Res 68 - 138 Authorizing Purchase of Lands for Park PurposesVillage of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 138 RESOLUTION AUTHORIZING PURCHASE OF LANDS FOR PARK PURPOSES WHEREAS, Richard Parranto, the negotiator retained by the Village for the purpose of negotiating sites for Village open land and park purposes, has presented proposed Earnest Money Contracts calling for the purchase of certain parcels for said purposes by the Village, and WHEREAS, said Earnest Money Contracts,all of which have been signed by the landowners, cover the following properties and are in the following amounts: LANDOWNER: George A. Kehl PROPERTY DESCRIPTION: Lot Twenty -Two (22), Caroline's Lakeview (Site No. 2, Parcel No. 1) PURCHASE PRICE: $8,100.00 ($300.00 of which is to be as reimburse- ment for printing expenses and $300.00 of which is to be as reimbursement for moving expenses) LANDOWNER: Elwin B. and Helen S. Spear PROPERTY DESCRIPTION: Lot Thirty -Four (34), Auditor's Subdivision No. 3, Section Twenty -Four (24), Township Twenty -Eight (28) North, Range Twenty -Three (23) West (Site No. 5, Parcel No. 2) PURCHASE PRICE: $23,000.00 LANDOWNER: C. F. Small PROPERTY DESCRIPTION: That part of the South Third (S 1/3). of the South Half (S 1/2) of the Southeast Quarter (SE 1/4) of the Southwest Quarter (SW 1/4) which is East of the straight line extension of the East right-of-way line of Lilac Lane as proposed to be extended except the East 293 feet thereof in Section Twenty -Three (23), Township Twenty -Eight (28) North, Range Twenty - Three (23) West, containing approximately 1.-86 acres (Site No. 4, Parcel.No. 5) PURCHASE PRICE: $7,440.00 and WHEREAS, the Earnest Money Contract with' respect to' the Spearj parcel provides that the Sellers are to have the option to rent the house and automobile garage upon said property for $75.00 per month from the date of possession to June 1, 1969, that the Seller shall have;the first option to rent said premises at the same rate beyond that date if the Village decides to rent said premises beyond June 1,1969, and{ te WHEREAS, with respect to the Small parcel, the Earnest Money Contract provides that the Village, at its own expense shall survey the property and that the purchase price of said property shall be increased or�' decreased if said survey shows the parcel to contain more or less than 1.86 acres, said adjustment to be at the rate of $4,000.00 per acre, and WHEREAS, the purchase of said properties upon the terms and conditions hereinabove contained, is in the best interest of the Village. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota -Heights, as -follows: 1) That the Mayor and the Clerk of the Village are hereby authorized and directed to execute the Earnest Money Contracts -hereinabove described on behalf of the Village, and .2) That the Village Attorney be and is hereby authorized and directed to take all steps necessary to consummate the `purchase of said properties upon the terms and conditions hereinabove contained.
