RESOLUTION NO. 150
RESOLUTION AUTHORIZING PURCHASE OF EASEMENTS
FOR SANITARY SEWER PURPOSES AND AUTHORIZING
PURCHASE OF LANDS FOR PARK PURPOSES
WHEREAS, Richard Parranto, the negotiator retained by the Village
for the acquisition of easements for the Village sanitary sewer
improvement project (Improvement No. 4, Project No. 7) has presented
to the Village Council Earnest Money Contracts providing for the
granting to the Village of sanitary sewer easements over certain
property in the Village hereinafter described, and
WHEREAS, said negotiator in the course of negotiating the acquisition
of certain of said easements required for said sanitary sewer system
has negotiated for the purchase of property the value of which to the
owners thereof would otherwise be substantially reduced by reason of
the taking by the Village of said sanitary sewer easements, and
WHEREAS, the properties covered by said sanitary sewer easements
are presently subject to the condemnation proceedings heretofore com-
menced by the Village for the purpose of acquiring said easements
(Village of Mendota Heights v. Rasmussen, et al.), and
WHEREAS, said Earnest Money Contracts, all of which have been signed
by the landowners or their duly authorized agent, cover the following
properties and are in the following amounts:
PROPERTY DESCRIPTION: Parcel No. 3 and fee simple title to
the property owned by the landowner
lying southwesterly of the permanent
easement included in said Parcel No. 3.
LANDOWNERS: Mary Wachtler, Emma Donovan, Elfreda
Cherrier
PURCHASE PRICE: $1,500.00 (The additional land being pur-
chased lying southwesterly of the permanent
sanitary sewer easement has been severed
by virtue of said sanitary sewer easement
and is accordingly included in arriving at the
consideration paid for the sanitary sewer
easement hereunder.)
PROPERTY DESCRIPTION: Fee simple title to all that part of Lot
Three (3), Auditor's Subdivision No. 2
situated in the Northeast Quarter (NE 1/4)
of the Southeast Quarter (SE 1/4) of Sec-
tion Twenty -Three (23), Township Twenty -
Eight (28) North, Range Twenty -Three (23)
West, Dakota County, Minnesota lying Easterly
of Freeway 35E including Parcel No. 4 in
said condemnation proceedings.
LANDOWNER: The Estate of Gustave Weber a/k/a Gustav
Weber
PURCHASE PRICE: $12,000.00 (The total purchase price shall
be allocated as follows:
Improvement No. 4, Project No. 7
(Sanitary Sewer) - $7,900.00
Parks - $4,100.00)
PROPERTY DESCRIPTION: Parcel No. 6 and fee simple title to that
portion of Government Lot Eight (8) in the
Northeast Quarter (NE 1/4) of Section Twenty -
Three (23), Township Twenty -Eight (28), Range
Twenty -Three (23), Dakota County, Minnesota,
lying Southwest of the permanent easement
described in said Parcel No. 6.
LANDOWNER:
Mary Wachtler
PURCHASE PRICE: $1.00 subject to the understanding and agree-
ment on the part of the Village that the re-
quirement of contribution for park purposes
will be waived with respect to any sub-
sequent subdivision of all or any part of
Government Lot Eight (8) which is presently
owned by said landowner, and
WHEREAS, the purchase of said properties upon the terms and conditions
hereinabove contained is in the best interest of the Village.
NOW THEREFORE, IT IS HEREBY RESOLVED by the,Village Council of the
Village of Mendota Heights, as follows: -
1) That the Mayor and the Clerk are hereby authorized and directed
to execute the Earnest Money Contracts hereinabove described on
behalf of the Village, and
2) That the Village Attorney be and is hereby authorized and
directed to take all steps necessary to consummate the purchase

of said properties upon the terms and conditions hereinabove
contained.
Adopted by the Village Council of the Village of Mendota Heights this
16th day of April, 1968.
