Res 68 - 159 Authorizing Purchase from McCloud-Allstrom of Easements for Sanitary Sewer Purposes & Authorizing Purchase of Lands for Park PurposesVillage of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 159 RESOLUTION AUTHORIZING PURCHASE FROM McCLOUD-ALLSTROM OF EASEMENTS FOR SANITARY SEWER PURPOSES AND AUTHORIZING PURCHASE OF LANDS FOR PARK PURPOSES WHEREAS, Richard Parranto, the negotiator retained by the Village for the purpose of negotiating sites for Village open space and park purposes, has presented a proposed Earnest Money Contract calling for the purchase by the Village of the park site designated as Site No. 6 in his appraisal report to the Village, and WHEREAS, said Richard Parranto, as negotiator retained by the Village for the acquisition of easements for the Village sanitary sewer improvement project (Improvement No. 4, Project No. 7), has presented to the Village Council Earnest Money Contracts providing for the granting to the Village of sanitary sewer easements over certain property in the Village hereinafter described, and WHEREAS, said negotiator in the course of negotiating the acquisition of certain of said easements required for said sanitary sewer system has negotiated for the purchase of property, the value of which to the owners thereof, would otherwise be substantially reduced by reason of the taking by the Village of said sanitary sewer easements, and WHEREAS, the properties covered by said sanitary sewer easements are presently subject to the condemnation proceedings heretofore com- menced by the Village for the purpose of acquiring said easements (Village of Mendota Heights v. Rasmussen, et al.), and WHEREAS, said Earnest Money Contracts, all of which have been signed by the landowners or their duly authorized agent, cover the following properties and are in the following amounts: PROPERTY DESCRIPTION: Subject to Marie Avenue, the South 700 feet of the East 660 feet of Government Lot 10, Section 23, Township 28 North, Range 23 West (Fee Title). LANDOWNERS: M. David McCloud C'. Naumann McCloud H. Willard Allstrom, Jr. Marjorie K. Allstrom PURCHASE PRICE: $16,920.00 (The purchase price is to be adjusted at the rate of $1,800.00 per acre if a survey discloses more or less than 9.4 acres). The above purchase price is to be allocated as follows: To Improvement No. 4, Project No. 7 (Sanitary Sewer) - $10,000.00 To Parks (Site No. 6) - $6,920.00 PROPERTY DESCRIPTION: Parcel No.*5 in the above described condemnation proceedings (Easement). LANDOWNERS: M. David McCloud C. Naumann McCloud H. Willard Allstrom, Jr. Marjorie K. Allstrom 26 PURCHASE PRICE: $757.00 PROPERTY DESCRIPTION: All that part of Government Lot Ten (10), Section 23, Township 28 North, Range 23 West, lying East of Highway No. 35E and West of the permanent sewer easement included in the description of Parcel No. 5 referred to above and except the South 700 feet of the East 660 feet of said Government Lot Ten (10) (Fee Title). LANDOWNERS: M. David McCloud C. Naumann McCloud H. Willard Allstrom, Jr. Marjorie K. Allstrom PURCHASE PRICE: $4,715.00 (This parcel has been severed by virtue of the permanent sanitary sewer easement included in Parcel No. 5 referred to above and accordingly the cost thereof is directly attributable to said sanitary sewer improvement project). (The purchase price is to be adjusted at the rate of $600.00 per acre if a survey discloses more or less than 7.86 acres). WHEREAS, the purchase of said properties upon the terms and conditions hereinabove contained is in the best interest of the Village. NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights, as follows: 1) That the Mayor and the Clerk are hereby authorized and directed to execute the Earnest Money Contracts hereinabove described on behalf of the Village, and -2- .1.4 f . .l 2) That the Village Attorney be and is hereby authorized and directed to take all steps necessary to consummate the purchase of said properties upon the terms and conditions hereinabove contained.
