RESOLUTION AUTHORIZING PURCHASE OF PROPERTY
FOR SANITARY SEWER PURPOSES
WHEREAS, Richard Parranto, who has been retained by the Village to
negotiate for the acquisition of easements for the Village sanitary
sewer improvement project (Improvement No. 4, Project No. 7) has
presented to the Village Council Earnest Money Contracts providing
for the granting to the Village of sanitary sewer easements over
certain property in the Village hereinafter described, and
WHEREAS, the properties covered by said easements are presently
subject to condemnation proceedings heretofore commenced by the
Village for the purpose of acquiring said easements (Village of
Mendota Heights v. Stefani, et al., Village of Mendota Heights v.
Rasmussen, et al.,) and
WHEREAS, said easements have been obtained from the following owners
in the Stefani, et al. condemnation proceedings over the following
described properties for the following consideration:
PROPERTY OWNER: Joseph L. Stefani
PROPERTY DESCRIPTION: Parcel No. 28 in the said condemnation
proceedings
PURCHASE PRICE: $263.00
PROPERTY OWNER: Terrance L. and Patricia M. Wannarka
PROPERTY DESCRIPTION: Parcel No. 33 in said condemnation
proceedings
PURCHASE PRICE: $235.00,
WHEREAS, one of said easements has been obtained from the following
owner in the Rasmussen, et al. condemnation proceeding over the
following described property and the following consideration:

PROPERTY DESCRIPTION: Parcel No. 13 in said condemnation
proceedings
PURCHASE PRICE: $100.00
WHEREAS, Mr. Parranto reported that Gerald J. and Marilyn Nelson the
owners of Parcel No. 58 in the Stefani, et al. condemnation proceeding
had signed an Earnest Money Contract under which they agreed to convey
to the Village fee simple title to the West 8 feet of Lots Fifteen (15)
and Twenty -One (21), Linden Addition together with a temporary easement
over the adjacent 2 feet in consideration for a total consideration
of $809.00 subject to the following conditions:
1) That for the purposes of an assessment for sanitary
sewer laterals said lots would be considered two 92 foot
lots, and
2) That said conveyance would not be deemed to reduce the
frontage of said lots for the purpose of determining whether
or not they were buildable lots under the Village ordinances.
and
WHEREAS, it is in the best interests of the Village to acquire said
sanitary sewer easements and fee simple title to said property of
Gerald J. and Marilyn Nelson upon the terms and conditions hereinabove
stated.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota Heights, Minnesota, as follows:
1) That the Mayor and Clerk are hereby authorized and
directed on behalf of the Village to execute said Earnest
Money Contracts providing for the acquisition of said
easements and fee simple title to said property of Gerald
J. and Marilyn Nelson by the Village upon the terms and conditions
hereinabove stated.
2) That the Village Attorney be and is hereby authorized
and directed to take all steps necessary to consummate
the acquisition of said sariitary sewer easements.
Adopted by the Village Council of the Village of Mendota Heights this
210 day of May, 1968.
