RESOLUTION NO. 167
RESOLUTION AUTHORIZING VILLAGE TO ENTER INTO
EASEMENT AGREEMENT WITH MOBIL OIL CORPORATION
FOR THE VILLAGE SANITARY SEWER SYSTEM
WHEREAS, in the construction of the proposed Village Master Sanitary
Sewer Trunk System, it is necessary that the Village obtain easements
to cross -certain property presently subject to easements in favor of
Mobil Oil Corporation and which is situated in the Village, and
WHEREAS, an Easement Agreement dated as of May 15, 1968, covering
the grant of said easements and the terms and conditions thereof, has
been submitted to this meeting by the Village Attorney, and
WHEREAS, said Easement Agreement has been executed on behalf of Mobil
Oil Corporation, and
WHEREAS, said Easement Agreement, among other things, provides that ,
the Village will indemnify and save Mobil Oil Corporation harmless from
and against any and`all claims and/or damages occurring by reason of
the Village or its agents, servants or contractors use of of construc-
tion of maintenance upon the premises covered by said Easement Agree-
ment, and
WHEREAS, it is-,necessary3�and in the -best interests of the Village
that the Village enter into said Easement Agreement.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota -Heights, Minnesota, as follows:
1) That the Mayor and Clerk of the Village of Mendota
Heights be and they are hereby authorized and directed
on behalf of the Village of Mendota Heights to enter into
and execute said Easement Agreement with Mobil Oil Corporation.
2) That.the Village pay to said Mobil Oil Corporation the total
sum of $1.00 as and for consideration for said easement.

this 18th day of June, 1968.
