Res 69 - 194 Accepting Commisioners Award as to Damages in the Stefani, Et Al. Condemnation ProceedingsVillage of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 194 RESOLUTION ACCEPTING COMMISSIONERS AWARD AS TO DAMAGES IN THE STEFANI, ET AL. CONDEMNATION PROCEEDINGS WHEREAS, the Village has heretofore commenced condemnation proceedings to acquire certain land for Village purposes, including lands needed for Improvement No. 4, Project No. 7C (Village Wide Sanitary Sewer Improvement Project) which proceedings have been known and designated as Village of Mendota Heights vs. Joseph L. Stefani, et al., and WHEREAS, under date of October 8, 1968, the Court appointed commissioners filed with the Clerk of the Dakota County District Court their award as to damages with respect to the parcels involved in said proceedings, and . WHEREAS, the Village Attorney, by his letter to the Village Council dated October 9, 1968, informed the Village Council of said awards and recommended that the Village accept said awards without filing an appeal therefrom, and WHEREAS, the Village Attorney in said letter recommended that if the landowners as to Parcel No. 53 in said proceedings filed an appeal from such award, then, and in such..event, the Village should also file an appeal from the commissioners award of damages entered as to said Parcel No. 53, and WHEREAS, pursuant to the Order of the Dakota County District Court dated October 8, 1968, the commissioners in said condemnation proceedings were awarded the following sums as consideration for their services and disbursements in such proceedings: Nick Vujovich Henry M. Gydesen Willard Ackerman and $657.75 $686.40 $690.00 WHEREAS, the Village Council has fully reviewed the awards made by said commissioners. NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights, Minnesota, as follows: 1) That the awards filed by the Court appointed commissioners on October 8, 1968, in the condemnation proceedings referred to above be and the same are hereby accepted by the Village and that, providing appeals are not taken therefrom by the respective land- owners the Village forthwith pay the amount of said awards to the parties in interest with respect to each respective parcel. 2) That if an appeal be taken by the landowners with respect to Parcel No. 53 in said proceedings, the Village Attorney be and is hereby authorized and directed to file an appeal from said award on behalf of the Village. 3) That the Village Clerk be and is hereby authorized and directed to attend to the payment of the sums awarded to the commissioners in said proceedings in accordance with the Order of the District Court of Dakota County dated October 8, 1968.
