RESOLUTION NO. 195,
RESOLUTION AUTHORIZING ACQUISITION OF
ADDITIONAL LANDS FOR PARK PURPOSES
WHEREAS, the Village has heretofore commenced condemnation proceedings
entitled Village of Mendota Heights v. Arthur Rasmussen, et al., for
the purpose of, among other things, acquiring easements for utility
purposes for the Village's water distribution and sanitary sewer
systems, and
WHEREAS, in said proceedings, the Village has heretofore determined
to take an easement for sewer and water purposes over the parcel
designated in said proceedings as Parcel No. 2, and
WHEREAS, the Village Council is of the opinion that it would be
in the best interest of the Village to amend the Petition in said
condemnation proceedings as to said Parcel No. 2 to include additional
property to be acquired by the Village for park purposes, and
WHEREAS, it would be in the best interest of the Village to acquire
fee simple title to the property included in the description of said
Parcel No. 2, as amended.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota Heights, Minnesota, as follows:
1) That the Petition in the condemnation proceedings
heretofore commenced by the Village entitled Village of
Mendota Heights v. Arthur Rasmussen, et al., be amended
to provide that the parcel designated as Parcel No. 2
in said proceedings be amended so as to include the
following described property situated in Dakota County,
Minnesota, to -wit:
That part of the Southwest Quarter (SW 1/4) of
the Northeast Quarter (NE 1/4) of Section Twenty -
Three (23)k Township Twenty -Eight (28), Range Twenty -
Three (23), Dakota County, Minnesota lying northerly
and easterly of the following described line:
Commencing at the Northeast corner of said
Southwest Quarter (SW 1/4) of the Northeast,
Quarter (NE 1/4); thence North 89035135" West,
along the Northerly line of said ' Southwest Quarter
(SW 1/4) of the Northeast Quarter_(NE 1/4), a distance
of 719.51 feet, to the actual point of beginning
of line to be described;
thence South 460_34115" East, a distance of
156.65 feet;
thence South 13056'40" East, a distance of
165.68 feet;
thence South 64030120" East, a distance of
92.72 feet;
thence South 61028'20" East, a distance of
113.92 feet;
thence South 77050150" East, a distance of
92.50 feet;
thence South 83°38'20" East, a distance of
69.45 feet;
thence South 38012100" East, a distance of
61.45 feet;
thence South 22°15'00" East, a distance of
62.95 feet;
thence South 23017'45" West, a distance of
83.70 feet;
thence South 00023105" East, a distance of
155.45 feet;
thence South 20059135" East, a distance of
95.40 feet;
thence South 13045155" East, a distance of
219.50 feet;
thence South 37059135" East, a distance of
166.50 feet, more or less,
to a point on the Easterly line of said Southwest Quarter.
(SW 1/4) of the Northeast Quarter (NE 1/4), said point
being 1157.3 feet Southerly -from -said Northeast corner
of said Southwest Quarter (SW 1/4) of the Northeast
Quarter (NE 1/4) and there terminating, excepting from
the above described tract, any portion lying within 60
feet of the Easterly right-of-way line of State Trunk
Highway No. 35E, and the parcel in the Northeast corner
owned by Northern States Power Company.
2) That fee simple title to the property included in the description
of Parcel No. 2 in said proceedings as amended be acquired by the
Village.
3) That the Village Attorney be and is hereby authorized
and directed to take all steps necessary to amend the Petition

and the proceedings in said condemnation action so as to
accomplish the foregoing.
Adopted by the Village Council of the Village of Mendota Heights this
15th day of October, 1968.
