Res 69 - 196 Authorizing Condemnation of Lands Necessary for Municipal Water & Sanitary Sewer PurposesVillage of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 196 RESOLUTION AUTHORIZING CONDEMNATION OF LANDS NECESSARY FOR MUNICIPAL WATER AND SANITARY SEWER PURPOSES (IMPROVEMENT 0. 68, PROJECT NO. 1, IMPROVEMENT NO. 63, PROJECT NO. 3, and IMPROVEMENT NO. 4, PROJECT NO. 7G) WHEREAS, the Village Council has heretofore determined to proceed with the construction of sanitary sewer improvements to serve the Friendly Hills Re -Arrangement area (heretofore known and designated as Improvement No. 68, Project No. 1), and WHEREAS, the Village Council has heretofore determined to proceed with the construction of the Village water distribution system along State Trunk Highway No. 13 (heretofore known and designated as Improvement No. 68, Project No. 3), and WHEREAS; the Village Council has heretofore determined to proceed with the construction of sanitary sewer improvements consisting of the construction of the Village's interceptor sanitary sewer system along State Trunk Highway No. 13 from Ramp No. 3 (Interstate Highway No. 35E to Lexington Avenue) heretofore known and designated as Improvement No. 4, Project No. 7G), and WHEREAS, to construct said improvements, it will be necessary for the Village to acquire fee simple title to some parcels of land and easements over certain other parcels of land for utility and street purposes. NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights, Minnesota, as follows: 1) That the Village Attorney be and is hereby authorized and directed on behalf of the Village of Mendota Heights to acquire by negotiation or by eminent domain proceedings, if necessary, all lands and properties required for the construction of said Improvement No. 68, Project No. 1, Improve- ment No. 68, Project No. 3, and Improvement No. 4, Project No. 7G, including -the acquisition of property for street purposes, if necessary, to facilitate the construction of,' said improvements.
