Res 69 - 203 Providing for Revocation of Building PermitVILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA Resolution No. °203 RESOLUTION PROVIDING FOR REVOCATION OF BUILDING PERMIT WHEREAS, a building perpit has heretofore been issued for the construc- tion of a one -family residence upon the property situated in the Village of Mendota Heights in Dakota County, Minnesota, more particularly de- scribed as: Lot Twenty -Seven (27), Tilsen's Highland Heights Addition No. Two (2) , and �4. WHEREAS, the building inspector of the Village of Mendota Heights has reported to the Village Council that the application for said Building Permit failed to properly disclose the drainage problems applicable to said lot, and WHEREAS, the Building Inspector and the Village Engineer have inspected the premises in question and reported to the Village Council that a pipe fourteen inches in diameter had been placed in the ground through said Lot 27 and that in the opinion of said Village Building Inspector and Village Engineer, said fourteen -inch pipe would be wholly inadequate to handle the drainage to and through said lot 27, and WHEREAS, the owner of said Lot 27 has been directed to replace said pipe with a pipe sufficiently larger in diameter to adequately handle the drainage to and through said Lot 27, and WHEREAS, the owner of said Lot 27 has refused to replace said fourteen - inch pipe or otherwise provide for an adequate drainage system to and through said Lot 27, and WHEREAS, The Building Inspector reported to the Village Council that the footings used in the construction of the foundation of the residence being constructed upon said Lot 27 were not in compliance with the pro- visions of the building code of the Village, and WHEREAS, the Building Inspector reported to the Village Council that the owner and/or builder of said residence upon said Lot 27 failed to request or obtain a "Foundation Inspection" as required under the provisions of the building code of the village, and WHEREAS, the Building Inspector reported to the Village Council that the cement contractor employed by the owner and/or builder of said residence was not licensed to perform cement work within the Village of Mendota Heights in accordance with the applicable ordinances of the Village, and WHEREAS, the above matters have been called to the attention of the builder and/or owner of said Lot 27, but that to date no action has been commenced by said owner and/or builder to correct the matters hereinabove set forth, and i WHEREAS, the Village Council is of the�Topinion that the continued con- struction of said residence under these circumstances set forth above would not be in the best interests of the,Village or of the residents of the Village, NOW, THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights, Minnesota, asjfollows: 1. That the building permit.,heretofore issued for the construction of a one -family residence upon Lot 27; Tilsen's Highland Heights Addition No. 2 be and is hereby revoked. I 2. That the owner and/or builder shall immediately cease and desist from any further construction upon said Lot 27 until the matters hereinabove set forth have been corrected and rectified to the satisfaction of the Village Council and in accordance with the applicable ordinances of the Village.; 3.
