Res 69 - 212 Authorizing Acting Mayor & Clerk to Execute Amendment to Contract with the US Dept of Housing & Urban Development Providing for a Grant to the Village to Acquire &/or Develop Land for Open Space PurposesVILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. _212 q c -r;4 RESOLUTION AUTHORIZINGAMAYOR AND CLERK TO EXECUTE AMENDMENT TO CONTRACT WITH THE U. S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT PROVIDING FOR A GRANT TO THE VILLAGE TO AC- QUIRE AND/OR DEVELOP LAND FOR OPEN -SPACE PUR- POSES UNDER TITLE VII OF THE HOUSING ACT OF 1961, AS AMENDED. WHEREAS, the Village of Mendota Heights has heretofore received a grant from the U. S. Department of Housing and Urban Development to assist the Village in acquiring open -space land for park and re- lated purposes pursuant to Title VII of the Housing Act of 1961, as amended, and WHEREAS, said project has been designated as Project No. MINN-OSA- 27, Contract No. MINN-OSA-27(g), and WHEREAS, under date of July 26, 1967, the Village entered into a written contract with the United States of America, Secretary of Hous- ing and Urban Development, covering the acquisition of land for said purposes, and WHEREAS,, it is hedessary and in the best interest of the Village to enter into a written agreement providing for the amendment of said contract in the following respects: a) Delete Site No. 5, Parcel No. 1, as more particularly de- scribed in Exhibit A attached to said contract and in place thereof substitute Site No. 5, Parcel No. 3, being the follow- ing described property situated in the Village of Mendota Heights, in Dakota County, Minnesota, to -wit: Lot One (1) Vandall's Outlots, Dakota County, Minnesota, except that part of the Southerly 158 feet of said Lot One (1) lying Easterly of the following described line: Beginning at a point on the South line7of the North- west Quarter (NW11/4) of Section Twenty -Four (24), Township Twenty -Eight (28), Range Twenty -Three (23)', Dakota County, Minnesota, said point being 1657.67 feet Easterly from the Southwest corner of said North- west Quarter (NW 1/4); thence Northerly at right angles 158 feet and there terminating. Sub7ect to Wentworth Avenue. w b) Delete Site No. 4, Parcel Numbers 1, 2, 3, and 4, and Site No. 7, Parcel No. 1, as more particularly described in Exhibit A attached to said contract, and WHEREAS, the U. S. Department of Housing and Urban Development has submitted a proposed form of amendment to said contract for said grant i� to acquire and/or develop open -space land, and WHEREAS, the execution of the amendment to said contract is in the best interests of the Village of Mendota Heights, NOW, THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village"of Mendota Heights as follows: 1) That thecM9 or -and Clerk of the Village of Mendota Heights be and are hereby authorized and directed to execute said amendment to said contract on behalf of the Village of Men- dota Heights, .. .
