Res 69 - 230 Authorizing Acting Mayor & Clerk to Enter into Pipe Line Agreement with the Chicago, Milwaukee, St. Paul & Pacific Railroad CompanyVillage of Mendota Heights Dakota County, Minnesota RESOLUTION NO. '230, RESOLUTION AUTHORIZINGMAYOR AND CLERK TO ENTER INTO PIPE LINE AGREEMENT WITH THE CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD COMPANY WHEREAS, in the construction of the extension of the Village water, storm sewer, and sanitary sewer systems to serve the Mendota Heights Industrial Park and the area adjacent thereto, it will be necessary that the Village secure permission to cross certain property and/or right-of-way of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company situated in Dakota County, Minnesota, and WHEREAS, the said railroad has submitted a proposed Pipe Line Agree- ment to the Village authorizing the Village to place, construct, maintain and use said systems upon the property and under the tracks of said railroad in accordance with the terms and conditions of said Pipe Line Agreement, and WHEREAS, the railroad requires a payment to it of $35.00 to cover its expense in preparing said Pipe Line Agreement, and WHEREAS, it is necessary and in the best interests of the Village that the Village enter into said Pipe Line Agreement. NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights, Minnesota, as follows: 1) That the Mayor and Clerk of the Village of Mendota Heights be and are hereby authorized and directed to execute said Pipe Lihb Agreement on behalf of the Village of Mendota Heights. 2) That the Village pay to said railroad the total sum of $635.00 to cover the railroad's charge for preparing said license agreement and as and for the consideration to be paid by the Village for the grant to it of said Pipe Line Agreement. Ae?-1 3) That the,,Mayor and Clerk be and are hereby authorized and directed to execute any and all additional papers or documents that may be required or necessary in order to consummate said Pipe Line Agreement.
