Res 70 - 290 Authorizing Settlement of Countryside Property Condemnation Appeals & Authorizing Payment ThereforVillage of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 290 RESOLUTION AUTHORIZING SETTLEMENT OF COUNTRYSIDE PROPERTY CONDEMNATION APPEALS AND AUTHORIZING PAYMENT THEREFOR WHEREAS, the Village heretofore commenced condemnation proceedings to acquire certain property owned by Countryside Company which property is designated as Parcel No. 1 in the proceedings entitled Village of Mendota Heights v. Countryside Company, et al., and WHEREAS, the"commi'ssioners appointed by the court in said condemnation proceedings filed their report with the District Court on November 22, 1968, wherein'they determined that the total amount of damages to be paid by the Village for the taking of said Parcel No. 1 amounted to $15,000, and WHEREAS, both Countryside Company and the Village have appealed from the commissioners' award of damages as to said Parcel No. 1, and WHEREAS, the Village has heretofore paid Countryside Company the sum of $11,250 as a partial payment of the commissioners' award of damages as to said Parcel No. 1, and WHEREAS, Countryside Company has agreed to dismiss its appeal in con- sideration for a total payment to it of $15,000 as damages by reason of the taking of Parcel No. 1 by the Village, and WHEREAS, the Village Attorney has presented a proposed stipulation for settlement of appeal as to Parcel No. 1 executed by Countryside Company providing for the dismissal of said appeals in consideration for the total payment to Countryside Company of $15,000, and WHEREAS, the Village Council is of the opinion that said proposed settlement is a reasonable and provident one and in the best interest of the Village. NOW THEREFORE, it is hereby resolved by the Village Council of the Village of Mendota Heights, Minnesota as follows: 1) That the proposed stipulation for settlement of appeal_as to Parcel No. 1 presented to the meeting by the Village Attorney be and is hereby approved and the Village Attorney is hereby authorized and directed to execute the said stipulation on behalf of the Village. 2) That the Village pay to Countryside Company at this time the additional sum of $3,750 representing a total of $15,000 as consideration for the taking by the Village of said Parcel No. 1. 3) The Village Attorney be and is hereby authorized and directed to execute any and all additional papers and to take such further steps as may be necessary to consummate said settlement.
