RESOLUTION NO. 297
RESOLUTION REFUNDING ASSESSMENT AND PRO-
VIDING FOR THE.DEFERMENT OF THE MAKING
OF ASSESSMENT
WHEREAS, pursuant to the assessment roll heretofore adopted by the
Village Council for the construction of an extension to the Village
Sanitary Sewer System along Second Avenue (which improvements have
heretofore been.known and designated.as.Improvement.No. 4, Project
No. 6), an assessment was levied against the following property of
Theodore and Mary Cruz situated in the -Village of Mendota Heights,
to -wit:
Parcel No. 26913-I (Lot 11, Block 2, T. T. Smith's
Subdivision No. 4, Dakota County, Minnesota),
and
WHEREAS, said assessment was in the total amount of $450, and
WHEREAS, a total of $123.29 in principal and interest has been paid
to date by said Theodore and Mary Cruz with respect to said assess-
ment, and • ' ••• • •
WHEREAS,. the Village Council is of the•opinion-that said property
at the present -time is not a fit and proper lot for building
purposes under the applicable Village ordinances, and
WHEREAS, the Village Council is of the opinion that the Village
should defer the making of an assessment as to the above described
property until such time as said property is determined to be a fit
and proper lot for building purposes under the applicable Village
ordinances.
NOW THEREFORE, it is hereby resolved by the Village Council of the
Village of Mendota Heights, Minnesota, as follows:
1) The assessment heretofore levied by the Village against
the above described property pursuant to Improvement No. 4,
Project No. 6 be and the same is hereby cancelled.
2) That the Village shall forthwith refund to Theodore and
Mary Cruz the total sum of $123.29 heretofore paid by them
under and pursuant to the assessment roll adopted for said
Improvement No. 4, Project No. 6.
3) That the Village shall defer the making of an assessment
as to the above described property by reason of said Improvement
No. 4, Project No. 6 until such time as said property is a fit
and proper lot for building purposes under the applicable
Village ordinances.
Adopted by the Village Council of the Village of Mendota Heights this
20th day of January, 1970.
