RESOLUTION NO. 305
RESOLUTION ORDERING PROPOSED CONSTRUCTION
OF A WATER DISTRIBUTION SYSTEM, SANITARY
AND STORM SEWER SYSTEMS AND STREET, CURB,
AND GUTTER IMPROVEMENTS TO SERVE THE WILLOW
SPRINGS AND BRECKENRIDGE ESTATES SUBDIVISIONS
AND ADJACENT AREAS AND PREPARATION OF PLANS
AND SPECIFICATIONS THEREFOR,
WHEREAS, a public hearing was held on the 10th day of February, 1970,
at 8:00 o'clock P.M. at the Village Hall of the Village of Mendota
Heights, Minnesota, pursuant to resolution adopted by the Village
Council of the Village of Mendota Heights on January 6, 1970, on
the question of the proposed construction of the following described
improvements:
The construction of an extension to the Village sanitary
sewer system, including appurtenances and incidentals
thereto, and the acquisition of easements, and the re-
construction where necessary of streets in the area more
particularly described in the resolution calling for
said hearing.
The construction of a storm sewer system including appur-
tenances and incidentals thereto and the acquisition of
easements., in and for the area more particularly described
in the resolution calling for said hearing.
The construction of an extension to the Village water
distribution system including appurtenances and inci-
dentals thereto, and the acquisition of easements, and
the reconstruction where necessary of streets in the
area more particularly described in the resolution calling
for said hearing.
The construction of street improvements consisting of the
grading, stabilization, drainage and bituminous surfacing,
and the construction of concrete curbs and gutters on the
streets to be situated in the area more particularly
described in the resolution calling for said hearing, and
WHEREAS, due publication of the notice of public hearing on said pro-
posed construction has been attended to, and
WHEREAS, mailed notice of said hearing has been mailed more than 10
days before the date of said hearing to the owners of each parcel
situated within the area proposed to be assessed, all in accordance
with the applicable Minnesota Statutes, and
WHEREAS, the Village Engineer reported that the proposed improvements
and construction thereof were feasible and desirable and further
reported on the proposed costs of said improvements and construction
thereof, and
WHEREAS, the Village Council then proceeded to hear all persons
interested in said improvements and all persons were afforded an oppor-
tunity to present their views and objections to the making of said
improvements.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota Heights, Minnesota, as follows:
1) That it is advisable, feasible, expedient and necessary that
the Village of Mendota Heights construct the above described
improvements, and it is hereby ordered that said improvements
be made save and except that this resolution shall not be
deemed to include said improvements within the following des-
cribed area situated in the Village of Mendota Heights in
Dakota County, Minnesota, to -wit:
All properties abutting Wachtler Avenue, Wentworth
Avenue and Dodd Road in the Southeast one-fourth of the
Northeast one-fourth (SW 1/4 of NE 1/4) and the North
330 feet of the East 330 feet of the Southeast one-
fourth (SE 1/4) in Section 23, the South one-half of
the Northwest one-fourth (S 1/2 of NW 1/4) and the
North one-half of the Southwest one-fourth (N 1/2 of
SW 1/4) in Section 24.
2) That the Village Engineer be and is hereby instructed
to proceed with the preparation of the necessary plans
and specifications for said improvements.
3) That hereafter said improvements shall be known and
designated as Improvement No. 70, Project No. 3.
Adopted by the Village Council this 17th day of February, 1970.
