RESOLUTION NO. 350
RESOLUTION ACCEPTING ENGINEER'S REPORT AND CALLING
FOR HEARING ON PROPOSED CONSTRUCTION OF A WATER
DISTRIBUTION SYSTEM AND SANITARY SEWER SYSTEM TO
SERVE WENTWORTH AVENUE BETWEEN DODD ROAD AND
DELAWARE AVENUE AND THE ANDREWS-MAHER PROPERTIES
WHEREAS, the Village Engineer has submitted his report to the Village
Council with respect to the proposed construction of the following
improvements:
The construction of an extension to the Village sanitary
sewer system, including appurtenances and incidentals
thereto, and the acquisition of easements, and the recon-
struction where necessary of streets in the area hereinafter
more particularly described.
The construction of an extension to the Village water distri-
bution system including appurtenances and incidentals
thereto, and the acquisition of easements, and the recon-
struction where necessary of streets in the area hereinafter
more particularly described.
WHEREAS, the area proposed to be assessed for said improvements is
situated within the Village of Mendota Heights, and is more parti-
cularly described as follows:
All of that portion of the NE 1/4 Section 24 T.28,
R. 23 lying north of Wentworth Avenue, and between
Dodd Road (State Trunk Highway No. 49) and Delaware
Avenue (Highway No. 63) together with that portion
of the SE 1/4 of Section 24 T. 28, R. 23 which lies
within the following described line:
Commencing at the East 1/4 corner of Section 24
T.. 28, R. 23 (center of Wentworth Avenue and Delaware
Avenue) thence southerly a distance of approximately
660 feet, thence westerly a distance of 1320 feet,
thence southerly a distance of 660 feet, thence
westerly a distance of 920 feet, thence northerly a
distance of 764.44 feet, thence westerly a distance
of 401 feet, thence northerly a distance of 410.4
feet, thence westerly a distance of 252.26 feet to
the centerline of Dodd Road, thence northeasterly
along the centerline of Dodd Road to the intersection
of Dodd Road and Wentworth Avenue, thence easterly
along the centerline of Wentworth Avenue to the point
of beginning at the intersection of Delaware Avenue,
and there terminating.

WHEREAS, in said report said Village Engineer reported that the
proposed improvements and construction thereof were feasible and
desirable and further reported on the proposed costs of said improve-
ments.
NOW THEREFORE, it is hereby resolved by the Village Council of the
Village of Mendota Heights, Minnesota as follows:
1) That the report of said Village Engineer be and
is hereby received, and
2) That a public hearing on said improvements be held
on Tuesday, July 7, 1970 at 8:00 o'clock P.M. at the Village
Hall of the Village of Mendota Heights, and
3) That the Village Clerk, with the aid and assistance
of the Village Attorney, be and is hereby authorized and
directed to prepare a notice of said hearing and to
cause said notice to be published and mailed to the
owners of the property situated within said area, all
in accordance with the applicable Minnesota Statutes.
Adopted by the Village Council of the Village of Mendota Heights
this 2nd day of June, 1970.

J. R. RITCHAY, being duly sworn, on oath says he is and during all times here stated
has been the vice president and printer of the newspaper known as The West St. Paul Sun
and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in
the English language in newspaper format and in column and sheet form equivalent in printed
space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least
:ince each week. (3) Said newspaper has 50% of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholly duplicate any other
publication and is not made up entirely of patents, plate matter and advertisements. (4) Said
newspaper is circulated in and near the municipality which it purports to serve, has at least
500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total
circulation currently paid or no more than three months in arrears and has entry as second-
class matter in its local post -office. (5) Said newspaper purports to serve the City of West
St. Paul and Villages of Mendota and Mendota Heights in Dakota County and it has its known
office of issue in the Village of Inver Grove Heights in said county, established and open during
its regular business hours for the gathering of news, sale of advertisements and sale of sub-
scriptions and maintained by the managing officer or persons in its employ and subject to his
direction and control during all such regular business hours and devoted exclusively during
such regular business hours to the business of the newspaper and business related thereto.
(6) Said newspaper files a copy of each issue immediately with the State Historical Society.
(7) Said newspaper has complied with all foregoing conditions for at least two years preceding
the day or dates of publication mentioned below. (8) Said newspaper has filed with the
Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an
affidavit in the form prescribed by the Secretary of State and signed by the publisher of said
newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
He further states on oath that the printed Notice of hearing
hereto attached as a part thereof was cut from the columns of said newspaper, and was printed
and published therein in the English language, once each week, for tW0 successive
