Res 70 - 397 Providing for Settlement of Stacker Condemnation AppealVillage of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 397 RESOLUTION PROVIDING FOR SETTLEMENT OF STACKER CONDEMNATION APPEAL WHEREAS, the Village has heretofore commenced condemnation pro- ceedings for the purpose of acquiring certain easements for the Village sanitary sewer system which proceedings have heretofore been known and designated as Village v. Stefani et al., and WHEREAS, the Village took possession of the parcel known and desig- nated in said condemnation proceedings as Parcel No. 51 as of May of 1968, and WHEREAS, the owners and respondents with respect to said Parcel 51 are as follows: Howard G. Stacker, Robert J. Tansey and Helen M. Tansey, husband and wife, William H. Muske and Elsie K. Muske, husband and wife, Marline Singer and Herbert I. Singer, husband and wife and WHEREAS, the commissioners appointed by the District Court in said condemnation proceedings on October 8, 1968, filed their award in the amount of $2,500.00 for damages by reason of the taking by the Village of said Parcel 51, and WHEREAS, both the landowners and the Village have appealed from the commissioners' award as to damages, and WHEREAS, there is a serious question that has been raised with respect to the damages to which the landowners are entitled by reason of the taking by the Village of said Parcel No. 51 by reason of the fact that the easement in effect cuts said property in two, and WHEREAS, the landowners have agreed to settle their appeal as to said Parcel No. 51 in consideration for a total payment to them by the Village of $4,250.00, and WHEREAS, it appears to be in the best interests of the Village to acquire said Parcel No. 51 in consideration for a total payment to said landowners of $4,250.00. NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights as follows: 1) That the Village hereby authorizes and approves the total payment of $4,250.00 to the landowners herein- above named in full settlement and as consideration for the taking by the Village of said Parcel No. 51. 2) That the Village Attorney be and is hereby authorized and directed to execute any and all papers and documents necessary to effectuate said settlement.
