Res 71 - 414 Adopting & Confirming Corrected Assessment Roll for Improvement #68, Project #5Village of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 414 RESOLUTION ADOPTING AND CONFIRMING CORRECTED ASSESSMENT ROLL FOR IMPROVEMENT NO. 68, PROJECT NO. 5 (CONSTRUCTION OF SANITARY SEWER, STORM SEWER, WATER DISTRIBUTION SYSTEM AND STREET, CURB, AND GUTTER IMPROVE- MENTS TO SERVE HIGHLAND HEIGHTS SOUTH SUBDIVISION AND ADJACENT AREAS) BE IT RESOLVED by the Village Council of the Village of Mendota Heights as follows: WHEREAS, the Village Clerk with -the assistance of Edward Kishel, Engineer for the Village of Mendota Heights, has calculated the proper amount of the corrected assessment roll showing the amounts to be specially assessed for Improvement No. 68, Project No. 5 (construction'of sanitary sewer, storm sewer, water distribution system, and street, curb, and gutter improvements to serve the Highland Heights South Subdivision and adjacent areas) against every assessable lot, piece or parcel of land affected thereby upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Chapter 429, Minnesota Statutes Annotated, par- ticularly of Section 429.051 thereof; and 4 WHEREAS, the proposed corrected assessment roll has been on file with the Clerk and at all times since its filing has been open for public inspection; and notice thereof has been duly mailed as required by law. Said notice stated the date, time and place of such meeting; the general nature of the improvement; the area proposed to be assessed;+ that the proposed corrected assessment roll has been on file with the Clerk; and that written or oral objections thereto by any property owner would be considered; and WHEREAS, said hearing was held at 8:00 o'clock P.M. on May 18, 1971, at the Mendota Heights Village Hall in the Village of Mendota Heights, Minnesota; and WHEREAS, the Mayor announced that the hearing was open for the con- sideration of objections, if any, to said proposed assessments; and WHEREAS, all persons present were then given an opportunity to present oral objections, and there were no written or oral objections presented; and i X k� NOW THEREFORE, this Council, being fully advised in the premises, an having made all necessary adjustments and corrections, finds that each of the lots, pieces and parcels of land enumerated in the pro- posed corrected assessment roll was and is specially benefited by the construction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and that such amount so set out is hereby levied against each of the respective lots, pieces and parcel of land therein described; and BE IT FURTHER RESOLVED, that the proposed corrected assessment roll is hereby adopted and confirmed as the proper special assessment for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, together with interest at the ra of seven per cent (7%) per annum accruing on the full amount thereof from time to time unpaid, shall be a lien concurrent with general taxes upon such parcel and all thereof. The first annual installmen of principal and interest relative to each of said assessments (pur- suant to said assessment roll adopted on November 5, 1970) heretofor certified by the Village to the Dakota County Auditor for collection with real estate taxes payable in the year 1971 shall remain as is and shall be deemed the first annual installment (including interest of said special assessments determined under said corrected assessme. roll. The balance of each of said corrected assessments remaining after the deduction for that portion of said first annual installmen constituting principal (of said corrected assessments) shall be paid in eighteen (18) equal installments except the balance of said asses ments attributable to street improvements shall be paid in nine (9) equal installments together with one year's interest (at the rate of 7% per annum) on the total of all unpaid installments with general taxes for each consecutive year thereafter until the entire assessme has been paid in full, and BE IT FURTHER RESOLVED, that the Clerk thereafter shall prepare and transmit to the County Auditor a certified duplicate of said correct assessment roll with each then unpaid installment and interest set forth separately, to be extended upon the proper tax lists of the County, and the County Auditor shall thereafter collect said assess- ments in the manner provided by law.
