RESOLUTION NO. 411
WHEREAS, the Village of Lilydale by letter addressed to this Village
on March 22, 1971, informed this Village that the Village of Lilydale
had then recently issued a building permit for the construction of
two eighty -unit apartment buildings on a parcel of land purported
to be situated within the Village of Lilydale containing approxi-
mately 8 acres and described as follows:
A part of Lot 9, Auditor's Subdivision No. 2,
Mendota, and part of Lot 26, Beaudette's Addition
lying westerly of Lexington Avenue with a frontage
of 368.3 feet on Lexington Avenue, and

WHEREAS, in said letter the Village of Lilydale, on behalf of Inland
Construction Corp., requested that the above described property
be connected to the Mendota Heights sanitary sewer and water distri-
butions systems, and
WHEREAS, the Village Council by resolution has heretofore determined
to reject the request made for connection of the above described
property to the Mendota Heights sanitary sewer and water distribu-
tion systems, and
WHEREAS, the above described property (which is represented to be
situated in the Village of Lilydale) is virtually surrounded on all
sides by property situated within the Village of Mendota Heights, and
WHEREAS, all of the adjacent Mendota Heights property is presently
zoned R-1 (One Family Residential District) under the Mendota Heights
Zoning Ordinance and is presently occupied by single family residences
all of which are of a high quality and very well maintained, and
WHEREAS, the comprehensive plan of the Village heretofore adopted
provides that the area of Mendota Heights in the vicinity of the
above described property is to be devoted solely to single family
residences and the development of such area has been in accordance
with the Village's comprehensive plan, and
WHEREAS, the Village of Lilydale by resolution adopted December 3,
1970, and published on December 16, 1970, purported to rezone the
above described property to a Multiple Dwelling District without
prior notice to or consultation with the Village of Mendota Heights
or any of the Mendota Heights residents situated adjacent to or in
close proximity to the above described property, and
WHEREAS, the proposed use of said property for high density multiple
purposes is incompatible with the present use and character of the
surrounding area situated in the Village of Mendota Heights as well
as the proposed development of the area in general, and
WHEREAS, the Mendota Heights sanitary sewer and water distribution
systems were designed under the assumption that the property in the
area of the above described parcel would be used solely for single -
family residential purposes, and
WHEREAS, the Village Engineer has advised the Village Council that
the high density proposed for an apartment project on the above des-
cribed property would cause a severe strain on the overall capacity
of the Mendota Heights sanitary sewer and water distribution systems
and the ability of such systems to serve all property within the
Village of Mendota Heights, and by reason thereof, the Village
Engineer has recommended against allowing the connection of the
proposed apartment project to the Mendota Heights sanitary sewer
and water distribution systems until such time as the question of
overall capacity of the Village's sanitary sewer and water distri-
bution systems has been finally resolved with respect to the needs
therefor by.all properties presently situated within the Village of
Mendota Heights, and
WHEREAS, the Village Council has been informed that the developer
intends to proceed with the construction of said apartment complex
regardless of whether or not said property is permitted to connect
to the Mendota Heights sanitary sewer and water distribution
systems, and
WHEREAS, the questions presented with respect to the above described
property and the proposed use thereof requires an area -wide approach
and planning and the coordinated and cooperative action of the affected
governmental units to -wit, the Village of Mendota Heights and the
Village of Lilydale, and
WHEREAS, the questions presented with respect to the above described
property are not predominantly local but relate to and vitally affect
both the Village of Mendota Heights and the Village of Lilydale
and will have a substantial effect on metropolitan area development.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota Heights, Minnesota, as follows:
1) That this matter be referred to the Metropolitan
Council for its investigation and review as well as
its recommendations and advice with respect to the
questions hereinabove described, and
2) That the Village Attorney'be and he is hereby
authorized and directed on behalf of this Village to
deliver any and all plans, documents, and papers requested
by or which will assist the Metropolitan Council in its
investigating and review of the questions hereinabove
presented.
