RESOLUTION NO. 405
RESOLUTION AUTHORIZING PURCHASE OF LANDS
AND EASEMENTS FOR,VILLAGE PURPOSES
WHEREAS, Richard Parranto who has been retained by the Village to
negotiate for the acquisition of property for the pending Village
improvement projects, has presented to the Village Council earnest
money contracts providing for the granting to the Village of ease-
ments over certain property in the Village hereinafter described,
and
WHEREAS, the properties covered by said easements are presently
subject to condemnation proceedings heretofore commenced by the
Village for the purpose of acquiring'said easements, and
WHEREAS, said easements have been obtained with respect to the
following described improvement projects from the following owners
over the following described property and for the following con-
sideration:

WHEREAS, the Village Attorney reported to the Council that an
agreement had been reached with Mr. and Mrs. John J. Lapakko pro-
viding for an utility easement over the Lapakko property in considera-
tion for the payment to the Lapakkos of $50.00, and

WHEREAS, the Lapakko property is more particularly described as
Parcel No. 2 (Improvement 69, Project No. 1) in those certain
condemnation proceedings heretofore commenced by the Village relative
to the Rogers Lake Sewer and Water Improvement Project (Improvement 69,
Project No. 1), and
WHEREAS, it is in the best interests of the Village to acquire said
easements upon the terms and conditions hereinabove stated, and
WHEREAS, Richard Parranto also presented to the Village an earnest
money contract providing for the acquisition by the Village of cer-
tain property owned by Mrs. Alma Fischer more particularly described
as all of the property east of proposed Trunk Highway No. 49 in the
Northwest quarter of Section 25, Township 28 North, Range 23 West,
Dakota County, Minnesota, presently owned by said Alma Fischer in
consideration for payment to Mrs. Fischer by the Village of the
total sum of $8,650.00, and
WHEREAS, the acquisition of said property is required with respect
to Improvement 70, Project No. 5, which parcels are described
therein as Parcel No. 10 and Parcel No. B, and
WHEREAS, it is in the best interests of the Village to acquire said
property upon the terms and conditions hereinabove stated.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota Heights, Minnesota, as follows:
1) That the Acting Mayor and Clerk are hereby authorized
and directed on behalf of the Village to execute said
earnest money contracts providing for the acquisition
of said property upon the terms and conditions hereinabove
stated.
2) That the Village Attorney be and is hereby authorized
and directed to take all steps necessary to consummate the
acquisition of the above described property upon the terms
and conditions hereinabove stated.
Adopted by the Village Council of the Village of Mendota Heights
this 16th day of March, 1971.
