RESOLUTION ACCEPTING ENGINEER'S FEASIBILITY
REPORT AND CALLING FOR HEARII>1G ON PROPOSED
CONSTRUCTION OF A STORM SEWER SYSTEM TO
SERV� CERTAIN PROPERTIES LOCATED IMMEDIATELY
TO THE NORTH OF FRIENDLY HILLS REARRANGEMENT
AND ORDERING PLANS AND SPECIFICATIONS THEREFOR
WHEREAS,the Village Engineer has submitted his report to the Village
Council with respect to the proposed construction of the following
improvements:
The construction of a storm sewer system, including
appurtenances and incidentals thereto to serve the
property hereinafter more particularly described, and
WHEREAS, the area proposed to be assessed for said improvements is
situated within the Village of Mendota Heights, Minnesota, and is
more particularly described as all property abutting the following
described property, to-wit:
The North 60 feet of the South 260 feet of that part of
the Northwest 1/4 of the Southwest 1/4 of Section 25,
Township 28 North, Range 23 West lying westerly of
the westerly right of way line of proposed New State
Trunk Highway No. 49.
WHEREAS, in said report, said Village Engineer reported that the pro-
posed improvements and construction thereof were feasible and
desirable and further reported on the proposed cost of said improve-
ments;
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota Heights, Minnesota, as follows:
1) That the report of said Village Engineer be and is
hereby received, and -
2) That a public hearing on said improvements be hel.d
on Tuesday, April 4, 1972, at 8:00 o'clock P.M. at the
Mendota Heights Village Hall located at 2010 South Lexington
Avenue in the Village of Mendota Heights, and
3) That the Village Clerk, with the aid and assistance
of the Village Attorney, be and is hereby authorized

and directed to prepare a notice of said hearing and
to cause said notice to be published and mailed to the
owners of the property situated within said area, all in ,
accordance with the applicable Minnesota Statutes, and
4) That the Village Engineer be and is hereby instructed
to proceed with the preparation of the necessary plans
and specifications for said improvements.

J. R. RITCHAY, being duly sworn, on oath says he is and during all times here stated
has been the vice president and printer of the newspaper known as The West St. Paul Sun
and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in
the English language in newspaper format and in column and sheet form equivalent in printed
space to at least 990 square inches. (2) Said newspaper is a weekly and is distributed at least
once each week. (3) Said newspaper has 50% of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholiy duplicate any dther
publication and is not made up entirel,v of patents, plate matter and advertisements. (4) Said
newspaper is circulated in and near the municipality which it purports to serve, has at least
500 copies regularl,y delivered to pa,ying subscribers, has an average of at least 75% of its total
circulation currently paid or no more than three months in arrears and has entry as second-
class matter in its local post-office. (5) Said newspaper purports to serve the City of West
St. Paul and Villages of Mendota and Mendota Heights in Dakota Count,y and it has its known
office of issue in the Village of Inver Grove Heights in said county, established and open during
its regular business hours for the gathering of news, sale of advertisements and sale of sub-
scriptions and maintalned by the managing officer or persons in its employ and subject to his
direction and control during all such regular business hours and devoted exclusively during
such regular business hours to the business of the newspaper and business related thereto.
(6) Said newspaper files a copy of each issue immediately with the State Historical Society.
(7) Said newspaper has complied with all foregoing conditions for at least two years preceding
the day or dates of publication mentioned below. (8) Said newspaper has filed with the
Secretary of State of Minnesota prior to JanuarY 1, 1966 and each January 1 thereafter an
affidavit in the form prescribed by the Secretary of State and signed by the publisher of said
newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
He further states on oath that the printed Notice of Hearin�
hereto attached as a part thereof was cut from the columns of said newspaper, and was printed
and published therein in the English language, once each week, for '�70 cuccessive
