RESOLUTION NO. 480
RESOLUTION CALLING FOR HEARING ON PROPOSED
VACATION OF A PORTION OF HAZEL STREET
WHEREAS, a petition has been duly presented to the Village Council
of the Village of Mendota Heights requesting the vacation of the
following street situated in the Village of Mendota Heights, which
petition has been signed by a majority of the owners of the property
abutting upon the following described street situated in the Village
of Mendota Heights in Dakota County, Minnesota, to-wit:
All that part of the street known as Hazel Street lying
Easterly of the Easterly right of way line of State
Trunk Highway No. 49 (also sometimes known as Jefferson
Highway) situated between Lots 9 and 10, and Lots 11 and
12 in Haselberger Addition.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota Heights, Minnesota as follows:
1) That a hearing on said petition to vacate the above
described street shall be held in the Village Hall of
the Village of Mendota Heights at 8:00 o'clock P.M. on
Tuesday, May 16, 1972.
2) That the Village Clerk with the aid and assistance
of the Village Attorney is hereby authorized and directed
to attend to the publication and posting of a notice of
hearing on said petition to vacate the above described
street all in accordance with the Minnesota Statutes.
Adopted by the Village Council of the Village of Mendota Heights
this 18th day of April, 1972.

J. R. RITCHAY, being duly sworn, on oath says he is and during all times here stated
has been the vice president and printer of the newspaper known as The West St. Paul Sun
and has fuil knowledge of the facts �herein stated as follows: (1) Said newspaper is printed in
the English language in newspaper format and in column and sheet form equivalent in printed
space to at ]east 900 square inches. (2) Said newspaper is a weekly and is distributed at least
�nce each week. (3) Said newspaper has 50qo of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholly duplicate any other
publication and is not made up entirely of patents, plate matter and advertisements. (4) Said
newspaper is circulated in and near the municipality which it purports to serve, has at least
500 copies regularlp delivered to pa.ying subscribers, has an average of at least 75% of its total
circulation currently paid or no more than three months in arrears and has entry as second-
class matter in its local post-office. (5) Said newspaper purports to serve the City of West
St. Paul and Villages oY Mendota and Mendota Heights in Dakota Count.y and it has its known
office of issue in the Village of Inver Grove Heights in said county, established and open during
its regular business hours for the gathering of news, sale of advertisements and sale of sub-
scriptions and maintained by the managing officer or persons in its employ and subject to his
direction and control during all such regular business hours and devoted exclusively during
such regular business hours to the business of the newspaper and business related thereto.
(6) Said newspaper files a copy of each issue immediately with the State Historical Society.
(7) Said newspaper has complied with all foregoing conditions for at least two years preceding
the day or dates of publication mentioned below. (8) Said newspaper has filed with the
Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an
affidavit'in the form prescribed by the Secretary of State and signed by the publisher of said
newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
He further states on oath that the printed Notice of Hearin�
hereto attached as a part thereof was cut from the columns of said newspaper, and was printed
and published therein in the English language, once each week, for tW0 cuccessive
