RESOLUTION NO. 516
RESOLUTION PROVIDING FOR THE ACQUISITION
OF EASEMENT OVER MAJESKY PROPERTY
WHEREAS, in connection with the construction by the Village of water,
sanitary and storm sewer and street, curb and gutter improvements to
serve part of the Pagel Road area, it is necessary that the Village
acquire an easement over and across the following described property
situated in the Village of Mendota Heights, in Dakota County, Minnesota,
to-wit:
A permanent easement for utility purposes over and across
the following described tract of land, to-wit:
The East ten (.10) feet of Lot Thirteen (13), and the
West ten (10) feet ot Lot Six (6), Haselberger Addition
Together with a temporary easement for construction purposes
over and across the following described tract of land, to-wit:
The Westerly twenty (20) feet of the East thirty (30)
feet of Lot Thirteen (13) and the Easterly twenty (20)
feet of the West thirty (30) feet of Lot 6, Haselberger
Addition.
and
WHEREAS, the owners of said property are Joseph H. Majesky and Marie H.
Majesky, husband and wife, and
WHEREAS, the Village Attorney has reported to the Village Council that
the oc,rners of said property have agreed to convey said property to the
Village in consideration for a total payment to them of $500.00, subject
to the understanding that the assessment for street purposes against
Lot 13 of said Haselberger Addition by reason of the current construction
and improvement of Hazel Street shall be based upon a frontage of fifty-
four (54) feet on said Hazel Street, and
WHEREAS, it is in the best interests of the Village to acquire said
property of Mendota Heights,-Minnesota, subject to said understanding.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota Heights, Minnesota, as follows:
1) That settlement of the acquisition
easement upon the terms and conditions

2) That the Village pay to Joseph-H. Majesky and Marie H. Majesky
husband and wife, as owners of the above described property
the total sum of $500.00 as tu11 payment and consideration for
the acquisition by the Vi].lage of-the above described easement.
3) That the Village Attorney be and is�hereby authorized
and directed to take a11��steps necessary to consummate the ,
acquisition of said property. �
