Res 73 - 75 Authorizing Amendment to Shaughnessy-Young Agreement� : �� • ` ��� Village of Mendota Heights Dakota County, Minnesota RE50LUTION N0. 73-75 RESOLUTION AUTHORIZING AMENDMENT TO SHAUGHNESSY-YOUNG AGREEMENT WHEREAS, in connection with the development of the Village's park system, the Village Council by resolution adopted on August 7,.1973, approved the purchase of part of Lot l, Auditor's Subdivision No. 2 together with that portion of the Northeast quarter of Section 23, Township 28, Range 23 lying southeasterly of the original reservation line as extended into said Northeast quarter in Dakota County, Minnesota, and WHEREAS, the owners of said property, J. Raymond Young, Jr. and Lawrence E. Shaughnessy, Jr., do not at present have record fee simple title to that portion of the above described property described as follows : That portion of the Northeast quarter of Section 23, Township 28, Range 23 lying Southeasterly of the original reservation line as extended into said Northeast quarter, � and WHEREAS, the Village Attorney has prepared and presented to the Village Council a supplemental agreement to be entered into by and between said landowners and the Village providing for the modifica- tion of the earnest money contract previously entered into with respect to said entire parcel to delete therefrom that portion of said property not presently owned in fee by said sellers and to reduce the total purchase price thereunder from $16,700.00 to $15,700.00. NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights, Minnesota, as fo].lows: 1) That the Village pay to the owners of the above des- cribed property the total sum of $15,'700.00 as full payment and consideration for the acquisition by the Village of the above described property less that portion thereof which is presently not owned by said landowners. 2) That if said sellers obtain title to the portion of said property to which they do not presently have record title on or before December 31, 1975, and convey the same to the Village, the Village will pay to said sellers as consideration for said property the total sum of $1,000.00. 3) That the Mayor and Clerk are hereby authorized and directed to execute on behalf of the Village said supp].emental agreement presented to the meeting providing for the under- standing hereinabove set forth.
