At a(r'egular) (spacial) meeting of the City Council of the City of
1V[endota Heights duly held on the 7th day of May , 19 74 ,
' the following Resolution was offered by Donald L. Huber , Mayor ;
seconded by James P. Losleben � , Councilman ; to-wit:
WHEREAS the Commissioner of High�vays has prepared plans'for the �
improvement of a part of Trunk Highway Number 117 renumbered as Trunk
' Highway Number 110 within the corporate limits of the City of �endota
Hei�hts �rom T.H. 55 to the E. Corp. I,im3.t� �
WHEREAS in order to obtain Federal Aid in the construction of said
Trunk Higncoay Number 117 ' renumbered as Trunk High�,aay Number 110
the Federal Highway Adninistration requires the assurance �hat the City of
Pdendota Hei�hte will not suffer any encroachment of any nature of kind
. .
whatsoever on the right of way of said Trunk High•way rdumber �17
renumbered as Trun� Highway Number 110 within the corporate limits
- of the said City of Mendota Hei�hts ; and

WHER�AS the Commissioner of Highways desires in the interest of public
safety that all parking of vehicles on said trunk highway be parallel with the
curb and at least 20 feet from any crosswalk.
P10W, THEN, BE IT RESOLVED that said City of �endota Heighte does
hereby agree and covenant that it �aill r.ever permit or suffzr, within its cor-
porate limits, any encroachment of any kind whatsoever, including curb gas pumps
and gas stations, billboards or other structures of any kind whatsoever, upon the
right of way of Trunk Highway 117 renumbered as Trunk Highway NumUer 110
and to the above end said City of �e�dota Iiei�hts hereby agrees that it
will never issue any license, permit, or grant, or give any leave or liberty or any
� other consent of whatever form for the construction or maintenance of any encroachment
