RESOLUTION NO. 74-46
RESOLUTION ORDERING FEASIBILITY STUDY AND
� AUTHORIZING TEMPORARY SANITARY SEWER SYSTEM
FOR LOTS 9 THROUGH 15 IN BLOCK 3, SOMERSET
PARK ADDITION
WHEREAS, Mendota Development Company as the owner of Lots 9 through
15 of Block 3 in Somerset Park Addition has requested municipal
sanitary sewer service to serve said property, and
WHEREAS, said Mendota Development Company lias further requested that
�pending the installation of municipal sanitary sewer to serve said
property, it be allowed to install a temporary private sewer system
to ser.ve said property. '
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights, Minnesota, as foll.ows:
1) That the City Engineer be and is hereby authorized
to make a study and prepare a report determining whether
or not the furnishing of municipal sanitary sewer for
Lots 9 tlirough 15 of Block 3, Somerset Park Addition
would be f easible.
2) That pending the installation of said municipa� sanitary
sewer to serve said property, Mendota Development Company,
as the owner of said property, shall be permitted to install
a private sanitary sewer system for each of said lots subject
to the condition that before the install.ation of any such
private sanitary sewer system said Mendota Development
Company shall in writing covenant, represent and agree with
the City that:
a. Said private sanitary sewer system or systems
shall in all respects meet with the City's regulations,
standards and ordinances rel.ative to the construction
and/or installation of private sanitary sewer systems.
b. That when municipal sanitary sewer is available
to serve said lots or any of them, an appropriate
assessment for such municipal sanitary sewer shall be
levied by the City.
c. That when municipal sanitary sewer is available
to serve said lots or any of them, any homes or dwelling
then situated upon said lots shal]. be connected to said
municipal sanitary sewer system within � 90 days after __ ,:
said municipal sanitary sewer becomes available.�

d. Said written agreement shall by its terms be binding
upon and inure to the successors and assigns of said
Mendota Development Company and will be in form such that
it may be filed in the offices of either the Register
of Deeds or Registrar of Titles of Dakota County, Minnesota,
as the case may be.
