Res 74 - 67 Amending Resolution Accepting Kirchert & Carlson Petition & Feasibility Report & Ordering Preparation of Plans & Specificationss. .�. �.� �Y City of Mendota Heights Dakota County, Minnesota ..� RESOLUTION N0. 74-67 RESOLUTION AMENDING RESOLUTION ACCEPTING KIRCHERT AND CARLSON PETITION AND FEASIB=LITY REPORT AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS WHEREAS, Albert W. Carlson and Evan Kirchert, the owners of the property at 2300 Pagel Road and 2294 Dodd Road, have heretofore in writing petitioned the City Council of the City of Mendota Heights requesting the construction of an extension to the Village's sanitary sewer system and water distribution system to serve such property and in said petition requested that the entire cost of said improvements be assessed against their property, and WHEREAS, the City Engineer has heretofore submitted his written report to the City Council in which he determined that the pro- posed improvements and the construction thereof were feasible and desirable and further reported on the proposed costs of�said improvements and construction thereof, and WHEREAS, City Council at its meeting of May 7, 1974, adopted Resolution No. 74-35 accepting said petition and feasibility report and ordering preparation of plans and specifications, and WHEREAS, said petitioners desire that the conditions of paragraph 3 of said Resolution No. 74-35 be modified as hereinafter set forth. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1) That the petition for said improvements and the feasibility report therefore are hereby accepted. 2) That the City Engineer be and he is hereby authorized and directed to prepare plans and specifications for said improvements. 3) That the provisions of paragraph number 3 of said Resolution No. 74-35 are hereby amended in their en- tirety so that as so amended said paragraph 3 of said Resolution No. 74-35 and of this resolution shall read as fol�:ows : That said improvements, if constructed, shall be constructed on the condition and subject to the understanding that the building known and numbered as 2288 Dodd Road presently situated upon the Kirchert property at 2294 Dodd Road shall cease to be used as a permanent residence when the pres�nt tenant moves from such building. "Permanent residence" as used hereunder shall not be deemed to include the use of said building as a residence for up to a maximum period of 14 con- tinuous days by any relative or guest of the oc- cupants of the permanent home situated upon the property known and numbered as 2294 Dodd Road it being understood that said limited use shall then be the only residential use permitted of said building. Provided further, that when the present .private sanitary sewer system serving said building at 2288 Dodd Road is no longer operative said building shall thereafter immedi- ately cease to be used for any residential pur- poses whatsoever.
