RESOLUTION ORDERING CONSTRUCTION OF ORCHARD
PI,ACE, HUNTER LANE, AND CULLIGAN LANE AREA
STREET AND SANITARY SEWER IMPROVENl�NTS AIQD
PREPARATION OF PLANS AND SPECI�FICATION5
THEREFOR (IMPROVEMENT NO. 7�, PROJECT NO. 2)
WHEREAS, a public hearing was held on the 20th day of August, 1974,
at 8:00 o'clock P.M. at the City Hall in the City of Mendota Heights,
Minnesota, pursuant to resolution adopted by the City Council of the
City of Mendota Heights on Jul.y 16, 1�74, on the question of the
proposed construction of the following described improvements:
The construction of street improvements consisting of
the acquisition of easements and the grading, stabiliza-
tion, drainage and bituminous surfacing of the streets
located in the area hereinafter described, and
The construction of an extension to the City's sanitary
sewer system, including appurtenances and incidentals
thereto, and the acquisition of easements to serve the
area hereinafter more particularly described.
WHEREAS, due publication of the notice of public hearing on said
proposed construction laas been attended to, and
WHEREAS, maile.d notice of said hearing has been mailed more than 10
days before the date of said hearing to the owriers of each parcel
situated within the area proposed to be assessed, a11 in accordance
with the applicable Minnesota Statutes, and
WHEREAS, the City E�gineer reported that the proposed improvements
and construction thereof were feasible and desirable and further
reported on the proposed costs of said improvements ancl construction
thereof , and
WHEREAS, the area proposed to be assessed for said improvements is
situated within the City of Mendota Heights in Dakota County,
Minnesota, and is more particularly described as follows:
All properties situated within the following described area
].ocated in the City of Mendota I3eights, Minnesota, to-wit:
A].ine commencing at the center of the intersection of
Lexington Avenue and Overlook Road, thence proceeding west-
ward to the westerly City limits of Mendota Heights; thence,
fo].lowing the City limits in a southwesterly and southerly
direction to the north right of way line of State Trunk
Highway 110; thence easterly along said right of way line
to a point approximately 660 feet easterly of the center of
Lexington Avenue; thence, north along the line 660 feet east
of Lexington Avenue to the center of Marie Avenue; thence
westerl� along the center of Marie Avenue to a point 435 feet
east of the centerline of Lexington Avenue; thence, northernly
along a line 435 feet east of Lexington to a line 220 feet
north of Marie Avenue thence westerly along a line 220 feet
north of Marie Avenue to the centerline of Lexington Avenue;
thence, northernly approximately 248 feet at the point of
beginning, and there terminating.
WHEREAS, the City Council then proceeded to hear all persons interested
in said improvements and a11. persons were afforded an opportunity to
present their views and objections to the making of said improvements.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights, Minnesota, as follows:
1) That it is advisable, feasible, expedient and necessary
that the City of Mendota Heights construct the above
described improvements, and it is hereby ordered that said
improvements be made. .
2) That the City Engineer be and is hereby instructed
to proceed with the preparation of the necessary plans and
specifications for said improvements.
3) That h�reafter said improvements shall be known and
designated as Improvement No. 74, Project N.o. 2.
Adopted by the City Council of the Village of Mendota Heights this
20th day of August, 1974.
