Koepke to Construct & Operate an Annual Hospital�.___ - ,- City of Mendota Heights Dakota County; M'innesota RESOLUTION NO. 74-92 RESOLUTION GRANTING CONDITIONAL USE PERMIT TO THOMAS E. KO.EPKE TO CONSTRUCT AND OPERATE AN ANIMAL HOSPITAL BE IT RESOLVED by the City Council of the City of Mendota Heights as follows: WHEREAS, a hearing was held on the application of Thomas E. Koepke to construct and operate an animal hospital or veterinary clinic on the following described property situated in the City of Mendota Heights in Dakota County, Minnesota, to-wit: Lot 1 of Einess Addition plus some adjoining property owned by Brian Birch, said property being in the Northwest quarter of Section 25 in Township 28, .. Range 23, and WHEREAS, said property is situated within an area described as a B-2 "Neighborhood Business District" under the City's Zoning Ordinance, and ' WHEREAS, under the provisions of Ordinance No. 123 adopted Jul.y 16, 1974 (codified as Section 13.2(6) of Ordinance No. 401) a conditional use permit is required to operate an anima]. hospital or veterinary . clinic in a B-2 district, and WHEREAS, a public hearing on said application for a conditional use permit was held before the City Council on October l, 1974, pursuant to notice duly given as provided in said ordinance, and WHEREAS, the Planning Commission has recommended that a conditional use permit be granted for said animal hospital, and WHEREAS, among other things, said Thomas E. Koepke submitted his plans for said animal hospital. to the Council, and WHEREAS, the Council is of the opinion that the granting of said conditional use permit and the proposed use of such property will not be detrimental to the health, safety or general welfare of the community nor wi11 it cause serious traffic congestion or hazards, nor wi11 it seriousl.y depreciate surrounding property value, and that the same is in harmony with the general. purpose and intent of the Zoning Ordinance and the City's Comprehensive Plan. , NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights as follows: 1) That a conditional use permit be and the same is hereby granted to Thomas E. Koepke to operate an animal hospital or veterinary clinic upon the above described property subject, however: A. To the submission to the City of a drainage plan for said property that meets with the approval and satisfaction of the City Council, and B. To the condition that the use of said property shall in al1 respects conform and comply with the provisions of Ordinance No. 123 (codified as Section 13.2 (6) of Ordinance No. 401). 2) That an exchange of a portion of said Einess Addition property for a portion of the adjoining property of Brian Birch as shown on the plans of said animal hospital presented to the meeting shall be permitted without the necessity of a subdivision or platting under the City subdivision ordinance.
