Res 75 - 77 Providing for Acquisition of McGough Property.� ' �. � . . � CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 75-77 RESOLUTION PROVIDING FOR ACQUISITION OF McGOUGH PROPERTY WHEREAS, in connection with the City park.system, it is in the best interest of the City to acquire the following described pro- perty situated in Dakota County, Minnesota, owned by Jerome H. and Mary L. McGough, to-wit: The Southerly 180 feet of Lot 4, Auditor's Subdivision No. 3, and WHEREAS, the landowners of the above,described �roperty have executed an earnest money contract under which they have agreed to sell and convey the above described property to the City for the total sum of $35,000.00 subject to the condition that said property shall be used�only for public park and open space purposes and for pur- poses related thereto, and provided further that said property shall not be used as a thoroughfare for motorized vehicles nor as a starting or ending point for any roadway for motorized vehicles to or from the street now known as Sylvandale Road, and - WHEREAS, certain of the property owners in the immediate vicinity of said property have agreed to donate $7,000 to City to be used by the City in part to pay for the acquisition of the above des- cribed property, and WHEREAS, the members of the City Council have reviewed the earnest money contract submitted to the City Council with respect to the acquisition of the above described property, and WHEREAS, the City Council is of the opinion that it is in the best interest of the City to acquire the above described property upon the terms and conditions more particularly in said earnest money contract contained. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1) That the City acquire the above described property upon the terms and conditions set forth above and as consideration for said property the City shall pay the total consideration of $35,000.00. I�J 2) That the Acting Mayor and Clerk are hereby authorized and directed to execute said earnest money contract on behalf of the City. 3) That the purchase of the above described property by the City shall be contingent upon the donation at this time to the City by certain of the property owners in the area of a minimum of $7,000.00. 4) That the City Attorney be and is hereby authorized and directed to take all steps necessary to consummate the acquisition of said property. - Adopted by the City Council of the City of Mendota Heights this 16th day of September, 1975.
