RESOLUTION N0. 76-06
RESOLUTION APPROVING FINAL
PLAT FOR LEXINGTON HIGHLAND WEST
WHEREAS, the owners of the property situated in the City of Mendota
Heights, Dakota County, Minnesota, more particularly described on
Exhibit A attached hereto, have presented to the City Council the
proposed final plat of said property which is to be known as Lexington
Highland West, and .
WHEREAS, the City Council has reviewed said final plat, and
WHEREAS, the above-described property constituting said Lexington
Highland West abuts on Marie Avenue, a street situated in the City
of Mendota Heights, and
WHEREAS, while said property abuts on said Marie Avenue, none of
the individual lots constituting said plat of Lexington Highland
West abut on said Marie Avenue, and
WHEREAS, the City Council has determined that each of the lots in
said Lexington Highland West benefit from said Marie Avenue and
will benefit further in the future by reason of the anticipated
bituminous surfacing and related improvements to said Marie Avenue
between Victoria and Lexington Avenues, and
WHEREAS, the City Council of the City of Mendota Heights has agreed
to approve said final plat of said Lexington Highland West subject
to the condition and with the understanding that upon the construc-
tion of any street improvement� for said Marie Avenue between Victoria
and Lexington Avenues (including but not limited to the bituminous
surfacing and curb and gutter and related improvements for said
street) each of the lots in said plat of Lexington Highland West
shall be assessed for their proportionate share of the cost of said
improvements, and
WHEREAS, the total of said assessments to be levied against all
of the lots constituting Lexington Highland West shall be based
on the frontage of the entire plat of said Lexington Highland West
along said Marie Avenue.

NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights, Minnesota, as follows:
1) That the final plat'of Lexington Highland West presented
to this meeting be and the same is hereby approved and the
appropriate City officials are hereby authorized and directed
to sign said plat on behalf of the City of Mendota Heights.
2) That the approval of said final plat of Lexington Highland
West hereunder shall be and is subject to the condition and
with the understanding that upon the construction of any street
improvement for said Marie Avenue between Victoria and Lexington
Avenues (including but not limited to the bituminous surfacing
and curb and gutter and related improvements for said street)
each of the lots in said plat of Lexington Highland West shall
be assessed for their proportionate share of the cost of said
improvements, the total of said assessments to be levied against
all of the lots in Lexington Highland West to be basecl on the
frontage of the entire plat of said Lexington Highland West
along Marie Avenue.
3) That the City Clerk be and is hereby authorized and directed
to file a certified copy of this resolution in the office of
the Register of Deeds of Dakota County, Minnesota, so that
the same will be of record and constitute a notice to anyone
purchasing or otherwise acquiring an interest in any of the
lots in said plat of Lexington Highland West.
Adopted by the City Council of the City of Mendota Heights this
3rd day of February, 1976.

The following described property situated in Dakota County,
Minnesota, to-wit:
The North 1/2 of that part of the West 1/2 of the West 1/2
of the NW 1/4 of Section 26, Township 28, Range 23, lying
North of a line parallel with and a distance of 693 feet
North of the South line of said NW 1/4 of Section 26, Dakota
County, Minnesota, except the North 30 feet thereof conveyed
to the Village of Mendota Heights as recorded in Book 259
of Deeds, Page 236, Dakota County, Minnesota.
and
The South 1/2 of that part of the West 1/2 of the West 1/2
of the Northwest 1/4 of Section 26, Township 28, Range 23,
lying North of line parallel with and distant 693 feet North
of South line of said Section 26, Dakota County, Minnesota,
except the South 225 feet of the South 1/2 of that part

Section 26, Township 28, Range 23, lying North of a line
parallel with and a distance of 693 feet North of the South
