RESOLUTION N0. 76-15
RESOLUTION ORDERING CONSTRUCTION OF IMP ROVE-
MENTS TO SERVE THE NORTHEAST AREA OF THE
CITY AND ORDERING FINAL PLANS AND SPECIFICA-
TIONS THEREFOR (IMPROVEMENT NO. 75, PROJECT
NO. 8)
WHEREAS, a public hearing was held on the 23rd day of February, 1976,
at 9:00 o'clock P.M. at the Somerset Heights Elementary School in
the City of Mendota Heights, Minnesota, pursuant to resolution
adopted by the City Council of the City of Mendota Heights on
January 13, 1976, on the question of the p'roposed construction of
the following described improvements:
The construction of sanitary sewer and water service
connections.
The construction of a storm sewer system including appurte-
nances and incidentals thereto including the construction
of control structures and other surface water control measures
and the acquisition of easements and the reconstruction
where necessary of streets in the area hereinafter more
particularly described.
The construction of an extension to the City's water distribu-
tion system including appurtenances and incidentals thereto,
and the acquisition of easements, and the reconstruction
where necessary of streets in the area hereinafter more
particularly described.
The construction of street improvements consisting of the
grading, stabilization, drainage and bituminous surfacing,
and the construction of concrete curbs and gutters on the
streets to be situated in the area hereinafter more particu-
larly described.
WHEREA5, due publication of the notice of public hearing on said
proposed construction has been attended to, and
WHEREAS, mailed notice of said hearing has been mailed more than
10 days before the date of said hearing to the owners of each parcel
situated within the area proposed to be assessed, all in accordance
with the applicable Minnesota Statutes, and

WHEREAS, the City Engineer reported that the �ropos.�d improvements
and construction thereof were feasible and desirable and further
reported on the proposed costs of said improvements and construc-
tion thereof, and
WHEREAS, the area proposed to be assessed for said improvements
is situated within the City of Mendota Heights in Dakota County,
Minnesota, and is more particularly described as follows:
All property within an area bounded by the following described
line:
Commencing at the centerline of Delaware Avenue and Beebe
Avenue, thence northward along the centerline of Delaware
Avenue approximately 2,250 feet, thence westerly along the
North lot line of Lots 2 and 13 of PR McDonnells Addition
to the cenzer of Chippewa Avenue, thence northerly along the
centerline of Chippewa Avenue approximately 750 feet, thence
westerly and southwesterly along the North line of Block 1
Guadalupe Heights Addition to the centerline of Eugena Street,
thence westerly to the center of the intersection of Eugena
Street and Pierce Street, thence northwesterly and then south-
westerly on the lot line of Lot 21 and northwesterly and then
southwesterly on the lot line of Lot 1, all in Cherokee Park
Heights Addition, to the southeasterly right of way line of
Sibley Memorial Highway (T.H. 13), thence southwesterly approxi-
mately 300 feet to the South line of Lot 9 Auditor's Sub.
No. 4, thence easterly along the South line of the above men-
tioned Lot 9 approximately 530 feet to the westerly line of
Lot 15, Block 4 Guadalupe Heights Subdivision, thence southerly
on the West line of above mentioned Lot 15 to the South line
of Lot 15, thence easterly on the South line of Lot 15 to
the westerly line of Lot 8 Lametti Add. No. 2, thence southerly
along the westerly line of Lots 8 and 9 Lametti Add. No. 2
to the North lot line of Lot 5, Block 2 Kirchner Add., thence
westerly along the North line and the West line of said Block 2
to the centerline of Kirchner Avenue and McDonald Street,
thence westerly along the centerline of McDonald Street to
the West line of Lot 5 Mechanic's Add., thence southerly along
the West line of Lots 5, 32, 41 and 68 of Mechanic's Add.
to Butler Avenue, thence westerly along the centerline of
Butler Avenue to Ivy Hill Drive, thence on the center
of Ivy Hill Drive to a point approximately 150 feet south,
thence easterly to the center of Partition Road, thence south-
easterly along the centerline of Partition Road to the North
line of Lot 9, Block 8 Kirchner Add. thence northeasterly
along the North line of Lots 9 through 16 of said Block 8
to the East line of said Lot 16, thence southeasterly along
the East line of said Lot 16 and to the centerline of Dodd
Road and Beebe Avenue, thence southeasterly along the center-
line of Beebe Avenue to the centerline of Delaware Avenue,
and there terminating at the point of beginning.
WHEREAS, the City Council then proceeded to hear all persons interested
in said improvements and all persons were afforded an opportunity to
present their views and objections to the making of said improvements.
NOW THEREFORE,:IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights, Minnesota, as follows:
1) That it is advisable, feasible, expedient and necessary
that the City of Mendota Heights construct the above des-
cribed improvements, and it is hereby ordered that said
improvements be made. �
2) That the City Engineer be and is hereby instructed
to proceed with the preparation of the necessary plans
and specifications for said improvements.
3) That hereafter said improvements shall be known and
designated as Improvement No. 75, Project No. 8.
Adopted by the City Council of the City of Mendota Heights this
16th day of March, 1976.
