RESOLUTION NO. 76-74
RESOLUTION EXTENDING CONDITION ATTACHED
TO RESOLUTION N0. 74-67
WHEREAS, under the provisions of Ordinance No. 74-67 adopted by the
City Council on July 16, 1974, it was provided that the Kirchert
and Carlson sanitary sewer and water improvements (which improvements
were known and designated as Improvement 74, Project No. 4) would be
constructed on the condition and subject to the understanding that
the building known and numbered as 2288 Dodd Road then presently
situated upon the Kirchert property at 2294 Dodd Road would cease to
be used as a permanent residence when the then present tenant moved
from such building, and
WHEREAS, the then present tenant has moved from said residence at
2288 Dodd Road, and the owner of said premises has requested the
permission of the City Council to use said premises as a permanent
residence for one year from the date hereof, and
WxEREAS, it appears to be reasonable and in the best interest of the
City to extend the use of said premises as a permanent residence for
one year from the date hereof provided that at the expiration of
said one-year period all of�the terms and conditions of said Ordinance
No. 74-67 would be fully applicable.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights, Minnesota, as follows:
1) That the use of the building known and numbered as
2288 Dodd Road presently situated upon the Kirchert property
at 2294 Dodd Road as a permanent residence may continue
through and until September 21, 1977.
2) That said premises at 2288 Dodd Road shall not be
used as a permanent residence beyond September 21, 1977.
3) "Permanent residence" as used hereunder shall not be
deemed to include the use of said premises as a residence
for up to a maximum period of fourteen continuous days
by any relative or guest of the occupants of the permanent
home situated upon the property known and numbered as 2294
Dodd Road, it being understood that after said date of
September 21, 1976, said limited use shall then be the only
residential use,permitted of said building.

4) Notwithstanding anything hereinabove set forth, when the
present�private sanitary sewer system serving said building
at 2288 Dodd Road is no longer operative, said building shall
thereafter immediately cease to be used for any residential
purposes whatsoever.
Adopted by the City Council of the City of Mendota Heights this
21st day of September, 1976.
