RESOLUTION NO. 76- g6
RESOLUTION PLACING HUD RESTRICTIONS
ON ADDITIONAL CITY PROPERTY
WHEREAS, under date of May 21, 1974, the City of Mendota Heights
adopted a certain Declaration of Restrictions relative to the sale,
lease, mortgage or transfer of certain properties more particularly
in said Declaration of Restrictions described, and
WHEREAS, said Declaration of Restrictions was filed in the office
of the Register of Deeds in and for Dakota County, Minnesota, on
May 30, 1974, as Document No. 434243, and
WHEREAS, said Declaration of Restrictions was adopted by the City
Council of the City of rdendota Heights in accordance with and pur-
suant to a Federal Open Space Land Program Grant more particularly
described and designated as 4GM Contract No. MINN OSA-27(g), Project
No. MINN OSA-27, and
WHEREAS, Site 3, Parcels No. l, 2, 3, 4 and 5 described in said
Declaration of Restrictions has been acquired by the Minneapolis-
St. Paul Metropolitan Airports Commission pursuant to condemnation
proceedings instituted by said Commission, and
WHEREAS, the City of Mendota Heights has used the funds received
for said Site 3, Parcels No. l, 2, 3, 4 and 5 in said condemnation
proceedings for the acquisition of the following described property
situated in the City of Mendota Heights, Dakota County, Minnesota,
to-wit:
That part of Government Lot Six (6) and the West Ten (10)
acres of the Northeast 2uarter (NE 1/4) of the Northeast
Quarter (NF 1/4) in Section Twenty-Six (26), Township
Twenty-Eight (28), Range Twenty-Three (23) which lies
Southeasterly of Trunk Highway I-35E.
All that part of Government Lot 10 lying Easterly of the
Easterly right of way line of Interstate Highway No. 35E
^ in Section 23, Township 28 North, Range 23 West except
that part thereof heretofore conveyed to the Village
of Mendota Heights.
and
WHEREAS, under said Federal Open Space Land Program Grant, it is
required that said Declaration of Restrictions be applied to and

become applicable to the properties more particularly described
above.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights, Minnesota, as follows:
1) The City of Mendota Heights, being the owner of the
following described property situated in the County of
Dakota and State of Minnesota, to-wit:
That part of Government Lot Six (6) and the West Ten
(10) acres of the Northeast Quarter (NE 1/4) of the
Northeast Quarter (NE 1/4) in Section Twenty-Six (26),
Township Twenty-Eight (28), Range Twenty-Three (23) •
which lies Southeasterly of Trunk Highway I-35E.

or creation of other indebtedness or other�transfer of the

interest therein is subject to the prior approval of the
Secretary of Housing and Urban Development of•the United
States of America.
