RESOLUTION N0. 77-08
RESOLUTION APPROVING CONDITIONAL
USE PERMIT FOR CONGREGATION SONS
OF JACOB AND ESTABLISHING
CONDITIONS THEREFOR
WHEREAS, Congregation Sons of Jacob has applied for a conditional use
permit to use the property described below for a religious institution
(a synagogue) and purposes directly related thereto, and --
WHEREAS, the property for which said application for a conditional use
permit has been filed is classified as a"R-1" One Family Residential
District under the City Zoning Ordinance and is more particularly des-
cribed as the following property situated in the City of Mendota
Heights in Dakota County, Minnesota, to-wit:
The West 726 feet of the East 1,386 feet of the
South 660 feet of the Northeast quarter of Section 27,
Township 28, Range 23 except the South 421.5 feet of
the West 130 feet thereof,
and
WHEREAS, the application for said conditional use permit has been duly
considered by the,City Planning Commission and the Planning Commission
has recommended the approval of said conditional use permit subject to
the following conditions:
1. The site shall contain detailed light standards
with hooded shields.
2. No parking shall be permitted on public streets
during the time of services.
3. A detailed landscaping plan must be submitted showing
types of shrubs and trees.
4. If a service road is provided along the north side
of Highway 110 between Lexington and Hunter Lane,
access to the synagogue from Hunter Lane would be
closed off and thereafter access to and from the
synagogue property would be from such service road.
5. Before commencement of construction, the Planning
Commission shall be presented with architectural
plans for the proposed building structure.
and
WHEREAS, the City Council has held a public hearing on said application
all as required under the provisions of the City Zoning Ordinance,
and
WHEREAS, all persons interested in said conditional use application
have been given the opportunity to be heard with respect thereto,
and
WHEREAS, the City Council is of the opinion that the above-described
property would be suitable for synagogue. use and would not create
a nuisance or be detrimental to the health, safety or welfare of
the immediate neighborhood or the community in general; and that the
proposed use would not create any traffic congestion or hazards greater
than would be the case if the site were used for single family resi-
� dential development; and that the proposed use is in harmony with the
� general purpose and intent of the City's Zoning Ordinance and Compre-
hensive Plan.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights, Minnesota, as follows:
1) The application of Congregation Sons of Jacob for a
Conditional Use Permit to use the above-described property
for a religious institution (a synagogue) and purposes
directly related thereto is hereby approved subject to the
following conditions:
a. Detailed light standards with hooded shields
shall be provided upon the site.
b. There shall be no parking permitted on adjacent
public streets during the time of services.
c. Prior to commencement of the synagogue building,
a detailed landscaping plan showing types of shrubs
and trees shall be submitted to the City Council for
its approval.
d. When Highway 110 is provided with a service road
on its north side between Hunter Lane and Lexington
Avenue, access from the synagogue property to ar from
Hunter Lane shall be closed off and access to or from
the synagogue property shall thereupon be provided from
said service road.
e. Before construction of any building improvements upon
the above-described property, architectural plans for the
proposed improvements shall be submitted to the Planning
Commission and City Council for their examination and
approval.
f. The grant of this conditional use permit shall be sub-
ject to and conditioned upon an agreement being reached
by and between the synagogue and the Mulvihills, owners
of the immediately adjacent property, providing for the
acquisition by the synagogue of said adjacent property
from the Mulvihills.
g. The grant of this conditional use permit shall
be subject to the dedication of such of the synagogue
and adjacent Mulvihill property as is necessary for the
construction of a service road along the north side of
Highway 110 from Hunter Lane to Lexington Avenue.
Adopted by the City Council of the City of Mendota Heights this 18th
day of January, 1977.
