RE50LUTION ADOPTING AND CONFIRMING-ASSESSMENTS
(IMPROVEMENT NO. 77,. PROJECT NO. 5) '
WI�REAS, the City Clerk,�with the aid of the City Engineer, has
calculated the proper amount to be specially assessed for Improvement ,
No. 77, Project No. 5(construction of an extension of the City's sanitary
sewer system to serve the property known as 2215 Dodd Road, Mendota Heights,
• Minnesota) against the assessable property affected thereby upon the basis of
benefits, without regaxd to cash valuation, in accordance with the provisions
of Chapter 429, Minnesota�Statutes�Annotated, particularly of Section 429.0�1
thereof; and ' ' -

Wi�REAS, the property owners.affected by such improvement have waived the
req�irement for public hearing on the proposed assessment; "._
NOW TI�REFORE BL IT RESOLVED by the City Council of the City of Mendota
Heights, Minnesota: . - • -

. 1.- Such proposed assessment, a copy of which is attached hereto and �
made a part hereof, is hereby accepted'and shall constitute the �
. special assessment against the lands named therein, arid each
� tract of land therein included is hereby found to be benefitted .
�by the proposed improvement in the amount of the assessment levied
against it. � • � � �

2. Such assessment shall be payable in equaT annual installz�ents
extending over a period of 19 years, the�first of the installments
to be payable on or before the first Monday in January, 1979 and
shall bear interest at the rate of 7 percent per annum from the
date of the adoption of this assessment resolution. To the first
installment shall be added interest'ori the entire assessment from
the date of adoption of this resolutiom until December 31, I977.
. To each subseqaent installment when due shall be added interest ,
for one year on all unpaid installments. ,
3. The owner of any property so assessed may, at any time prior to �_
certification of the assessment to the County Auditor, pay the
whole of the assessment on such property, with interest accrued
'to the date of paym�nt, to the City Treasurer, except that no
interest shall be charged if the entire assessment is'paid within
thirty days from the adoption of this resolution; and he may, at
any time thereafter, pay to the County.Treasurer the.entire amount
of the assessment remaining unpaid, with interest ac�rued to
Becember 31 of the year in which�such payment is sade. Such
payment must be made before November 15 or interest will be '
' charged through December 31 of the next succeeding year. �

. 4. The clerk shall forthwith transmit a certified duplicate of
, this assessment to the'County Auditor to be extended on the , -
proper tax lists of the County, and such assessments shall be
collected and paid over in the same manner as other municipal
