RESOLUTION NO. 78-I1
RESOLUTION AUTHORIZING ACQUISITION OF
LANGENBRUNNER PROPERTY
WHEREAS, the City Attorney has presented an earnest money contract
dated this day executed by Jon T. and Joanne M. Langenbrunner providing
for the acquisition by the City of the northerly 30 feet of Lot 8,
Block 3, Somerset Park No. 3, Ramsey County, Minnesota, including
the entire home which is situated in part upon the above-described
property, and
WHEREAS, under the terms of said earnest money contract, the City
would pay to said landowners the total sum of $25,000.00 for such
property, and
WHEREAS, the members of the City Council have reviewed said earnest
money contract, and
WHEREAS, in addition to the terms set forth in said earnest money
contract, said landowners have executed said earnest money contract
subject to the following conditions:
A. The date upon which possession of said property would
be delivered to the City shall be June 12, 1978,
rather than May 30, 1978.
B. That if the landowners do not exercise the option of
removing the home upon said property, the City will
accept said house "as is" without any obligation on
the part of the landowners to remove the foundation
or any part of said home.
C. That the City will proceed forthwith to vacate that
portion of the outstanding utility and drainage ease-
ment which is situated over and across the following
portion of said Lot 8, Block 3, Somerset Park No. 3,
to -wit:
Beginning at a point 100 feet South and 10 feet East of
Northwest corner of said Lot 8, said point also being on
the Northerly line of the existing utility and drainage
easement, thence South 20 feet parallel and 10 feet East
of the West line of said Lot 8, thence Easterly to a
point 5 feet West and 130 feet South of the Northeast
corner of said Lot 8, thence North 30 feet parallel and
5 feet West of the East line of said Lot 8, thence West
89.27 feet, along the North line of the existing easement
to the point of beginning.

WHEREAS, it is in the best interests of the City Council to acquire
said property upon the terms and conditions in said earnest money
contract contained and subject to the additional conditions set forth
above.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights, Minnesota, as follows:
1) That the City acquire the above-described property upon
the terms and conditions in said earnest money contract con-
tained and subject to the conditions set forth above.
2) That the Mayor and Clerk be and they are hereby authorized
and directed to execute said earnest money contract on behalf
of the City.
3) That the City Attorney be and is hereby authorized and
directed to take any and all steps necessary to effectuate
and consummate the purchase of said property on behalf of
the City.
Adopted by the City Council of the City of Mendota Heights this
7th day of February, 1978.
