Res 78 - 81 Authorizing Vacation of AlleyCity of Mendota Heights Dakota County, Minnesota 3 A •C• 1µm• RESOLUTION NO. 78-81" RESOLUTION AUTHORIZING VACATION OF ALLEY l WHEREAS, a petition has been duly presented to the City Council of the City of Mendota Heights signed by a majority of the owners of the property abutting upon the following described alley situated in the City of Mendota Heights in Dakota County, Minnesota, to -wit: 9 t All of the alley situated in Block 6 of T. T. Smith's Subdivision No. 4. and WHEREAS, notice of a hearing on said petition has been duly published and posted more than two weeks before the date scheduled for a hearing on said petition all in accordance with the applicable Minnesota Statutes, and WHEREAS, a public hearing was held on said petition on Tuesday, July 18, 1978, at 7:30 p.m. at the City Hall of the City of Mendota Heights, and WHEREAS, the City Council then proceeded to hear all persons interested in said petition and all persons interested were afforded an opportunity to present their views and objections to the granting of said petition, and WHEREAS, there were no objections presented to said petition, and WHEREAS, the City Council is of the view that it would be in the best interest of the public and the City to vacate only the easterly one hundred eighty•(180) feet of said alley. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1) That the vacation of the easterly 180 feet of the alley more particularly described above situated in the City of Mendota Heights is in the best interests of the public and the City. 2) That the following described portion of the alley situated in the City of Mendota Heights, Dakota County, Minnesota, to -wit: The Easterly one hundred eighty (180) feet of the alley situated in Block 6 of T. T. Smith's Subdivision No. 4 be and the same is hereby vacated. 3) That the City Clerk be and is hereby authorized and directed to prepare and present to the proper Dakota County officials a notice of completion of these vacation proceedings all in accordance with the applicable Minnesota Statutes.
