Res 78 - 106 Adopting & Confirming Assessments for Public Improvementsh �� CITY OF MENDOTA HEIGHTS Dakota County, Minnesota RESOLUTION N0. 78-106 RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR PUBLIC IMPROVEMENTS BE IT RESOLVED by the City Council of the City of Mendota Heights as follows: WHEREAS, the City Clerk with the assistance of Edward F. Kishel, Engineer for the City of Mendota Heights, has calculated the proper amount to be specially assessed for the collection of �he balance of delinquent assessments against tax forfeited property described as Parcel No. 27-28700-151-00 and Parcel No. 27-28700-152-00, in accordance with the provisions of Chapter 429; and WHEREAS, the proposed assessment roll has been on file with the Clerk and at all times since its filing has been open for public inspection; and notice thereof has been duly mailed as required by law.. Said notice stated the date, ti.me and place of such•meeting; the general nature of the improvement; the area proposed to be assessed; that the proposed assessment roll has been on file with the Clerk; and that written or oral objections thereto by any property owner would be considered; and WHEREAS, the owner of the affected lots, pieces or parcels of land affected thereby submitted written waiver of the right to said assessment hearing; and WHEREAS, all, persons affected by said public improvements were given an opportunity to present objections to the proposed assessment roll; NOW THEREFORE, The Council, having heard and considered all objections so presented, and being fully advised in the premises, and having made all necessary adjustments and corrections, finds that each of the lots, pieces and parcels of land enumerated in the proposed assessment roll was and is specially benefitted by the construction of said improvements in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and that sub.h=amount so set out is hereby levied against each of the respective lots, pieces and parcels of land therein described; and BE IT FURTHER RESOLVED, that the proposed assessment roll as so corrected is hereby adopted and confirmed as the proper special assessment for each of said loLs, pieces and parcels of land respectively., and the assessment against each parcel, together with interest at the rate of seven percent (7�) per annum accruing on the full amount thereof from time to time unpaid, shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment shall be payable in equal annual installments for a period of thirteen years for sanitary sewer and water improvements; as to trunk sewer shall be payable in equal installments over a period of ten years; as to street and curb and gutter improvements shall be payable in equal installments over a period of seven years; and as to diseased tree removal shall be payable in equal installments over a period of four years; the first of said installments, together with interest on the entire assessment from January l, 1979 to December 31, 1979, to be payable with general taxes for the year 1978, collectible in 1979 (now designated as real estate taxes payable in 1979),_and�one of each of the remaining installments, together with one year's interest on that and all other unpaid installments, to be payable with general taxes for each consecutive year ;;.. • �• ' thereafter until the entire assessment is paid; and BE IT FURTHER RESOLVED, that the Clerk shall prepare and transmit to the County Auditor a certified duplicate of said assessment roll with each then unpaid installment and interest set forth separately, to be extended upon the proper tax lists of the County, and the County Auditor shall thereafter collect said assessments in the manner provided by law. • Adopted by the City Council of the City of Mendota Heights this Third day of October', 1978.
