WHEREAS, State;Hiqhway �13,�which we selec:ted as the orig- ' , , inal alignment of a four lane'road in the.late forties; had to be ' _�-. �� abandoned�because Federal interstate guideliiies adopted in the• � . early fifties.se�-Y�minimum distances,between interstate highways,` .. �, •thus eliminating Highway #13�because of'its close proxi:mity in �' ' Northern Dakota County to I-494; its abandonment resulted in con-�-. siderable studies and�public hearings, culminating in the present �' alignment of interstate 35E which was adopted by the State Hi.ghway.� , �.Dep�rtment, and officially accepted by the governing bodies of �• Burnsville, Apple Valley, Eagan, and Mendota Heights by 1959, and -�� � _`'said alignment included bridging the ofte�t dry'marsh,end of Black- , hawk�Lake; and, • � � � . � • • - - � ; . - , •_ - . � � . � - , - . - = WHEREAS,�a11 governmental bodies including the Environmental . . `�Quality Board-(EQB)'whose�membership,includes the Department of ' ." (DNR)-and Pollution Control Agency (PCA) gave � � approval of the 1959 I-35E alignment which included crossing the .• ,_ - � Blackhawk LakerMarsh,,in September,.1977 thus in effect giving�the ` ' green light to the Department of Tran�sportation (DOT) in commence ��' -� construction stag.ing; 'and, . '' �'"_ WHEREAS, in May, 1978,,the�DOT asked the DNR for a bridge -permit to cross the marsh-end of Blackhawk Lake; the route the ' DNR.and PCA, as membersof the EQB, had.approved in 5eptember 1977, howeve,r, the DNR,and PCA reversed themselves and�instead of�the - DNR issuing��the permit', they•set a public hearing at which_the . ' DNR, PCA,and Associated Families appeared in.oppositiori before the ' .. Concerned that the state�and federal goverriments tiave en- . .� '• acted laws t�a� permit one person or in this instance a small'group,; , who built aware of the 1959 I=35E alignment whi.ch will be-several .'. � ',' blocks away from their homes,�can"almost endlessly hold up the con- ,� �struction of the interstate system,� thus jeopardizing not only the ,�-: ,. � f iives of the 20,000 citizens of Eagan and the 180,000 in Dakota ' County but al.so many of the� several.million people in the metro area,_ • �-especially now that the Minnesota Zoological�garden is,opened; ' '_ .� � '. , THEREFORE BE IT RESOLVED that the City Council unanimously � � � , conciire and �eterate theL�foregoing Eagan resolution; - _� , , BE IT FURTHER•RESOLVED:that.the Mendota Heights'City Council • . �. urges'the DNR Commissioner to issue.the bridge permit to cross the ''.,� Blackhawk Lake`marsh, which, if issued will immediately a11ow the - ..
