RESOLUTION NO. 81-.05
RESOLUTION DENYING FEDERAL LAND COMPANY
APPLICATION FOR PUD
WHEREAS, Federal Land Company has applied for a PUD development for
a 5.6 acre tract of land located contiguous and easterly of Highway 13
and south of the alignment of Eugenia Street, and
WHEREAS, the Mendota Heights Planning Commission, at a regular meeting
held on September 23, 1980, voted unanimously to recommend denial
of said application, and
WHEREAS, the application was presented to the Mendota Heights City
Council and a public hearing on the application was duly held at
a regular Council meeting held on November 18, 1980, and
WHEREAS, at said meeting, all persons interested in said application
were afforded an opportunity to present their views and objections to
said application, and
WHEREAS, the City Council continued consideration of said matter to
this meeting, and
WHEREAS, the City Council has considered the application and has had
a thorough discussion in consideration of the matter, and
WHEREAS, the City Council has determined that:
1) The proposed PUD site contains a total 5.6 acres which
is substantially less than the 10 acres required for a PUD
development under the provisions of the City's Zoning Ordinance.
2) The proposed.PUD development would be out of character
and not compatible with the single family residences which
surround the site.
31 The density proposed for the PUD development would be
greater than that permitted in the R-1 one -Family Residential
District in which the property is located.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights, Minnesota, as follows:
11 That said application of Federal Land Company for a
PUD development upon the property hereinabove described
be and the same is hereby in all respects denied.
