Res 1980 - 64 Approving Plans & Specifications & Ordering Improvements for Valley View Oak ImprovementsCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 80-64 RESOLUTION APPROVING PLANS AND SPECIFI- CATIONS AND ORDERING IMPROVEMENTS FOR VALLEY VIEW OAK IMPROVEMENTS (IMPROVEMENT NO. 79, PROJECT NO. 8) WHEREAS, a public hearing was held on the 15th day of July, 1980, at 7:30 o'clock P.M. in the City Hall of the City of Mendota Heights, Minnesota, pursuant to resolution duly adopted by the City Council of the City of Mendota Heights on the question of the proposed construction of the following described improvements: The construction of an extension to the City's sanitary sewer system, including appurtenances and incidentals thereto, and the acquisition of easements, and the recon- struction where necessary of streets in the area herein- after more particularly described. The construction of a storm sewer system including appur- tenances and incidentals thereto and the acquisition of easements, in and for the area hereinafter more particularly described. The construction of an extension to the City's water dis- tribution system including appurtenances and incidentals thereto, and the acquisition of easements, and the recon- struction where necessary of streets in the area hereinafter more particularly described. The construction of street improvements consisting of the acquisition of easements and the grading, stabilization, drainage and bituminous surfacing, and the construction of concrete curbs and gutters on the streets to be situated in the area hereinafter more particularly described. WHEREAS, due publication of the notice of public hearing on said proposed construction has been attended to, and WHEREAS, mailed notice of said hearing has been mailed more than 10 days before the date of said hearing to the owners of each parcel situated within the area proposed to be assessed, all in accordance with the applicable Minnesota Statutes, and WHEREAS, the City Engineer reported that the proposed improvements and construction thereof were feasible and desirable and further reported bn the proposed costs of said improvements and construction thereof, and WHEREAS, the area proposed to be assessed for said improvements is situated within the City of Mendota Heights in Dakota County, Minnesota, and is more particularly described as follows: i The North 2/3rds of Lot 1, Burns'Heights, and That part of the NE 1/4 of Section 27, Township 28, Range 23 described as follows: Commencing 1,555.0 feet west and 214.5 feet south of skid NE corner; thence south 300 feet; thence west 200 feet; thence southwest 24 degrees 57 minutes west 306 'feet to the point of beginning; thence south 483 feet; thence west 340 feet; thence north 483 feet; thence east 340 feet to said point of beginning. All that part of Government Lot 2 and the SW 1/4 of NE 1/4 of Section 27, Township!iH, Range 23, lying south of the center line of TH:13, sometimes known as Sibley Memorial Highway and lying west of a line more particularly described as follows, to -wit: beginning at a point on the south line of the NE 1/4 of Section 27, Township 28, Range 23, at which the said south line would be intersected by the west line of Lot 1, Burns' Heights, if said west line were extended south, thence north along said west line to the NW corner•of said Lot l; thence east along the north line of said Burns' Heights to a point on the west line of Culligan Knoll, thence north along the west line of said Culligan Knoll to the NW corner of Lot 1, Culligan Knoll, thence west at right angles 340 feet to,a point; thence north at right angles to the center line of TH 13, excepting therefrom the following parts thereof, to -wit: (a) That part thereof now included in the plat of Leone ReArr. (b) Beginning at the NW•corner of Culligan Knoll, thence west along the westerly extension of the northerly line of Lot 1, said. Culligan Knoll 19.7 feet, thence south and parallel with the west line of said Culligan Knoll 200 feet, more or less, to the westerly extension of the southerly line of Lot 2, said Culligan Knoll, thence east 19.7 feet to the southwest corner of Lot 2, said Culligan Knoll, thence north along the west line of Lots 1 and 2, Culligan Knoll to the point if beginning, (herein•above intending to include all property included within the plat of Valley View Oak). ' and WHEREAS, the City Council then proceeded to hear all persons interested in said improvements and all persons were afforded aft opportunity to present their views and objections to the making of said improvements, and WHEREAS, the City Council has heretofore directed Engineer proceed with the preparation of plans and thereof ,• and WHEREAS, the City Engineer has prepared plans and for said improvements and has presented such plans to the City Council for approval. that the ity specific tions specifications and specifications NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1) That it is advisable, feasible, expedient and necessary that`the City of Mendota Heights construct the above des- cribed improvements, and it is hereby ordered that said improvements be made. 2) That the plans and specifications for said improvements be and they are hereby in all respects approved. 3) That hereafter said improvements shall be known and designated as Improvement No. 79, Project No. 8.
