Res 1980 - 52 Accepting Engineer's Report & Calling for Hearing on Proposed Sanitary Sewer, Water, Street & Storm Sewer Improvements to Serve the Valley View Oak Subdivision & Adjacent AreasCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 80- 52 RESOLUTION ACCEPTING ENGINEER'S REPORT AND CALLING FOR HEARING ON PROPOSED SANITARY SEWER, WATER, STREET AND STORM SEWER IMPROVEMENTS TO SERVE THE VALLEY VIEW OAK SUBDIVISION AND ADJACENT AREAS (IMPROVEMENT NO. 79, PROJECT NO. 8) WHEREAS, the City Engineer has submitted his report to the City Council with respect to the proposed construction of'the following improvements to serve The Valley View Oak Subdivision and adjacent areas, to -wit: The construction of an extension to the City's sanitary sewer system, including appurtenances and incidentals thereto, and the acquisition of easements, and the recon- struction where necessary of streets in the area hereinafter more particularly described. The construction of a storm sewer system including appurte- nances and incidentals thereto and the acquisition of easements, in and for the area hereinafter more particularly described. The construction of an extension to the City's water distribution system including appurtenances and incidentals thereto, and the acquisition of easements, and the recon- struction where necessary of streets in the area hereinafter more particularly described. The construction of street improvements consisting of the acquisition of easements and the grading, stabilization, drainage and bituminous surfacing, and the construction of concrete curbs and gutters on the streets to be situated in the area hereinafter more particularly described. WHEREAS, the area proposed to be assessed for said improvements is situated within the City of Mendota Heights in Dakota County, Minnesota, and is more particularly described as follows: The North 2/3rds of Lot 1, Burns' Heights, and That part of the NE 1/4 of Section 27, Township 28, Range 23 described as follows: Commencing*1,555.0 feet west and 214.5 feet south of said NE corner; thence south 300 feet; thence west 200 feet; thence southwest 24 degrees 57 minutes west 306 feet to the point of beginning; thence south 483 feet; thence west 340 feet; thence north 483 feet; thence east 340 feet to said point of beginning. All that part of Government Lot 2 and the SW 1/4 of NE 1/4 of Section 27, Township 28, Range 23, lying south of the center line of TH 13, sometimes known as Sibley Memorial Highway and lying west of a line more particularly described as follows, to -wit: beginning at a point on the south line of the NE 1/4 of Section 27, Township 28, Range 23, at which the said south line would be intersected by the west line of Lot 1, Burns' Heights, if said west line were extended south, thence north along said west line to the NW corner of said Lot 1; thence east along the north line of said Burns' Heights to a point on the west line of Culligan Knoll; thence north along the west line of said Culligan Knoll to the NW corner of Lot 1, Culligan Knoll, thence west at right angles 340 feet to a point; thence north at right angles to the center line of TH 13, excepting therefrom the following parts thereof, to -wit: (a) That part thereof now included in the plat of Leone ReArr. (b) Beginning at the NW corner of Culligan Knoll, thence west along the westerly extension of the northerly line of Lot 1, said Culligan Knoll 19.7 feet, thence south and parallel with the west line of said Culligan Knoll 200 feet, more or less, to the westerly extension of the southerly line of Lot 2, said Culligan Knoll, thence east 19.7 feet to the southwest corner of Lot,2, said Culligan Knoll, thence north along the west line of Lots 1 and 2, Culligan Knoll to the point of beginning, (hereinabove intending to include all property included within the plat of Valley View Oak). WHEREAS, in said report said City Engineer reported that the pro- posed improvements and construction thereof were feasible and desirable and further reported on the proposed costs of said improvements. NOW THEREFORE, IT IS HEREBY RESOLVED, that the report of said City Engineer be and is hereby received, and BE IT FURTHER RESOLVED, that a public hearing on said improvements be held on Tuesday, July 15, 1980, at 7:30 o'clock P.M. at the Mendota Heights City Hall in the City of Mendota Heights, and BE IT FURTHER RESOLVED, that the City Clerk, with the aid and assistance of the City Attorney, be and is hereby authorized and directed to prepare a notice of said hearing and to cause said notice to be published and mailed to the owners of the property situated within said area, all in accordance with the applicable Minnesota Statutes.
