The regular meeting of the Mendota Heights Airport
Commission was held on Wednesday, June S, 1994, in the
Large Conference Room, 1101 Victoria Curve. The meeting
to order at 8:00 o'clock P.M. The following members wer

The Commission acknowledged receipt of the ANOMS Report for
April. Commissioner Olin stated that the MAC Air Noise
Complaint Line is answered by an answering machine:

Commissioner Fitzer arrived at 8:08 o'clock P.M.

The Commission briefly reviewed the MASAC Monthly Complaints
map for the month of April. �
It was noted there were 43 complaints registered by Mendota
Heights residents in the month of April. Also, the Commission
noted, as per the Runway Use Report - Jet�Operations for
departures, that Runways 11L and 11R were used equally
overall, while at night Runway 11R was favored. �
Administrator Lawell pointed out that 40 percent of the Jet
Carrier Operations were Stage 3 aircraft and 60 percent of the
Jet Carrier Operations were Stage 2 aircraft. It was noted
that this was the second month in a row that 40 percent of the
aircraft operations were Stage 3 aircraft. 'l
The Commission acknowledged receipt of the NOISE Newsletter
for May. Chair Beaty noted that there is a Noise Conference
scheduled for July 27-30 in College• Park, i�Georgia.
Administrator Lawell stated he will inform the City Council of
the conference.

A brief discussion ensued regarding Stage III and the prospect ,
of a new Stage IV aircraft someday.
The Commission discussed hushkits and Commissioner Stein
stated he had recently read where a major manufacturer of
hushkits has dropped out of business due to lack of orders for
hushkits. Administrator Lawell briefly explained the types of
aircraft which NWA will retire and hushkit.
The Commissiori acknowledged receipt of the Richfield 150
Buyout Update for May.

Administrator Lawell explained that the magnets had been
ordered and that they will be delivered by June 16, in time
for the workshop with the City Council. Lawell explained that
the ma.gnet will have a picture of an airplane with a slogan
along with the MAC air noise complaint line phone number. The
magnet size will be 2" by 2" with gray background and maroon
lettering.
Commissioner Fitzer stated he has mentioned the magnet idea to
several neighbors and that he has gotten a favorable response
from most of the people.
Administrator Lawell explained how the magnets would be
distributed. He stated that the magnets would be distributed
to households and businesses with the 55120 zip code. He
explained that Highway 110 will be the boundary line dictating
what households and businesses will receive the magnet. He
stated that residenta north of Highway 110 will be encouraged
to contact the City Hall and request a ma.gnet.
IIPDATL ON APPOINTMENT OF NL� AIRPORT
R}3LATIONS COD�lISSIONFR
Administrator Lawell stated that on June 7 the City Council
appointed Ms. Cynthia Surrisi who resides at 1875 Warrior
Drive to the Airport Relations Commission. He explained that
Ms. Surrisi is an attorney who specializes in the area of
aviation law. He stated that she is currently employed as
legal counsel to the Airline Pilots Association. Lawell
stated that Ms. Surrisi will be unable to attend the June 16
workshop due to a prior commitment but that she will be in
attendance for the Commission's July�l3��meeting.

Lawell stated that Ms. Surrisi's term will expire
of 1995. �

The Commission reviewed a memorandum submittedl�by Mayor
Mertensotto regarding his recent attendance of a MASAC meeting
held on Tuesday, May 24. Mayor Mertensotto attended,the MASAC
meeting as a substitute for the City's regular repreisentative,
Councilmembe� Jill Smith.
Chair Beaty noted the Ma.yor's request of Mr. John�Foggia to
define the Eagan/Mendota Heights corridor. Beaty stated there
seems to be no northern boundary and if the MAC is viewing the
corridor in this matter, he is very concerned. Administrator
Lawell briefly diacussed a letter which waa sent from the City
to Jeff Hamiel regarding the corriclor. He stated the City has
not yet received a reply from Mr, Hamiel. II

Commissioner Fitzer explained that the airport has a VOR on
its field. He explained that this VOR transmits signals to
all aircraft which then can select a radial (heading)e He
atated most airports can use this as their mainlmeans of
navigation. He stated he questions why this is not'�used more
often at the airport. Fitzer stated that by using the VOR
headings given can be narrowed and can be made more precise.

Fitzer briefly explained different noise reduction procedures.
He explained the FAA�s Close-In and Distant Takeoff Procedures
which could possibly reduce noise generation over Mendota
Heights. He explained that the Close-In Community Profile is
a steeper departure path. He stated that these profiles may
be worth addressing in reducing noise generated over Mendota
Heights. He stated that these profile procedures are not
currently being implemented at any airports in the' Country.
He stated that these profiles should be tested• �I ,
Administrator Lawell stated he has seen information,regarding
these procedures. The FAA adopted these procedures to
minimize the proliferation of locally developed procedures
around the country. It appears as if the FAA;Ihas left
adoption of these policies in the hands of the airlines rather
than with the airport operators.. Lawell stated that this

information was recently reviewed by the MASAC Operations
Committee and that he will get a status report. Commissioner
Fitzer stated that this information is currently in NWA
manuals. �
In response to a question from Chair Beaty, Commissioner
Fitzer stated that by using the VOR, it could move the
tracking further south. He further explained there are
different classes of VOR's.
Commissioner Fitzer stated he would like to hear why the FAA
chooses to not implement these procedures.
Commissioner Olsen commented that according to the Mayor's
memorandum, the MAC Chairman is not aware of the existence of
the MASAC group. In response to a question from Commissioner
Leuman, Administrator Lawell stated that Steve Cramer is a
former south Minneapolis Councilmember who relinquished his
seat as Councilmember when he lost his bid to become Mfayor and
then took an appointment to the MAC.

Administrator Lawell explained that on June 16 the Commission
will meet with the City Council to diacuss the current status
of the air noise problem within the community and to
strategize on ways in which the City can effectively minimize
the overall air noise impact.

to be completed to achieve results.

Leuman stated that state representatives should be lobbied.
Commissioner Fitzer stated the City of 1Kendota Heights needs

stated the MAC should have representatives on the,Commission
whose communities are directly affected by airport operations.
He stated ,communities such as Worthington �i�have MAC
representation and he stated he questions their involvement.
Administrator Lawell stated it was a political decision to
broaden representation on the MAC as aviation is alstatewide
concern. He stated the MAC should balance more metropolitan
representation rather than out state representation.
Chair Beaty stated he does not want to rule out

tower order predated NEPA. Fitzer inquired if anyone has ever
contested the legality of the change order. Lawell stated
that an inquiry would require someone to research and analyze
FAA administrative procedures in effect in 1973e

Chair Beaty suggested that a letter be sent requesting that
only Stage III aircraft use Runway 11L. Commissioner Fitzer
explained that size of aircraft, length of runway and aircraft
destination c�ictates which planes use specific runwayse
Commissioner Fitzer stated that MSP could set a precedent for
other airports in implementing Close In/Distant flight
procedures.
The Commission discuased inviting Jeff Hamiel, Executive
Director of the MAC and Bruce Wagner of the FAA to attend an
Airport Relations Commission meeting.
A brief discussion ensued regarding whether or not the airport
will be relocated. It was noted that Mayor Mertensotto
believes that the airport will stay. Chair Beaty inquired
what the MAC is doing with the ANOMS information.
Commissioner Olsen stated he will be on vacation and will not
be able to attend the workshop.

This corporation was fomied in furtherance of the general welfare of the communities
adjoining M'inn,eapolis-St Paul International Airport - Wold-Chamberlain Field, a
public airport in the County of Hennepin, State of IVI'wnesota, through the allevia6� of
tbe problems created by tl�e saund af sircraft using the aiiport; through study and
evaluation on a continuing basis of the problem and of suggestion for the alleviation of
the same; through initiation, coordination and promoti� of reasonable and effective
procedures, control and regulations, consistent with the safe operation of the airport and
of sircraft using the same; and through dissemination of information to the affected

Group on Land Use Compatibility were surprised and
disappointed when they learned during a meeting June 3
in Washington that a provision establishing a new grant
pmgram for �land planning around airports, which they
had helped shape, had been stripped from pending Senate
legisladon even though it had no known onposition.
The proposal would have made grant funds from the 12.5
percent noise setaside in the Airport Improvement Pro-
gram available to local governments for joint compadbil-
ity planning with airport operators. Originally drafted by
the Clinton administration, the pmvision had been re-
viewed and revised by the study group. Individually the
members of the group had lobbied the Senate Aviation
Subcommittee in favor of its passage. Since the group
represents an unusual collection of traditionally adversarial
interests, their unanimity in this instance was striking and
had raised hopes for enactment.
However, at its June meedng the group learned that the
provision had been deleted. There appeared to be no clear
reason for the action by Senate staffers removing i� But
it has often been the fate of legislative provisions con-
cerning noise to fall victim to political infighdng over
larger, unrelated disputes among powerful parties in the
aviadon community. Consequendy, among the study
�roup members, long-time Washington hands took the
atback in stride, resolving to fight again another day, but
the non-Washington representatives found the develop-
ment disturbing and quesdoned whether they should
continue to participate.
JUNE 1994
Despite promised last-minute� attempts by group mem-
bers to have the language restored, as this is written the
Senate appears ready to enact the Airport and Airway
Improvement Bill (S.1491) without it. In a conveisation
June 14 with NOISE Presid'ent Conrad W. Bowers,
Martha Moloney, the, executive assistant to Chairman
Wendell H. Ford of the Senate aviation panel, said that
only NOISE had contacted ,Ford's office expressing
support for the pmvision, implying that it lacked wide-.:
spread bacicing. Efforts to restore the provision in a
House-Senate conference on''the bill are not likely to
succeed if neither chamber's version contains it, accord-
ing to Chief Counsel David 'Heymsfeld of the House
Aviation Subcommittee. � � �
In other business during its June meeting, the group heand
a presentation from an official of the Department of
Housing and Urban Developriient which showed that
HUD is, remarkably enough, �even less advanced in its
policies regarding noise-impacted residential develop-
ment than FAA. In fact, as study group member porn C.
McGrath, dinector of the George Washington University
Insdtute for Urban Development Research, pointed out,
HUD's policies were actually� more enlightened years
ago than they are today. �

Jcel Segal of HIJD's Office of Environmental Quality
expYained that agency policy essendally concerns itself
only with multifamily housing inside the DNL 75 dB
contour. Recendy HUD's subdivision review require-
ments were weakened to eliminate the need for an envi-
ronmental assessment and corisultation by a HLJD ap-

At the beginning of the meeting, most of the »on-aviation

that FAA officials had caused the recard of the group's
proceedings to be changed so as to erase a consensus the
graup reached last March an the difficult issue of setting
impact thresholds for residential land uses.

in the record, an FAA. spokesman had aclmitted ordering
the changes and when pressed said the original language
would be restored. Subsequently it was. But the fact that
the agency felt it could change the record at will exacer-
bated already deep frustradons amang the community
interests, who have felt from the beginning that FAA's
intenrion was to direct the work of the study, graup to a
pr�determined outcome.
At a meeting March 3 in San Diego, CA members of the
graup had reached a compromise on the thorny issue of
naise impact thresholds. T`Irey agreed there was a need
for further study of a possible dual approach to the
prabiem that might set the threshold at DNL 6t} dB faT
newresidentialdevelopment while leaving it at 6S dB fo�
cxisting residentia2 uses (See the April NOISE Newslet-
ter). Members agreed th:at the study group itself was nat
an appmpriate venue for detaiied anatysis af the propasai
but that the group could groperly recommend further
conside;ration of the idea by anather, presumably techni-
cally qualified, body.
A recard of ihe March 3 meedng, written by an FAA
consultant, was reviewed by the study graup at its April
29 session. The record accurately reflected the consensus
on thresholds, repordng that the group "supported con-
sideration of twn separ•ate thresholds" and describing the
proposal for the paired DNL 65 dB and 60 dB standards.
�%owever, an expanded version of the record, distributeci
by the consultant to members on May 20, said only that
th�e group had "considered" two tiiresholds in Maz�ch.
Furthermore, the sentence describing the 6Q dB standard
for new development was enrireiy nussing. .

When asked by Price on May 20 why the changes had
been made, FAA official James P. Muldoon - who admit-
ted to having ordered them - explained that he did not
believe there had been a consensus. Muldoon did not
explain why, if there had been no consensus, he had failed
to chaltenge published accounts in the trade journal
Airport Noise Report of March 14 and in the NOISE
Newsietter for April that cieariy described one.
Muldoan is FAA's offcial staff representative to the
study group. The groap was specially appainted to
address the land use campatibitiry qaesdon and cansists
of airport and airline interests, state aviatian regulatars,
other representatives of the aviation industry, communi-
ties, and the field of urban planning.

almost universally believe to be too high - so long as

colerate the lower 60 dB threshold for new development.
In a furthercompromise, communities haddecided not to
try to press on the group their long-held opposition to the
DNL metric itself.

Prior to the San Diego meeting, several of the non-
aviadon members of the study group had grown impa-
tient with the effort. But the successful San Diego
meeting seemed to revive hope that the initiative was
worthwhile after all. Not only was c,onsensus reached on
the threshold issue, the group also agreed on the revisions
to the proposed legislative language establishing the new
land-use compatibility grant program.
Particularly outspoken about the FAA's tinkering witti
the record were Grapevine, TX City Council Member, and
NOISE First Vice President Sh'arron Spencer, McGrath,
and Price. After a thorough airing of the issue at the outset
of the 7une 3 meeting - during which FAA spokespersons

.,_ �ceviewing and cQrrecting the record wouId be form�al-
ized in order to avoid simiiar problems in the future. The
concerns of,.the community interests were �iso eased �
when the FAA consultant presented for comment a pro-
posed oudine of the study group's final report which
faithfully reflected the tenor of its work and the likely
content of its recommendations.
In another development tending to support the indepen-
dence of the study group from FAA's control, George
Howard, president of the Airports Council International-
North America and chairman of the FAA Research Engi-
neering and Development Advisory Committee of which
the study group is a subset, reaffumed that "by no means
should FAA guide anyth'ing that comes from the group."
He stressed that the advisory committee seeks various
viewpoints and that FAA's role is only to facilitate the
work of the study group. �
The Study Group meets again on June 20 to begin work
inalizing its report. ••

GRANTS TO NLC STE�ERING PANEL
NOISE President Conrad W. Bowers of Bridgeton, MO,
who also serves on the Nadonal League of Cides' Steer-
ing Committee on Transportation and Communicadons,
has presented a dr�ftresoludon to the NLCpanel express-
ing support for a proposed new grant program fostering
collaborative noise compatibility� planning by localities
and airports (See related story in �this issue). The Com-
mittee appr+oved the resolution June 17 at its meeting in
Chesapeake, VA. i I
The resolution notes that the problem of incompatible
land uses around airports has res'isted an effective solu-
tion for many years despite the efforts of some cities and
airports and notes further that the programmadc instru-

The Metropolitan Airports Commission condemnation
of New Ford Town and Rich Acres is proceeding. An
article in the May 31 st edition of the Star Tribune
points out that residents aze getting prices based on the
values of their homes as if there were no rroise pol-
lutiori. Homes in New Ford Town were compared with
ones outside the noise affected neighborhood to
determine their value. This is required in condemnation
proceedings. �Some residents received .$15,000 to
$25,000 more than the assessed value of their homes
and most residents are getting more tttan the assessed
value for their home. They also receive relocation
expenses.
Many homes in South 1Viinneapolis are far more af-
fected by airport noise pollution than those in the
Richfield sections. The City of Mmne�polis opgoses

Airport Expansion Plans
Expansion of the current airport is proceeding in advance of the Legislature's Dual Track
decision in 1996.- An article in the May 6 issue of Ciiy Business describes a MAC proposal to
spend $30,0OO,OUO to add 143,0OO��sy. ft. of space to the Lindbergh ternunal to accommodate
customs inspections for international flights and to lease space to Northwest Airlines for an
"NWA Club". The primary purpose of the expansion is to facilitate; and thereby expand
international operations at the airport.

The proposed addition would be financed by Passenger Facility Charges (PFC) - those extra $3
taxes you pay every time you use the airport. These charges, levied on airline tickets at the gate,
were authorized by Congress in the 1990 Airport Noise and Capacity Act.
The MAC proposal ignores the recent ruling of the Nfinnesota Court of Appeals that state
pollution laws apply to airport noise and that airport operations are in violation of State laws.
SMAAC opposes any further increase in capacity at the airport until significant steps have been
taken by the MAC to curtail the noise gollution.
Part of the problem is due to the steady acquisitions over the years of older noisier stage II jets
by Northwest Airlines. As of April, 1994, NWA had approximately � 43% stage III utilization
rate nationally , lower than any American c.arrier except TWA, and lower at MSP. Federal law
requires all stage II jets to be eliminated by the year 2,000.
PFC funds should be used to reduce the levels of illegal noise pollution. Couldn't PFC funds be
used to help Northwest Airlines meet the requirements of Federal Law? For example the
$30,000,000 could be used as loans to retrofit the old DC-9's and 727's with new engines or for
the purchase of Hush kits. (see next article)

dispersi�g it more equitably over a wider range, thereby lowering its iwtensity. But look at the data from

City Council due to legal issues raised by the city attorne�'s office. Council Member Mead is

AnnuaY Sprin� Meeting
About 60 people showed up for the Spring Meeting at Diamond Lake Lutheran
Church on Thursday, May 26. Presentations were made by JeffHamiel, Dore Mead, and
Tom Goodman. The usual animated discussions took place, and were especially livened up
by the presence of both JeffHamiel and Tom Goodman. The meeting adjourned at 9:00 p.m.
but many stayed afterward to continue the discussion. We recruited several riew potential
board members from among �the audience. The SMAAC board strongly urges its
membership to get involved and attend these meetings. They are informative � and they are
crucial to building support for change. ' I

Heights, and Tom Lavel� City Administrator of Mendota Heights. John Gordon, of

pollution on KSJN on Wednesday, June 1, the eve of the oral hearings before the Minnesota

Justices Sandx�a Gardebring and John Simonett recused
themselves. Gardebring wrote the riPCA regulations under
dispute, and Simonett is 'retiring on June 30th�. Justice
Rosalie Wahl will leave on August 27. Governor Carlson has
named Ed Stringer, his chief of staff, to replacelWahl, and
Paul Anderson, chief judge of the Minnesota Court �of Appeals
to the State-Supreme Court. �

The initial appropriation of $5,000 for the lawsuit has
finally been received. Council Members Dore Mead��and Steve
Minn's request for an additional $5,000 has met opposition
from the City attorney due to questions about funding
lawsuits not directed by the city attorney's office. The
SMAAC board believes the City of Minneapolis has an
obligation to defend it residential neighborhoods against
illegal noise pollution from all sources, including the MAC.
The response to our fund drive has been fantaltic, with
over $10,000 from 290 contributors. If you have not yet
contributed to the lawsuit but would like to, -fill out the
enclosed form and send in your donation. Our fund-raising
ability is not only a warning to the MAC to stop breaking
the law, it sends a strong message to elected officials that
they need to do something about this problem. ;�

concerned about aircraft noise generated by operations at
Minneapolis/Ste Paul International Airport. Your City Council is
equally concernecT about this problem and is actively seeking

it is very important you make the call!
On a monthly baais the MAC compiles air noise complaint
statistics from all communities surrounding the airport. While
airport operations are not directly influenced by the complaint
data reported, it is import nt for the MAC to understand the
X.ma.gnitude of the problem ur�oise pollution causes within
Mendota Heights. In additi , the City Council and Airport
Relations Commission can use this data when representing you

The magnets invite those bothered by air noise to calllthe MAC

all Mendota Heights postal patrons, including all City� �

"Living in c3.ose proximity to the airport, our resident`s shauld
expect to receive some aircraft noise" aaid Mendota Heigh�s
Airport Re3ations Commission Chair Scott Beaty. "However our
resident� should not be expected to bear an inordinate amaur�t of
�he noise simply because our°City i� less densely populated than
some of our neighbars" he added. A large partson af the
community currently receive� repetitive overflight� from aircraft
departing MinneapolisJS�. Paul International Airport which is
loca�ed west of the City. ;�
The Mendota Heights City Councii and the Airports Rel�ations
Commission are pursuing modifications in the departure procedures
used at the airport ta reduce the overall amount of air�naise
affecting the Ci�.y. In 'addition, the Council_ and Comm�ssian are
currently preparing an Airport Naise Pl.an of Action which wil1. be

to modi�y the draft Aa,rport Noise Plan o� Action to reflect the
comments made that evena.ng, Attached for your review please �ind
a second draft of the document. Change� made to the Plan of Action

Relations Commission was held on Thursday, June 16 r 1.994 in the
Gity Hal1. Large Conference Room, 11Qi Victoria Curve. The meeting
was called to order at 7:40 o'clock P.M. The following members
were present: Mayor Mertensotta, Councilmembers Huber; Roch and
Rrebsbach. .Airport Commissioners Beaty, Stein, Olin, Leuman and

Adminietrator Lawell stated that one of the City's� goals in
noiae reduction through modifa.ed takeoff procedures is the
implementation of non-simultaneous takeoff procedures which
could mini.unize Mendota Heights Air Noiae $xpoaures. Lawell
stated that in January of 1992 the MAC approved non-
aimultaneous takeoff procedures which better avoid Nlendota
Heighta residential areas. He atated that these procedures
have not been implemented. Lawell explained that a letter had
been eent to MAC Fxecutive Director Hamiel inquiring�why these
procedures have not been 3mplemented. Lawell stated the City
has not received a reaponse. �
Mayor Mertensotto etated this argument has continued for at
least four y.ears . He stated that the City has been'� itold that
aircraft follow runway headings then the middle marker.
Coirnnissioner Fitzer atated that procedure is ne�ver done.
Mertensotto atated that the MAC cannot get the FAA to fa.n the
aircraft. He�.stated that they do not want to "mess� with the
corridor. Lawell stated that the MAC and FAA hesitate to bolt
down a northern boundary due to projected future increases in
the amount of air traffic at MSP.; Mertensotto �stated an
additional runway ��will allow more choices in takeoff

Administrator Lawell stated the Airport Relations�Commission
has suggested Mr. Jef£ Ham.iel at��end one of their` upcom�.ng
rnee�ings. Commi,asioner Beaty reiterated that�a letter

and that the City has not received a response. Mayor
Mertensotto stated the City of Inver Grove Iieights has alsa
sen� correspondence to the MAC and �hat MAC hasl nat been
responsive, Councilmember Rrebsbach stated that Mr. xamiel
should be invited to a meeting and tha� the City ahould
clarify wha.t�'steps are in place to relieve the air noise over
the City and what steps have not been implemented.�

Lawell stated that he will'draft a letter invi�ing Mr. Hamiel
to attend an Ai.rpor� Re].at�.ans meeting and thaG he will draft
a letter to the MAC requesting an update on revised non-
simultaneou� takeoff procedures. In response to a question
from Mayor Mertensotto, Commissioner Fitzer stated'that the
type of heading depends upon the type of aircraft.i�
Councilme�rtber Rrebsbach stated that U.S. Representative
Oberstar's comments should be announced at a Council meeting
and that the community needs to be focused, Mayar Mertensa�to
suggested that a copy o£ the arGicle should be submitted with
the Frida.y News and that the rnatter should be publicized.
Councilmember Rrebebach s�ated the Council should adop�. a
resolution and then send to the MAC. Administrator La.well
suggested that the Council review this item at the�ir second
meeting in July. i
Adm�.nis�rator Lawell stated anather goal cauld be �o test new
Runway 11L/11R degarture procedures defined '� by VOR
Navi.gational. Aids . Lawell explained that the VOR Navigational
Syatem is a radio beacon which sends out radials to�aircraft
which can then lock in on a frequency. Cozmniasioner Fit�er
stated tha� this system� is currentl.y not used',lat MSP.
Commissioner Fitzer sta�ed tha.t this syetem �vould da away with
arbitrary headinga, He atated the Ci�y af Mendo��a Heights
could pick a good tracking and get it approved by the FAA and
MAC. Laraell presen�ed �he Council and Commission with a map
indicating five degree increments showing tracking of
aircraft�. Cauncilmember Krebsbach stated �hat the purpose of
this process is to concentrate aircraft traffic (i'�e.� same

Commissioner Beaty inquired what airports are currently using
VOR radials to define departure headings. Commissioner Fitzer
responded the new Denver airport. Councilmember'IKrebsbach
inquired if VOR tracking were given, could aircraft miss
Mendota Heights. Commiasioner Fitzer responded no,but that a
heading could be given which would be just south of the
Furlong ANOMS monitor no. 23. �I�
Mayor Mertensotto stated tha.t using the VOR navigational aids
would not be in the best interest of the community.
Councilmember Rrebsbach stated the City should concentrate on
challenging the corridor issue. !I

The Coun.cil and Commission discussed specific departure tracks
over Mendota Heights. Councilmember Huber inquired how
Commissioner Fitzer was able to change a epecific�departure
tracking as directed by the control tower. Commissioner
Fitzer etated that pilots are able to deviate from asaigned
headings by a few degrees. Mayor Mertensotto stated that the
FAA's main concern is pa.asenger safety. He stated no changes
can be made unless the N�,C agrees and that it can be �backed by
an EIS . I (
In response to a question from Councilmember Krebsbach, Mayor
Mertensotto stated that the City is asking for anl'equitable
distribution of aircraft noise and that the City ahould
consider having political representation on the MAC.
Commissioner Beaty stated other communities se�em to be
protected from,air noise and that Mendota Heights is the
scapegoat. Administrator Lawell stated that the City has been
negatively impacted by the evolution of the airpo'rt and by
what has transpired over the years. He stated the City should
consider uaing the Freedom of Information Act to obtain
specific information regarding past decisions wliich have
impacted Mendota Heights. ;I

fact that the control tower chief who made the change order
lived in a specific neighborhaod which benefitted � from the
change order and tha� infor�ration regarding how there has been
increased hub and flight ac�ivities sinee 19?3. Administrator
Lawel.l atated that the City could conaider do3.ng some legal
research regarding what adm�.nzstrative pracedures were used by
Ghe FAA in 1973, Mayor Mer�enaotto sta�ed �hat the pub].icity
needs to get out and that the City needs to take�a strong
position. '�

Mayor Mertensotto stated the City ehould receive informa.tion
regarding the change order �hrough �he Freedom of Information
�f.et . He s�ated he does not want to see the City� hire a.n.
attorney's affice to research this informa�ion as he does not
want to spend the money, Mayar Mertensotto stated!the City
has financially supported �he SMAAC lawauit. Councilmember
Huber stated the community would be better aerved if the
conununity was made aware of the changes within the 2ast twenty
yeara. Administrator Lawell sta�ed Mr. Bob Collette did
research changes since 19?3 and there have been 'at least
fifteen changes. �� '
Mayor Mertensotto stated that Ms. Dore Mead, Counci]amember
with Minneapolie, has requested a meeting with Administrator
Lawell, Councilmember Smith and himsel�. He s�ated��that the
City needs allies in pursuing the air noise problem,;,and that
Minneapolis and Invar Grove �eight� may be the best a13.ies.
The Council and Cammiesion briefly discussed how Inl�er Grove
Heights is impacted wi�h air noise. A discussian�further
ensued regarding how Mendota Heights' north end is not
�ignificantZy intpac�ed with air noise and that those residents
are not too cancerned. Councilmember Huber briefly relayed a
conversation he had recently with a resident on Marie Avenu.e
regarding air noise. ��

with the entire con�ttnxnity. She stated all neighborhoods
ehould be kept well informed. She atated tha.t;�the City
Council ehould identify the issues at an upcoming City Council
meeting and then publicly inform the community what,'steps the
City is purauing in its fight against air noise. Mayor
Mertensotto stated that along with the letter and magnet, the '�

Lawell pointed out that eventually the MAC and FAAiwill hear
about Mendota Heights efforta in educating its comim�nity on

Lawell stated the Airport Relations Commission has'discussed
the possibility of having a city resident appointed to the
MAC. Councilmember Huber suggested that Mr. Kevin Howe,
resident of Mendota Heights and Metropolita.nl Council
Commissioner, should be contacted as he may have an idea on
who is active in the community. Adminiatrator Lawel'1 briefly
reviewed that members on the MAC are statewide members and
that a representative from Bloomington represents Mendota
Heights. Councilmember Koch suggested that to heighten the
awareneas, Legislators ehould be informed. Commissioner Beaty
stated the �Airport Relations Commission had discussed
informing and inviting legislators representing� Mendota
Heights to attend future Commission meetings. �

and that we need to find an equitable solution.

Please be reminded the City Council and the Airpo,'rt
Relations Commission (AR.C) will be meeting in a joint workshop
this Thursday, June 16, to discuss the preparation of a Plan of
Action aimed at reducing airport noise within 1�lendota Heights. It
is the intent of this memo and attachments to lay the basis for
the workshop.

DISCIISSION� i

Given the magnitude of the 1°airport issue", it is�often
difficult to make headway in our fight to minimize community air
noise. Easily there are 10-12 broad categories of air�lnoise
related policy issues which could command our attention and
resourcesa In order to address the "whole", the Commission noted
the importance of dealing with the "parts" in hopes of�,�making
incremental progress on the air noise problem. By "chunking1° the
air noise problem down into "doable" action steps, we could set
the City on course to make meaningful strides for the iuture.

The model the Commission chose to use in developing the Plan
of Action involves five basic stepse These include: i

Within these five policy issues the Commission identified
eleven goals which might be worthy of our pursuit. Attached
please find a copy of a draft Plan of Action as developed by the
Commission at its June 8th meeting. Please note that a number of
the ideas expressed in the document are just that, ideas which
will certainly need further work prior to adoption andl
implementationo Furthermore, some of the ideas may be mutually
exclusive-- for example, some of the ideas advocate for
concentrating air traffic over a smaller defined area while other
advocate for greater aircraft fanning. Ij
