�' The regular meeting of the Mendota Heights Airport�
Commission was held on Wednesday, May 18, 1994, in the'
Large Conference Room, 1101 Victoria Curve. The meeting,�

The Commission acknowledged receipt of the ANOMS Report for
March. It was noted, as per the nighttime jet only operations
report for departing aircraft, the south parallel runway was
used 40.3 percent. Administrator Lawell noted that'1according
to the Runway Use Report - Jet Operations, Runways i1L and i1R
were balanced in use during the day. Lawell pointed out,
during the month of March, 40.5 percent of the Jet Carrier
Operations were Stage 3 aircraft and 59.5 percent of the Jet
Carrier Operations were Stage 2 aircraft. �.
In response to a question from Chair Beaty, Commissioner
Fitzer stated that with installation of Hushkits on Stage 2
aircraft, the aircraft is then categorize as Stage 3. He
stated that a Hushkit is an extension off the aircraft engine
similar to a car muffler. il
Chair Beaty stated that 727 aircraft are the loudest aircraft
along with DC9 aircraft. Commissioner Fitzer stated that the
same engines are on both of the aircraft but that tlie 727 has
three engines instead of two. ;�
The Commission acknowledged receipt of the NOISE Newsletter
for April. Administrator Lawell pointed out that Mr. William
F. Albee, of the Federal Aviation Administration, has
suggested that the NOISE may want to reconsider its position

favoring federal investment tax credits (ITC) for owners of
Stage 2 planes who hushkit them to meet Stage 3 noise
standards. Lawell stated that Nlr. Albee, has information that
hushkitted aircraft are considerably noisier than new Stage 3
' planes even if they meet Stage 3 noise standards. Lawell
explained that this could have a long term implication in that
the federal ITC legislation, which NOISE has supported, could
keep noisier planes flying longer.
Commissioner Fitzer stated that in reviewing the Jet
Departurea and Arrivals Maps within the ANOMS report, he had
noticed specific areas which were not affected by air noise,
specifically Lake LeMa.y in northern Eagan. He stated there
seems to be quite a variance in the northern boundary of
aircraft travel. He suggested that the City should define its
own corridor and then superimpose it onto existing maps
showing departures and arrivals.
Administrator Lawell stated he would obtain an overlay to
superimpose on the ANOM' s Flight Tracking Map which would show
City boundaries and corridor data. Given that the corridor is
based on aircraft headings and not ground tracks, the overlay
would be more of an approximation rather than an absolute.
Commissioner Fitzer suggested that a list of target issues be
created to help steer the Commission in the direction of
making air noise more equitablee Administrator Lawell stated
that a list could be presented at the City Council/Airport
Relations Commission joint workshop in June.
Commissioner Fitzer stated, in reviewing the MSP Ma.rch 1994
Complaints Summary within the ANOMS report, that it seems the
airplanea are being sent over ares were there seems to be a
small resistance of complaints.
The'Commission acknowledged receipt of a Chicago Tribune
article regarding a ruling that the roar of jet noise around
0'Hare International Airport is a nuisance for its neighbors.
It was noted that the Judge ruling on the case determined that
" the City of Chicago was responsible for creating an ongoing
noise nuisance in some public schools around 0'Hare and that
. the judge required the city to pay the cost of abating that
nuisance.
In response to a question from Chair Beaty, Administrator
Lawell briefly explained the Part 150 Sound Insulation Program
currently underway in the Furlong Addition. Administrator
Lawell briefly explained the MAC's Passenger Facility Charge.

Lawell explained that the major purpose of the National
Environmental Protection Act (NEPA) is to require��agencies,
prior to undertaking a major federal action, to take a°hard
look" at the environmental consequences of the' proposed
action. He explained that the MSP Tower Order of 1973
predated NEPA regulations. ,h�

Lawell explained that the Appeal Court's decision in the
Deerborn caae went against the plaintiff township'Iand city.
He stated that he has discussed this case with: the City
Attorney for Deerborn and that he was advised�, by the
attorney, that they are currently evaluating their options
relative to this case. He stated the City Attorney informed
him it would be unlikely they would be filing an appeal for
review by the U.S. Supreme Court. ��
A brief discussion ensued regarding how people are'appointed
to the Metropolitan Airports Commission and that the City
should be lobbying for an individual to help represent the
City of Mendota Heights on the MAC. '

Administrator Lawell explained that the Commission had
discussed, at a prior meeting, the nationwide phase out of
noisier Stage II jet aircraft as specified by the iAA.

In response to a question from Commissioner Olin,
Administrator Lawell explained that the phase out of Stage II
aircraft is to be fully complete by the year 2000,, however
airlines which are at least 85 percent Stage III by the year
2000 will be able to apply to the FAA for a three;iyear time
extension in which to complete their equipment transition.

Administrator Lawell stated that MAC staff has indicated that
Northwest has recently stated the company does not intend to
submit a time extension request as allowed by the FAA in the
year 2000. He stated MAC officials have stated that they have
' asked Northwest whether they are willing to commit to that
statement in writing and Northwest has declined to do so.
Administrator Lawell reviewed an excerpt from the contract
documents lvorthwest Airlines executed with the Metropolitan
Airports Commission as part of the Northwest Airlines
Maintenance Base negotiations. The Commission reviewed some
provisions (within the contract) regarding aircraft noise.
Administrator Lawell stated he would contact Steve Cramer, MAC
Commissioner, to discuss how more provisions could be enforced
regarding the phase out of Stage II aircraft.
DISCIISS INFORMATION RLLAT£D TO AIRCRAFT
ENGINF RUNUP PROCLDIIRES AT MSP
Administrator Lawell explained that a resident had complained
regarding aircraft noise caused by engine runup at MSP. He
explained that after listening to the description of the
complaint, it appeared that what the resident was really
concerned about was the "back noise" which causes persistent
rumble when aircraft land towards and takeoff over South
Minneapolis.
The Commission briefly discussed a MAC document entitled
"Field Rulea Aircraft Engine Run-Up Procedures".
In response to a queation from Chair Beaty, Commissioner
Fitzer there is a fair amount of noise generated when an
aircraft's engine reverses.
Commissioner Olin stated that the MAC's Air Noise Complaint
Line is answered with an automatic answering device. He
stated it would be worthwhile to keep calling the hotline to
complain about the noise.
Chair Beaty stated the run-ups are suppose to be conducted
between the hours of 6:00 A.M. and 11:00 P.M. Commissioner
Fitzer stated there are different types of run-ups such as
full power checks and EPR (Engine Press Ratio).

Chair Beaty explained that the Commission had directed staff,
in April, to research the process to purchase and'distribute
magnets throughout the City which would inform City residents
on how to register their air noise complaintsl with the
Metropolitan Airports Commission Air Noise Complaiit Line.
Chair Beaty inquired if the City has the ability to separate
the mailings by zip code thereby targeting areas whi�ch receive
significant amounts of air noise. Administrator Lawell
responded that the City mails its newsletters by zi.p code and
postal route which includes all households and business
addresses. He stated staff would determine the process and
extent of distribution throughout the community. i
Chair Beaty stated he would like a letter sent with the
magnets explained the City's fight against air noiie.

Commissioner Olsen moved to direct staff to determine the
style, color, quantity, advertisement logo and distribution of
refrigerator magneta appropriate to inform the residents on
how to register their complaints to the Metropolitan Airports
Commission regarding air noise.
Commissioner Stein seconded the motion. i
Chair Beaty suggested that samplea be made availalile at the
upcoming Joint City Council/Airport Relations Commission
workshop. He further stated he would work with staff on
determining a slogan for the ma.gneta. i
Commissioner Olin stated the MAC Air Noise Complaint Hotline
number should be announced during regular City Council
meetings. II

would be present for the workshop. Commissioner Stein stated
he may have a conflict. ;�

ers will be two of the nation's foremost researchers in this field,

Air Force Base, OH and Sanford Fidell of BBN Systems and
Technologies, Canoga Park, CA. Together Finegold and
Fdell will discuss the findings of a recently completed Air
Force sbudy on sleep disturbance and will also bring us up to

The Federal Interagency Committea on Aviatio� Noise
(FICAI� rias chasen the 24th Annual Conference ofNOISE as
the venue for its 1994 public itearing, FTC'AN Chainnan
Thomas L• . Connor has announced.
Connor, who is manager of the Technical Division of FAA's
fl�ce af F.�vimnment and Energy, said the one-time aggor-
twuiry for gublic comment an FICAN's reseamh agentda will
be on Wednesday. July 27, in ihe auditorium of the Riehand B.
Russell Federal Building at 75 Spring Street in downtown
Atlanta. The hearing will begin at 9.OQ am. and is expected to
be an all-day affair. The Atianta date and locadon were chosen
by FICAN because they coincide with rhe NOISE conference
in Co2Iege Park, GA and it was thought that'conference
altendees might also be interested in the FICAN hearing, �
The NOISE conference begins that same Wednesday evening
with a 7 p.m. �ception at the Geoigia lntemational Conven-
don Center, hosted by the spansoring community, the City of
Callege Park. Two full days af conventian events follaw an

REAUTHORIZATION BILL
The Senate and F%use of Repnesen �tat�'ves have passed differ-
ent versions of a bill reauthorizing the FAA's Airport Im-
pmvement Pragram {AIP} for a 60-day period. Both versions
oftne measurewouid release $8Q0 millipn in grants far airport
capital grajects� which ha's been held up because the AiP
program expire;d last October, but the forrnulas fordistributing
the funds differ in the two bitls and efforts ta find a compromise
have so far failed, leaving the measu i stalled as this is writtea
� �.
The short-term measu� was offerad because House and Sen-
ate cauld not reconcile differences �over the issue af aidine
rates and chacges in a larger reauttwrization bill, Language in
the larger bill which would have created a new grant pragram
forlocalities wha engage in collabarative land use compatibil-
ity glann'rng with airports was not included in the short-term
Iegislatian. It is believed the provision will be �tained when
the larger bill is revived after the �expiration of ii� 6()-day
�period. ! �
The provision is supported by NOISE and the other members
of FAA's Land Use Compadbility Study Group. The land-use
panel met in Washington on Apnl 29 and agreed to wortc with
FAA oii'icials in drafting praposed �guidelines for implemen-
tation of the new pivgram, when and if it goes into effeci.

required .for the Part 150 Project area. They
began their duties on May 16, 1994.
Pham Express has extensive experience within the
Minneapolis - St. Paul area, including previous
management of over 350 single family homes �as
well as maintenance of apartment buildings.
Once the homeowner or tenant vacates the acquired
dwelling, the property management firm begins
their work. This includes the following:

At a recent meeting we discussed the desire ��to better
publicize the MAC Air Noise Complaint Line telephone number within
our communitye As a result, we decided to investigate the
feasibility and cost of having printed and distributed a small
refrigerator magnet to those residents most.impacted bylthe noise.

Since our last meeting staff has worked with Commission Chair
Beaty to finalize the wording and design of the ma.gnet.!� A mock up
of the magnet is attached. The order is currently at the printer
and hopefully the finished product will be avai�lable for
distribution in time for our upcoming joint workshop with the City
Council. ��

After the workshop we will then prepare a joint letter from
Mayor Mertensotto and Chair Beaty which will be sent out to
affected residents describing our efforts to combat air noise and
asking for their help in making use of the complaint line when they
are disturbed by air noise. ';�

Airport Relations Commisaioner Bill Healy and directed���staff to
advertise for a replacement commissioner. Ma.yor Merterisotto has
notified me that he has spoken with Ms. Cynthia Surrisi�, 1875
Warrior Drive, about the position and he feels she woul�d make an
excellent addition to the Commission. 'II
Ms. Surrisi indicates she is an attorney who specializes in
the area of aviation law. More specifically, she menti�,oned her
prima.ry area of focus was administrative and labor law:`
Currently she is employed as legal counsel to the Airline Pilots
Association. il

The City Council will consider Ms. Surrisi's appointment at
their meeting scheduled for June 7th. Unfortunately, due to
previously scheduled out of town meetings, Ms. Surrisi�will not
be able to attend the Commission's June 8th meeting ori�the
Council/Commission Workshop scheduled for June 16th. I�have
indicated to her that I will send her the packet materials for
each of these meetings and would welcome any comments or

As we have discussed in the past, the "airport issue" as a
whole is a multifaceted, everchanging beast which is difficult to
digest without breaking it down into its individual components.
Earlier in the life of the Commission we discussed these issues
through the use of various overheads, copies of which are attached.
This material can probably serve as a useful starting point in our
diacussion on June 8th. I�
