Mayor Huber called the meeting to order at 8:00 o'clock P.M. The follawing

MENDOTA PLAZA Mr. Dicic SheeYiy was present to discuss a solution
DRAINAGE to the problem of drainage from the Mendota Plaza
Shopping Center. City Admi.nistrator Johnson stated
that he has discussed with Mr. Sheehy some of the standards the City may want
as far as surface treating the water and screening floating debris, sand and
heavy debris from the drainage. Mr. Johnson stated that he had not yet seen the
proposed plans, but that the proposal would at least be a start towards making
improvements on one of the City's major waterways. I
Mr. Sheehy stated that he would propose installing 500 feet of 72" pipe in the
creek bed to carry the creek's water. He proposes to grade at the existing
parking lot grade and then go up to meet the road, placing�catch basins to catch
the runoff. He stated that this type of system could create a problem if
sedimentation and debris from the lot flow into the pipe, causing a hazard to the
normal flow of the water. Mr. Sheehy proposed that a screening device be placed
on the catch basin to catch debris so that it does not floi� into the stream.

Engineer Kishel suggested that a small settling pond with �an overflow structure
and a culvert structure of some type to catch any paper be constructed on the.
Plaza property. He strongly felt that the Minnesota Highw� y Departmenttshould
become involved in reviewing any proposal for this area.
Mayor Huber directed that Administrator Johnson and Engineer Kishel work with
Mr. Sheehy in the preparation of a proposed drainage plan.�
Councilman Lockwood arrived at 8:35 P.M.
NSP RATE INCREASE On the invitation of the Council, Mr. •Tom Connolly
of NSP was present to explain the proposed 15�
electric and 6� gas rate increase, which will become effee�ive on March 19.
He listed the three major reasons for the increase as: inflation; expenditures
necessary for pollution control equipment; and the energylirisis.

ment to your communiiy of the traditional Road 8� Bridge allocation of 35%
of the first 4.6 mi Is. You may recall that the disbursemenfi approved by the
County Board earlier was somewhat short of the full amount beca �se of complica-
tions arising out of the use of revenue-sharing monies to supplem�ent the Road

think this is a very valid suggestion because the League said its first
actian �o be taken upon passage �f the utility regulation bill�lwould be
to hire an expert to provide the municipaiities with a man capable of
presenting their case before the Public ServiceYCommission. �
You mention the St. Paul problem with the Narthern States Powe�^ Company.
You may nat be aware a#' it, but I have been told that shauld this biil
pass, the citizens of St. Paul would lose approximately $7 mi1lion.
As you state, Minneapolis would like io be in exactly the same�position
as 5t. Paul and so is not asking far utility regulatian. j
I have made one further suggestion to the authors af ihe bili and
that is should the bill pass, instead of having the present Public
Service Cammission adm�nister ihe pravisions it shouid be done�by ihe
Energy Agency which is being set up under another bill ta regu ate
energy in tFte state. This wau3d seer� to be the mare iogical a�thority
and at 1east wou1d have the benefit of perhaps mare capab1e people.

I am placed in a dilemma because I have been requested
by Commissioner Leo Murphy and other Dakota County
Commissioners to support legislation authored by Rober�t
Pavlak concerning the Dakota County road bondirig program.
The other communities do support this bonding program.

I do, however, agree with your resolution tha.t'Ithe highway
building plan be discussed with all• municipalities, and
hopefully this issue could be reso�ved. I am riot in favor
of jamming anything down any community's throat. I under-
stand that discussions will be taking place between vari-
ous communities concerning a new study and that a master
plan or program will be adopted. I would appreciate hear-
ing the results of �these meetings, because I want to be
fair to each of the communities that I represeiit.
If it is advisable that I appear before the village
courrcil to hear your views, please contact me as I would
appreciate the opportunity to obtain more of tlie facts.

MENDOTA PLAZA Administrator Johnson presented preliminary plans for
DRAINAGE IMPROVEMENTS �he piping af the ditc'si north of�the Plaza. H�

Sheehy Construction Company to install piping and fil]. the�area in order to
obtain additional land for commercial structures. He note that Engineer Ki.shel ,
has contacted the Highway Departm�nt relativ� to the pipinq and the construction
of a ponding area. Administrator Sahnson noted that the r'�ghts of a lancl owner
to develop property are acknowledged, however, Mendota Hei�hts official� will
exart considerable efforts to insure complete and adequate�lenvi.ronmental treatment.

I have taken the time to review Ed's drawings on Mari'e Avenue.
In order to expedite the plan preparation, I would suggest� that the
Council give Ed final directions on the Marie Avenue plans.
If you will look at the plans, you will see that movi�g the road
to the north of the center line will do several things. First, it
will alleviate a couple of driveway problems. Second, parking on the
south will give additional privacy to those homes on the s�outh side �
and will leave the north side of the street as the no parlc�ing side. If
at some future date a pedestrian way is to be developed, the Council at
that time will not have to consider not only taking the privacy of the
people on the south side with parking but also imposing a, additional
lack of privacy via a pedestrian way. Third, if the decis�ion at this
time would be to construct the street in the middle of the right-of-way,
and if then at some future date a decision should be made�i�to install a
pedestrian way, it would be most difficult to ask those p ople who
already have parking on their side to bear the additionallburden of a
pedestrian way on their boulevard. It would also be equally unfair to
consider a pedestrian way near a curb that is next to an �a�ctive drivi�g
lane, as this would pose an unsafe condition for people walking or
riding on such a pedes�rian way. I
In my own mind I am convinced that this'is the logical thing to
do. I would appreciate this being a matter of record and�'that you
give Ed Kishel instructions if a concensus can be reached.

revealeci that the Diamond Jim's Supper Club and nearby bau��tique
shaps are naw con.necte8 ta our sewer system. I have eo��t cteci
Mr, John Thompson c�ncerning this additional 25Q foot fro�t lot
(which has its southern boundary at the rear of Diamand Jzm's
Supper Club) and he submitted the attached letter. His compu�ation
of $4,Q75 campares ta an earlier camputation by Ed Kishel��of $4,125.
The difierence appears to be the additiona2 25� sur�hargeion the t�unk
sewer a�sessment. j
I would recammend that the Attorney be directed to prepare a
supplemental agreement ta include this addi�ianal 250 foo� parcel.

It is with pleasure that we are responding to your request that we submit our
proposal for providing professional services for the study of spa�tial require-
ments far community facilities in the City of Mendota Heighis. T}�e results of
the study would be presented in a written and graphic report designed to assist
the public and officials of the City in their planning toward the'�future hausing
of governmentai, municipat service, and other community facilities.
The study would be specifically concerned with determining the necessary floor
areas and cast af a structure or structures within a Civic Center��to house the
agencies fulfilling such municipal functians as the fallowing:
l. Legislatian: the Mayor and Cauncil, public hear'tngs; �1)
Z. Administrarion: the Administrator, planning and cleve�opment, financa,
code enforcement; .
3. Pubiic Works: engineering, parks and recreatian, streets�, utilities,
equipment storage and maintenance; �i
4. Public Safety: police, fire prevention and control, civi�l defence,
health, detentian, municipal court.
Educational and library facilities would not be covered by the study except as
pravisian for space reguired for any af their functions might be i�nciuded at the
Civic Center site or in a composi�e structure. �
Cansideration wauld be given, but not in detail unless further aut�horized, to the
possible space requirements if representatives or services of other 1eve3s of
gavernment were to be housed at the Civic Genter. A similar degree of consider-
ation wauld be given to the allocation ofP°space for puhlic assembly or exhibition

Our analysis of space requirements would be directed first, to ir�mediate or near,
future needs, and secondly, to ultimate needs for a population grown to the maxi-
mum reasonably to be expected within present land use developmen� or zoning
guidelines. �I �
We estimate that a study of the scope described would require fr�om three to five
months, depending to some extent upon the time required for reviews at the local
level; time of our staff, in several classifications, would amou�nt to about 50 man-
days in our estimation. �� �
We would devote our best effort and most knowledgeabte personnel,
and interpretation of tf�e study, and we would expect to operate
of�the fullest cooperation and interchange of information with t
and their staff. , �

We propose that we be engaged to perform these services on the basis that the City
pay us a multiple of two times our direct personnel expense, plus certain reim-
bursable expenses, with the understanding tf�at the total amount�payable to us�,
exclusive of the reimbursable expenses, shall not exceed eight t�iousand five hund-
red dollars ($8,500.00). A Form of Agreement whicFi defines direct personnel
expense (Article 3) and reimbursa6le expenses (Article 4) is enclosed for your
review and consideration. We would 6e F�appy to enter into an ag�-eement with you
in this form, but we realize that discussion of its provisions or amplification
of them may be desired by you. For your use in analyzing our cost proposal we
are also enclosing a schedule of our current hourly rates, including the multi-
ple, applicable to each classification of our personnel. Sincejthese rates in-
clude the multiple, you wi11 understand tfiat they i�nclude the fringe benefits on
salaries, office overhead and profit. 'i

, of Mendota Heigf�ts we would be guided by an analysis of the experience of other
communities of similar size and characteristics, by study of the population
growth potential of the city, by consideration of-�recognized sta dards for the
� provision of various municipal services, and by a concern for tfie necessary fis-
� cal limitations'. Where the size or the provision at all of certain facilities
� would be optionat, our report would so note and the options and,their probable
, costs would be outlined. Similarly, where space for certain fac`ilities might be
` built in two or more stages to accommodate a growing population�or level of ser-
� vice, this would be detailed. The report, in its final form would be designed
to provide, after official review and determination of priorities, the space in-
' formation and definition of functional relationships that the City would need to
define the scope and provide the program for the architect selected to design a
Civic Center or municipal building. �I

WI�REAS, copies of a Dakota County thoroughfare plan�have been
distributed to Dakota County Legislators; and
WHEREAS, such thoroughfare plan document has not been submitted
to Mendota Heights officials for review; and
WHEREAS, the facts and conditions as�set forth in Mendota Heights
Resolution Number 74-21, adopted on February 19, 1974, still are �
valid and unchanged; and �
WF�REAS, the legislative copy appeared to be a very hurriedly
assembled and incomplete draft of a final document; and '�

WHEREAS, a cursory review of a legislative copy of said plan
indicates a number of opinions and conclusions that need clarification
and elaboration;
NOW THEREFORE BE IT RESOLVED that the City Council of the City
of Mendota Heights hereby urges the legislature to withhold authority
for bonding until said plan has been broadly distributed, discussed
with all interested groups and adopted by unanimous vote of the Board
of County Commissioners; and '
BE IT FURTHER RESOLVED that copies of this resolution be forwarded
to all Dakota County Legislators and the Dakota County Boaid of

Our analysis�of space requirements would be directed first, to immediate or near
future needs, and secondly, to ultimate needs for a population grown to the maxi-
mum reasonably to be expected within present land use development or zoning
guidelines. .
We estimate that a study of the scope described would require from three to five
� months, depending to some extent upon the time required for reviews at the local
, level; time of our staff, in several classifications, would amount to about 50 man-
, days in our estimation. �
�� We would devote our best effort and most knowledgeable personnel to the direction
� . and interpretation of tf�e study, and we would expect to operate in an atmosphere
� of.the fullest cooperation and interchange of information with the City officials
' and their staff.
. We propose that we be engaged to perform these services on the basis that the City
' pay us a multiple of two times our direct personnel expense, ptus certain reim-
, bursable expenses, with the understanding that the total amount payable to us„
exclusive of the reimbursable expenses, shall not exceed eight thousand five hund-
red dollars ($8,500.00). A Form of Agreement whicfi defines direct personnel
; expense (Article 3) and reimbursa6le expenses (Article 4) is enclosed for your
review and consideration. We would 6e fiappy to enter into an agreement with you
� in this form, but we realize tfiat discussion of its provisions or amplification
of them may be desired by you. For your use in analyzing our cost proposal we
, are also enclosing a schedule of our current hourly rates, including the multi-
� ple, applicable to each classification of our personnel. Since these rates in-
� cl ude the mu 1 t i p 1 e, you ►�ri 1 1 unders�tand tfiat they i�ncl ude the f r i nge benef i ts on
salaries, office over�iead and profit.

(n assessing the requirements for housing the community facilities and services
` of Mendota Heigf�ts we would be guided by an analysis of the experience of other
communities of similar size and characteristics, by study of the population
growth potential of the city, by consideration of-�recognized standards for the
• provision of various municipal services, and by a concern for tfie necessary fis-
� cal limitations'. Where the size or the provision at all of certain facilities
, would be optional, our report would so note and the options and their probable
costs woutd be outlined. Similarly, where space for certain facilities might be
built in two or more stages to accommodate a growing population or level of ser-
vice, this would be detailed. The report, in its final form would be designed
to provide, after official review and determination of priorities, the space in-
' formation and definition of functional relationships that the City would need to
' define the scope and provide the program for the architect selected to design a
Civic Center or municipal building.

RESOLUT�ON NO.
RESOLUTION URGING LEGISLATORS TO WITHHOLD
AUTHORITY FOR DAKOTA COUNTY ROAD BONDING
Wi�REAS, copies of a Dakota County thoroughfare plan have been
distributed to Dakota County Legislators; and
WHEREAS, such thoroughfare plan document has not been submitted
to Mendota Heights officials for review; and
WHEREAS, the facts and conditions as�set forth in Mendota Heights
Resolution Number 74-21, adopted on February 19, 1974, still are �
valid an� unchanged; and �
WF�REAS, the legislative copy appeared to be a very hurriedly
assembled and incomplete draft of a final document; and
WHEREAS, a cursory review of a legislative copy of said plan _
indicates a number of opinions and conclusions that need clarification
and elaboration;
, NOW THEREFORE BE IT RESOLVED that the City Council of the City
of Mendota Heights hereby urges the legislature to withhold authority
for bonding until said plan has been broadly distributed, discussed
with all interested groups and adopted by unanimous vote of the Board
of Count�y Commissioners; and '
BE iIT FURTHER RESOLVED that copies of this resolution be forwarded
to all Dakota County Legislators and the Dakota County Board of
Commissi,oners.
