Pursuant to due call and notice thereof, the City Coun
of Mendota Heights, held its annual Board of Review me

The meeting was called to order by Acting Mayor Lockwood at 8:00
o'clock P.M. The following members were present: Acting Mayor
Lockwood, Councilmen Gutzmer, Wahl, and Losleben. Mayor Huber
had notified the Council that he would be unable to attend.
The Dakota County Assessor's Office was represented byl�Assessor
John O'Toole and two assistant assessors. The County �}.ssessor's
records were opened for general review for the residents of the'
City. ��

Minutes of the Regular Meeting
Held Tuesday, June 17, 1975
Pursuant to due call and notice thereof, the regular meeting of the City Council,
City of Mendota Heights, was held at 8:00 o'clock P.M. at the City Hall,
750 South Plaza Drive, Mendota Heights, Minnesota. 'i
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Gutzmer, Loslebe�� and Wahl.

Approval of the minutes was tabled until �uly 1, 1975,
due to equipment breakdown and delay of t e submittal of the
minutes to the Council. �
FURIANG AVENUE Mayor Huber opened the meeting for the pu�pose of the
AREA IMPROVEMENTS continuation of a feasibility hearing on �roposed sanitary
sewer and water improvements to serve the�Furlong Area.

Mr. Bernard Biessener, 1309 Furlong Avenu� stated that he
hopes for feasibility approval and accept� ce of the project.
Several unrecognized members of the audie'ce participated
in the discussion and questions were aske� on assessments
regarding what would be considered useabl� and non-useable
property and the possibility of special a'justments on such
property. �

Administrator Johnson s�ated that the MAC��property would benefit
from the water improvements, and that the�cost for watermain
construction would be distributed amongstithe benefitting
property owners. He further stated that � determination
will be made at a later date regarding wh�t should and should

CLEMENT/VANDALL Mr. Jere Logan, representing the residents! in the proposed

proposal by Bettenburg dated May 14, 1975�

City offices on June 17, 1975. Mayor Huber thanked Mr. Logan
for his presentation. I
Mr. Fred Metcalfe, 1355 Clement Street, st ted that the
residents of Somerset, as direct recipient of the storm sewer
drainage from Clement/Vandall improvements, wish to go on
record regarding their concern of the wate drainage problem.
The Council informed the Council that a de ision on the propos
improvements would be made on July 15. �

residents requesting the re-establishment' of the pond in the
valley between T.H. 110 and Marse Avenue.
Mr. Harvey Bream was present to discuss a�letter submitted
by the City Administrator to Mrs. Ruth Rossetter and Mr. Bream
regarding a sign violation. The letter in�icated that the
advertising sign located on Mrs. Rossetter�s property across
from Diamond Jim's is not in conformance with the Zoning
Ordinance. 1

Mr. Bream asked the Council for a special�permit or variance
on a temporary basis, stating that he has'a contract with
the Rossetter Realty Company for a six-month period, which
began May 1, 1975, and that he feels the s�ign is invalua.ble
to the sale of the Eagle Ridge condominiums. The Council
pointed out that the Zoning Ordinance does� not allow a variance
in this instance, and the acting City Attorney stated that
the sign is in violation of the ordinance�and'to allow it
would be setting a precedent. II

monthly report for May, 1975 and the Fire �i partment monthly

CETA Administrator Johnson stated that the City will be provided
with three employees through the CETA prog am for part of the
summer. He explained that the program will lasL for ten weeks,
32 hours per week per employee, at a salary of $2.10 per hour.

HIGHWAY STUDY The Council acknowledged receipt of a pro�osal from
' Planning Consultant Dahlgren for the preparation of a highway
study for Mendota Heights. The study is �roposed to take
approximately 6 months to complete, at a cost of $3,000.
Mayor Huber pointed out that such a study is a necessity and
would enable the City officials to take a�firm stand on
future highway construction.
After discussing the proposal, the Council directed Mr. Dahl
to submit a more detailed proposal for coisideration at a
later date.
LEXINGTON HIGHLAND Administrator Johnson stated that the Developers Agreements
EAST AND WEST for Lexington Highland East and West have been executed by
Mr. Kopp and Mr. Gearman and submitted to the City offices
for Council approval. Mr. 3ohnson outlined the agreements
for the Council. ���
After a brief discussion, Councilman Gutz'er moved that the

Agreements for Leaington Highland East anll West.

SPACE STUDY Administrator Johnson stated that the cos� for the preparation
of the Space Study overran the original c�st estimate and
outlined the new figures. After a brief iscussion, the
Council directed the P.dministrator to neg�tiate with
Mrs. Earbara LukerR;ar�n on the additional � osts; the
new billing is not acceptable.

City Council's position with respect to the county road system
defined in the Council's resolution following initial hearings;

to the County Engineer and the Board Chairman for the adjustm nts made,

cooperation with the County (now that they have come up with� more
realistic plan as it affects the City of Mendota Heights). T e previous
plan indicated the acceptance of a total of 3.27 miles of cou ty road
(Mendota Heights Road), and the dropping of 7.85 miles as follows:

Requirement
1. The Lapakko's own Lots 31, 32, 33, and 34 of Linden Ad ition as shown
on the sketch at the left. A portion of lot 34 was acquired by the
State Highway Department to provide additional right-oII-way for the
eventual rebuilding and reconstruction of Trunk Highwaj� 49 thru this
part of the City. You are all familiar with the fact t!hat the High-
way Department purchased substantial right-of-way for t�he redevelop-
-ment of Highway 49 from what was then Highway 100 south� to the south
limits of this City. This right-of-way was purchased b the Highway
Dapartment in the early 50's when the Friendly Hills area was being
platted. '��
2. The lots in question which are currenily occupied by a�
single family house which is located on Lot 32, as ori
and occupied by Alanzo Houser who is a nationally known

The problem of locating an accessory garage in a rear 'ard when the
lat is as smaii as this ane is of caurse, extreme. Ir��many cases
in this part af the City variances have been granted so as to
accomadate a reasonable so7ut9on to the development of,�such a
garage on the sma11 iots that are in existance in this part�af the
City. In. general, in the past, the City has encouraged the
develapment of garages'an these properties. It is simply a �
matter of locating them in a way so as to make them funtionally
usable wi�hout creating undue deleterious effects on contiguous '
properties. We have suggested ta r�fr. Wederbrand ihat it�would
be important to have written consent from the contiguous
propet�y ar�mers affected io the �rear and to his west_ si de. We �
suggest that �t would_be helpful to have these fo7ks attend the
Planning Commission meeting so as to ailaw the Commissian and �he
Council ta discuss the relationship between the proposed variances

4. It would a pear that the proposed location is a reasonable one
assuming the nei`ghbors agree that their properties are riot
adversely affected. A copy of the proposed layout is.attached
to this report for your consideration. ;,I •
5. Mr. Wedebrand did note that he has�constructed a fence along his
west property line which confines the neighbors driveway, to a
very narrow nine foot width between the fence and his house. We
suggested that one solution might be for the two neighbors to
develop a joint driveway within the 25 foot distance between the
houses. It would appear that this would offer a better'�Isolution
for both parties if it can be accomodated in terms of giade and
tFe appropriate legal arrangements. •

site in the shopping center, and propose to open in the1�nonih of
July.They propose ta place cut out letters on the narth'side of the •
building four feet high, on a panel approximate3y 96 feet long
partraying the words "Country Ciub Market". This l�ocati�on is the
same as the sign that formerly read "Red Ow]".. In BdCIi"�i14C1� they
prapose to pui �he words "Country Ciub Mkt." on the shor�i partion
of the supermarket building that faces westerly. These��letters are
proposed ta be two feet high an a panei approximately 15�feet�iong.
In addition, they propose 96 square faot sign to Ee adde�d to the
existin9 PY3on sign that now exists near Highway 110. ;�

6. The key question in our opinion is what size letter is appropriate to

It would be helpful if each member of the Planning Commi�ssion and
Council were to view the site particularly as it relates to Highway 110'

7. If the letters were two feet in height, the length of t'e sign would
likely be in the vicinity of 50 feet. This would of co�rse, conform
to -ine 100 foot maximum.stated in the ordinance. It wo ld appear
�that the sign size proposed, that of four feet in height, may well
not be necessary to achieve the objective of being resonably seen
from Highway 110. You wi17 note that the signs on the other stores
in the center are considerably smaller none of which appear to even
apprc?:h the 100 square foot maximum provided. We suggest that the

the police chief and by the sergeant as time permits. Fire Marshall
duties are performed by the volunteer firemen on a volunteer basis. I am
recommending that we establish a position that will respond to the needs
of both areas by a full-time person performing both detective'land fire
marshall duties. I am attaching a job description of this gos�ition for
your consideration.

Minutes of the Regular Meeting
Held Tuesday, June 17, 1975
Pursuant to due call and notice thereof, the regular meeting of the City Council,
City of Mendota Heights, was held at 8:00 o'clock P.M. at the City Hall,
750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Gutzmer, Losleben and Wahl.
Councilman Lockwood had notified the Council that he would be absent.
APPROVE Approval of the minutes was tabled until July 1, 1975,
MINUTES due to equipment breakdown and delay of the submittal of the
minutes to the Council.
FURLONG AVENUE Mayor Huber opened the meeting for the purpose of the
AREA IMPROVEMENTS continuation of a feasibility hearing on proposed sanitary
sewer and water improvements to serve the Furlong Area.
Mayor Huber asked for questions and comments from the audience.
Mr. Bernard Biessener, 1309 Furlong Avenue,. stated that he
hopes for feasibility approval and acceptance of the project.
Several unrecognized members of the audience participated
in the discussion and questions were asked on assessments
regarding what would be considered useable and non -useable
property and the possibility of special adjustments on such
property.
Administrator Johnson stated that the MAC property would benefit
from the water improvements, and that the cost for watermain
construction would be distributed amongst the benefitting
property owners. He further stated that a determination
will be made at a later date regarding what should and should
not be considered useable property and the associated assessments.
Mr. Clarence Krueger, 1015 MacArthur Avenue, stated that he
is in favor of the project, but that the current building
moratorium has created a problem. He purchased a house in the
f MAC area in 1973, and has a lot in the proposed project area
for the home to be moved upon, but he cannot meet the deadline
of July 1 given to him by the MAC for moving the house because
of the moratorium. Mayor Huber stated that the City would
assist Mr. Krueger in his request for more time from MAC.
There being no further questions or comments, Mayor Huber
moved that the hearing be closed.
Councilman Gutzmer seconded the motion.

CLEMENT/VANDALL Mr. Jere Logan, representing the residents in the proposed
AREA PROPOSED improvement area, addressed himself to the Council in affirming

latest proposal as follows:
24 foot wide streets on Upper Clement, 1st Avenue, 2nd Avenue,
3rd Avenue, 4th Avenue, Clement from 2nd to 3rd Avenues,
Vandall from 3rd to 4th Avenues;
18 foot wide streets in all other areas;
curbs only at corners;
storm sewers essentially as in the "country style" street
proposal by Bettenburg dated May 14, 1975.
The petition and sketch of this proposal was received in the
City offices on June 17, 1975. Mayor Huber thanked Mr. Logan
for his presentation.
Mr. Fred Metcalfe, 1355 Clement Street, stated that the
residents of Somerset, as direct recipients of the storm sewer
drainage from Clement/Vandall improvements, wish to go on
record regarding their concern of the water drainage problem.
The Council informed the Council that a decision on the proposed
improvements would be made on July 15.
COMMUNICATIONS The Council acknowledged receipt of a letter from Miles Bredvold,
1281 Lakeview Avenue, regarding proposed Furlong area
improvements. The Council also acknowledged receipt of letters
from Mr. & Mrs. Vern Richgels, 1310 Kendon Lane, Frances Richgels,:
1309 Kendon Lane, and Mr. & Mrs. Hollis Huebner, 1305 Kendon
Lane, regarding proposed Furlong area improvements.
The Council acknowledged receipt of a letter from Phillip Fournier
1306 Kendon Lane, regarding proposed Furlong area improvements.
The Council acknowledged receipt of a letter from the Dakota
County Highway Department regarding a meeting to be held on
June 19 on the County Highway System Plan and the 5 -year
County highway system construction program. Administrator
Orvil Johnson stated that Howard Dahlgren was planning to
attend the meeting. Councilman Gutzmer and Planning Commission
Chairwoman Ridder also stated that they would attend themeeting.
The Council acknowledged receipt of a petition from several
residents requesting the re-establishment of the pond in the
valley between T.H. 110 and Marie Avenue.
SIGN VIOLATION Mr. Harvey Bream was present to discuss a letter submitted
by the.City Administrator to Mrs. Ruth Rossetter and Mr. Bream
regarding a sign violation. The letter indicated that the
advertising sign located on Mrs. Rossetter's property across
from Diamond Jim's is not in conformance with the zoning
Ordinance.

Mr. Bream asked the Council for a special permit or variance
on a temporary basis, stating that he has a contract with
the Rossetter Realty Company for a six-month period, which
began May 1, 1975, and that he feels the sign is invaluable
to the sale of the Eagle Ridge condominiums. The Council
pointed out that the Zoning Ordinance does not allow a variance
in this instance, and the acting City Attorney stated that
the sign is in violation of the ordinance and'to allow it
would be setting a precedent.
Mr. Bream stated that he will research the Ordinances of
surrounding communities to find out what their regulations
are concerning this type of advertising sign.
MARIE PARK POND City Engineer Kishel stated that because of the potential
surface water developing in the Marie Park there is much
concern over the capacity of a holding pond in the park.
He stated that it is necessary to take immediate steps to
control the water level in the pond. He further stated that
it is questionable whether the Burow pond could be a complete
holding pond for the area, as he does not feel it would be
effective enough, but that perhaps the park pond and the Burow
pond should be interconnected. Mr. Kishel outlined two schemes
for surface water control and the associated cost.
After considerable discussion, Mayor Huber moved that the
Engineer be authorized to prepare a change order in the
Fischer Construction Company contract (improvement No. 73,
Project No. 2) to include construction of force mains for
the Marie Park pond.

prepare a change in the Kopp/Gearman plans and.specifications
to include construction of a lift station and the balance of
the force main construction for the Marie Park pond.

PARK COMMISSION The Council acknowledged receipt of the May 28 Park and
Recreation Commission meeting. There was some discussion
regarding the acquisition of property to provide park facilities
for the Curley Valley View area.
DEPARTMENT The Council acknowledged receipt of the Police Department
REPORTS monthly report for May, 1975 and the Fire Department monthly
report for May, 1975.
CETA Administrator Johnson stated that the City will be provided
with three employees through the CETA program for part of the
summer. He explained that the program will last for ten weeks,
32 hours per week per employee, at a salary of $2.10 per hour.
The program is funded through the CETA program.

HIGHWAY STUDY The Council acknowledged receipt of a proposal from
Planning Consultant Dahlgren for the preparation of a highway
study for Mendota Heights. The study is proposed to take
approximately 6 months to complete, at a cost of $3,000.
Mayor Huber pointed out that such a study is a necessity and
would enable the City officials to take a firm stand on
future highway construction.
After discussing the proposal, the Council directed Mr. Dahlgren
to submit a more detailed proposal for consideration at a
later date.
LEXINGTON HIGHLAND Administrator Johnson stated that the Developers Agreements
EAST AND WEST for Lexington Highland East and West have been executed by
Mr. Kopp and Mr. Gearman and submitted to the City offices
for Council approval. Mr. Johnson outlined the agreements
for the Council.
After a brief discussion, Councilman Gutzmer moved that the
Mayor and Administrator be authorized to execute the Developers
Agreements for Lexington Highland East and West.

SPACE STUDY Administrator Johnson stated that the cost for the preparation
of the Space Study overran the original cost estimate and
outlined the new figures. After a brief discussion, the
Council directed the Administrator to negotiate with

new billing is not acceptable.
CHERRY HILLS SECOND Engineer Kishel submitted to the Council a feasibility report
ADDITION on proposed Cherry Hills Second Addition improvements.
After a brief discussion, Mayor Huber moved the adoption of
Resolution No. 75-51, "RESOLUTION ACCEPTING ENGINEER'S REPORT
AND CALLING FOR HEARING ON PROPOSED CONSTRUCTION OF STREET AND
STORM SEWER IMPROVEMENTS TO SERVE THE CHERRY HILLS SECOND

Gentlemen:
Per my discussion with the Village Manager, I am hereby requesting
your consideration for utilities and streets for my Ivy Falls West
Addition plat. My surveyors are proceeding with hard shells and we
have received preliminary engineering approval from your Village
Engineer.
I would like to get at least some of the streets and utilities in
this year, so I would appreciate anything you could do to expedite
this matter.

5. As you know, the lot size requirements in the City are 15,000
square feet of land and 100 feet of frontage ( measured at the
building line). Because of the diagonal shape of the taking, Lot
34 now has 117 feet of width at the rear and 52.67 feet at.the
front. The lot is 220 feet deep and therefore has a lot area of
18,700 square feet. At the building line(30 feet back from the
street) the lot has a frontage of approximately 63 feet.
6.• The Lapakko house (on Lot 32) however, is set back 120 feet from
the.right-of-way. The frame structure formerly used as a pottery
located on Lot 31 is set back approximately 95 feet.
7. One solution would be to allow the variance to the 52.67 feet of
frontage and determine the lot to be a buildable one, on the
condition that any future residence. be set back a minimum of say
90 feet from the frontage street* At this point the lot at
the front of the home would be 86 feet. This width -exceeds the
minimum 70 foot required for existing lots (to be a buildable
lot) by 10 feet.
8. As you know, the ordinance states that if an existing lot comes
within 70 percent of the minimum requirements for frontage and
lot area, it is deemed a buildable --lot. Thus, if this lot had
70 feet of frontage as measured at the building line it would in
fact constitute a buildable lot without Planning Commission or
Council action.

Yard Requirements
PLANNING CONSIDERATIONS:
1. Mr. Wedebrand is seeking permission to construct a 24 foot by 24
foot garage in his rear yard to be located three feet from the
side lot line and ten feet from the rear lot line. The ordinance
requires that in such an accessory building built in a rear yard
shall be a minimum of five feet from the side lot line and 30 feet
from the rear lot line.
2. The attached drawing shows the conditions relevant to the property
in question and the contiguous properties on either side. The
lot in question has a frontage of 42 feet and the house is located
14 feet from - the westerly lot line. The contiguous house is
located nine.feet from the line. Mr. Wederbrand proposes to construct
a driveway within the 14 foot.set-back on the west side of the
house to a new garage structure to be placed 26 feet from the rear
of the existing home.
3. The problem of locating an accessory garage in a rear yard when the
lot is as small as this one is of course, extreme. In many cases
in this part of the City variances have been granted so as to
accomodate a reasonable solution to the development of such a
garage on the small lots that are in existance in this part'of the
City. In. general, in the past, the City has encouraged the
development of garages*on these properties. It is simply a
matter of locating them in a way so as to make them funtionally
usable without creating undue deleterious effects on contiguous
properties. We have suggested to Mr. Wederbrand that it -would
be important to have written consent from the contiguous
property owners affected to the -rear and to his west -side. We
suggest that it would.be helpful to have these folks attend the
Planning Commission meeting so as to allow the Commission and the
Council to discuss the relationship between the proposed variances
and their properties.

4. It would appear that the proposed location is a reasonable one
assuming the nei-ghbors agree that their properties are not
adversely affected. A copy of the proposed layout is -attached
to this report for your consideration.
5. Mr. Wedebrand did note that he has•constructed a fence along his
west property line which confines the neighbors driveway to a
very narrow nine foot width between the fence and his house. We
suggested that one solution might be for the two neighbors to
develop a joint driveway within the 25 foot distance between the
houses. It would appear that this would offer a better solution
for both parties if it can be accomodated in terms of grade and
the appropriate legal arrangements.
