Held Tuesday, July 11, 1972
Pursuant to due call and notice thereof, the regular meeting of the
Uillage Council, Uillage of inendota Heights; was held at 8:00 o'elock
P.m. at the Uillage Ha.11, 2010 South Lexington Aven�e, Saint Paul,
minnesota. ,�
mayor Huber called t�ie meeting to order at 8:00 o'clock P.m. The
fqllowing members were present: mayor Huber, Councilmen Lockwood,
Wahl, Gutzmer and Blair. �
APPROUE Councilman Lockwood moved approval o the minutes

FURLONG mayor Huber opened the hearing for discussion of

STREET_ Improvements. Clerk—Treasurer Radabaugh read the
ImPR011EmENT list of four property owners to be assessed at a rate
of $2.864 per front foot for a total Icost of �2,228.�47.
mayor Huber asked if anyone was interested in looking at the I
assessment rolls. There was no further discussion.'
Councilman Lockwood moved that the hearing be closed. Councilman
Gutzmer seconded the motion.

mayor Huber stated that the assessments will be foruiarded to Hastings
in thirty days and that the property owners involved have thirty
days in which to pay their assessments in full without interest.
Councilman Lockwood moved to adopt Resolution Number� 497 approving
the assessment roll. Councilman Wahl seconded the rnotion.

on top of the sign, a light st�ndard will be placed near the sign.
The roof—top air conditioner will be enclosed on all four sides
by a verticle redwood enclosure.

ROGERS mayor Hub�r read letters of objection�to street,
LAKESIDE storm sewer and sewer and water impro ements from
EAST John Lapakko, Eugene Olson, Bill Sime�, and a joint
ImPROVEmENTS objection from six other property ownirs.
mayor Huber stated that only a decision on whether o'ir not to order
in the project would be made at this meeting. He fu��rther stated that
at such time as the project is �ompleted, �n as�essment hearing w�ll
be held for discussion of how the assessments wi,ll be distributed.�
mr. John Lapakko asked how wide Cheri Lane will he. mr, Kishel
answered that it will be a 60 foot street and that tlhe street will go
down the center of the right of way.
Councilman Wahl ask�d why the Uillage has not maintalined Cheri Lane.
mayor H�ber replied that with the exception of snowp�lowing, the
Uillage does not maintain any streets that do not me�et Uillage
standards. ��
mayor Huber moved approval of Resolution Number 498 authorizing the
Engineer �o prepare final plans and specifications f�or storm sewer,
sewer and water and street improvements in the Roger�s Lakeside East
Addition. Councilman Lockwood seconded the motion.�

ENDRESEN — mayor Huber read the minutes of the Jiune 28 Planning
PLANNING CPmmission in which �he Planning Commission recommendec
COmmISSION denial of mr. Endresen's application for a property
CASE #72-8 split at 615 Ivy Falls Avenue. The l,ot to be divided
off would be an 85 foot lot. All oflthe surrounding
lots are 1�0 foot or 110 foot lots.
mayor Huber moved denial of the application for a d'vision of
property on the recommendation of the Planning Comm'ssion without
recourse and to waive the six months requirement fo re—app�ication.
Councilman Gutzmer seconded the motion.

Attorney General's opinion on the inclusion of donated park land in
calculating density figures. He also stated that the developers were
in effect giving the Uillage nothing by donating the 18 acres, since
there are �24,000 in pending assessments on the parcel.

DRAINAGE. Orvil Johnson stated that interviews had been held with
CONSULTANT Eugene Hickok and Associates and Itaska Engineering
relative to doing a drainage study forlthe Lassao II
property. mr. Johnson recommended that Hickok and Associates be hired
to do this pilot study and �hat the fee for their seriices would be a
minimum of $1,500 and a maximum of $1,800.
mr. Kevin Howe requested an early review of the four 6uilding sites
in Somerset II and was assured of an early re'view.
mayor Huber made a motion to authorize the Uillage off icials to sign
the necessary papers hiring Eugene Hickok and Associates to do the
pilot drainage study for a fee not to exceed $1,800.�ICouncilman
Lockwood seconded the motion.

BRACKEY — mr. Robert Brackey requested an extension of sewer

mr. Brackey to hook up to the system, he will have to get permission
from the Highway Department to go over Highway 13 and he will have to
make arrangements to get the St. Paul Water DepartmenI�t to connect the
main to the water line at his own cost. mr. Kishel sUggested that
the hook—up charge be $2,317.00. I
Councilman Lockwood moved that the Council grant perm ssion to
mr. Brackey to hook up to the Uillage sewer and water�system at a
cost of $2,317, and that such hook—up shall be grante�d only subject
to proof that a single family dwelling shall be built on the property.

of the Open Space Project Selection System for your information.
In deciding whether you wish to resubmit the application for Fiscal
Year 1973 consideration, please keep the following facts in mind:
1) The project selection criteria rate, not only the{quality of
the open space to be provided, but also such items as the financial
need of the community, the efforts of the community to expand its
'� supply of low and moderate income housing, and the provision or
proposal of minority employment opportunities.

Television Advisory Committee . I

who have been selected to serve on this committee and assist the Nletropolitan
Council. The committee is being called upon to make recommendations concerned
with the impact of cable television in the metropolitan area .

The effect of this vacation would be to eli'minate

tend to vacate. This property is now rather heavily wooded and

areas. I am anxious to retain this property in its undeveloped
state�for my own enjoyment and my family's, and I anticipate the
possibility of building a new home on it at some time in the
future.

The Villqge has been involved in community planning since the late 1950's and fhis area
has always been considered a part of the Acacia Park "neighborliood". Y,I ictory Avenue
is not the type of physical barrier which by itself divides two neig{iborhoOds. At fihe
present, there are too few peopl� in the area to afford the facilil-ies and services most
people expect. Coupled with this is the facfi thai- the neighborhood wilf �be left with
less chance of future development after MAC's acquisition. The noise pnoblem, tne
high cost of ufiilities and the "cloud" caused by HUD noise guide(ines wi�l combine to
effect future residential development. If the larger area is taken and rezoned industrial,
fihis will present another handicap to residential development north of Victory Avenue.
An industrial park across the street is not compatible to a residential com�munity, This
area has to fo(low with the larger ar�a in order to develop the entire neighborhood in a
p(anned, rational manner, creating a liveable urban environment. ,�

As you recall, Jim martin appeared before the Uillage
Council on June 20 to discuss additional platting �of cemetery
properties. At that meeting, he was advised to pu�t in current
form the details of platting matters that were imp�roperly
recorded in 1967.
I am enclosing a seven page summary in resp�nse to
the direction they received on June 20. The letter tells about
their activities and their alleged need for additi�onal
cemetery platting. I am enclosing a print of the Acacia Park
Cemetery and have indicated in red the location of the two
plats that were recorded in 1967.
This is a considerable increase in platted cemetery
land and I would advise the Council to weigh all e�vidence
for and against the need for such platting. I ant�icipate
that a representative will be present on the eightleenth
to further elaborate on this matter. I�

Acacia Park Cemetery is a public, non-pro'fit
cemetery consisting of approximately 78 acres. The original
cemetery of 60 acres was acquired in 1926. What is ]�nown as
The Acacia Park East Addition is approximately 15 acres in
size and was acquired between 1938 and 1�963. What is� known
as Acacia Park South Addition is a 2 1/2 acre parcel��of land
which was acquired in 1963. The Acacia Park Cemetery Association
holds no other property in Mendota Heights. : I

Approximately 57� of the gravesites available in
the original cemetery have been put into actual use,''while
approximately 52� of the remaining avaiiable gravesites have
already been soid. At present, there are approximately 9,280
interments in the original cemetery. There has been in average

which abuts on the east line of the present East Addi
(See attached Exhibit A, a letter dated November 6, 1
the District Engineer for the Department of Highways,
William Merritt�. I
At t�e present time, then, the future use
East Addition is�contingent upon the Highway De�artme
completion of its work on Highway 55. As soon as sai
relocation, and bridge work is completed and as soon
landscaping can then be accomplished on the E�st, Addi
is contemplated that the Associatio� woul go,forward
use of the property for burial purposes. �By rough ap
it is believed that the East Addition has capacity f
grave$ites. �
As is true of the East Addition, the Sout
has r�o�t yet been used for burial purposes. At presen
South Addition contains a single family residence alo
double garag� which is being occupied and used by the

plans for the future use of the South Add�tion may rec�uire
eventual alteration iri view of certain proceedings being
initiated by the Airports Commission having as their end
the condemnation of certain portions of the South Addition.
As presently drawn, the South Addition has the ultimate
capacity for 2,200 gravesites.
It is hoped that the foregoing will be sufficient
to give the Council a basis for granting its approval to the
plats which have been previously but improperly filed for
record with-::the Register of Deeds in Dakota County in 1967.
rnTe regret that we are unable to provide the Council with a
firm timetable concerning the future use of the additions
in question. Necessarily, the preparation of such a�ime-
table awaits the finalization of the Highway Denartment's
plans and work on the Highway 55 project. II

PROP�RTIES AND PROVIDING PENALTIES FOR
VIOLATION THEREOF
The ViJ.lage Council of the Village of Mendota Heights�''
follows: '
Section 1. For the proper identification of ali
structures within the Village, the official house or bi
which shall be obtained by the owner from the Building
