INVESTmENTS Councilman Gutzmer moved that t�e Uillage Council
� authorize the Clerk—Treasurer t�a invest $104,500
in savings certificates. Councilman Blair seconded the motion.

EQUIPmENT Acting mayor Lockwood acknowled��ed a memo from
PURCHASES the Uillage Administrato'r stati�g that informal
bids had been received for purc ases�of a plow
and undercarriage for Park equipment, and for f�ur radios.
. Acting mayor Lockwood moved that the bid of th� LaHass Corporati'on
for a plow and undercarriage be awarded in the amount of $872.00.
Councilman Gutzmer seconded the motion. No ac ion was taken on
. the motion.
Councilman Wahl stated that neither the Park e�uipment nor the
ra�lio purchase were recommendedito be awarded �o the lowest bidd
and felt that the bi�ds should be awarded to th lowest bidders.

the matter of the plow and undercarriage purchase be tabled unti

27830-A1, is located at the northeast corner of North Freeway Raac� and Sauth Lane

Attached is a drawing that we recentiy prepared in connection witFr a praposed
cul-de-sac for the narth end af I<nab Road which graphically showsi the conditions
as described by Mr. Garr. In our apinion, the north 50 or 60 fee of Lot 9 is
inundated by water and not useable as building property. What, eientually, will
happen to the pond or whether this portion af the lat wi13 ever b�� used for any-
thing other than ponding, we do nat know. Our position is that s� long as the
bulk of the lot is used as a building site we must assess the ent� re lot. There
are many cases in the Uillage where portians of assessed properti�s are not use-
able at present, but no one knows�what the future will bring. I
In the case of Mr. Garr's assessment, it was calculated as follow;�:
The north 30 feet of Lot 10 was assessed in full.• L.ot 9, being 1�0 feet lang
and 135•2 feet deep, was assessed on the narrower dimension, name y, 135•2 feet.
Even with this type af formula, some 30 feet mare or less of this frontage can
be considered to be under water naw.
Because of the fact that portions of many parcels of assessed praperty in the
Village can be considered undesirabte, we recommend that no change be made in
the assessment. �i

In establishing the assessments for this parcel, we assessed the frontage on South

Freeway Road plus all that part of the depth in excess of 150 feet, namely, 50
feet. We acknowledge that this jot cannot be divided but utilized the theory that
the deeper lot caused more than normal utility construction along the frontage �
road justifying the added 50 feet of assessment. ' ;�
We also acknowledged that a great amount of open street right-of'way on the west
side of the lot would preclude the ability to serve his lot from�that side. We,
therefore, omitted the usual 10 foot corner lot assessment in this particular case.

assessments to Lot 1, Block 2, Mortenson`s Addition we comment as follows:
As is.the case of Mr. George Hanson, across the street, we assessed the
short side of the lot along the Frontage Road plus ten (10)�feet around
the corner, as well as all that part of the side lot in excess of 150--f-eet.
It is our opinion that the side lot assessment is not necessarily based
on a possibility of deviding the lot into two buildable sites, but is

In response to a letter from George W. Hanson, 645 Highway 110, Lot 3, Block 1,
Mortenson Addition, Parcel 27359 regarding assessments as part of,lthe ab,ove pro-
ject, I comment as follows: ;
Based on our standard method of proceedure, we assessed the frontl100 feet plus
10 feet around the corner because it is a corner lot, and everyth;ng over 150
feet of lot depth. The contention by Mr. Hanson that the lot can`ot be divided
into two (2) buildable lots i•s correct, however, the theory of assessing all side
lot frontage in excess of 150 feet of depth does not limit itself,lto property
division. It is �ontended that large lots of this nature cause t'he need for con-
struction of added,length of utilities and should be partia�lly pa�d for by the
owners of these large lots. It is no different t�an assessing 20i or 300 feet of
frontage because of the width of a lot facing a utility.
It is our recommendation that no change be made in the assessment

In the process of reviewing the assessment.for Charles Garr, Lot � and the north
30 feet qf Lot 10, Gailand Heights Addition on I<nob Road, it occu�red to us that
an error had been inadvertenfi3y committed in the preporatian of the assessment
far the south 120 feet of Lot 10 owned by Kenneth Knowtton. .
Lot 10 was ariginally 150 feefi wide and 135.2 feet deep. We had prepared a pre-
liminary assessrnent ral] quite some time before Mr. Garr built on Lot 9 and used
the narrow width of the tot, namely, 135•2 feet as the assessable wid�h. When
the north 30 feet of Lot 9 was transferred to Njr. Garr, one of our office per-
sonnel subtracted 30 feet fram the l35•� feet leaving i05.2 feet as the assess-
able frontage on paper. This is how the roll was finally calculated and published.
Now we find that the south �20 feet of Lot 10 is actually 12Q feell by 135.2 feet
in dimerrsion. We are, therefore, carrecting the matter by revisi`g the a'ssessment
rall to uti1ize 120 fe�t as the assessable frontage. On this bas's, the assess-
ment charges should be corrected as fallaws: �

With regard to assessments for the above project, Mr. Samuel Lecht�nan owner of
parcel 27881, Lot 15 Gailand Heights Add, requests certain informa�tion with re-
gard to utility costs and assessment calculation. The following is our reply:
The platted dimensions of the lot are as follows:
Width = 115•5 feet on the souih end, 126.4 feet on the north,end for an
average width of 120.9 feet.
Length = 3�5•3 feet.
In the process of constructing the frontage road, the Village acquired 5.3 feet
of the south end of the lot leaving the actual length at 300 feet� In reviewing
the assessment calculations we note that this deduction was not mide from our
calculation with the result that a new calculation is in order.
As far as utility cost breakdown is concerned, we.reported at the''
hearing that the cost of installing sanitary sewers was $15.74 per
while the cost of installing water mains was $11.76 per assessable
assessment rate established by the Council was $14.00 per foot for
$11.00 per foot for water.
Utilizing the corrected length, we herewith recalculate the assess
parcel as follows:

The general assessment procedure is to assess the average width pllus ten (10) feet
around the corner, plus all of the side lot frontage in excess of i150 feet. 41e

assess everything in excess of 150 feet on the side lot because 150 feet is the

be fiaken to control excessive runoff and resulfiing siltation:
The first step wil{ be the cansfirucfiion of a temparary retention area from selected mafier-
ia! on the site (clays and impervious materials) on o�tlot 1 and lots 1, 2 aind 3 of Block
1 wifih 2 to 1 side s(apes (as shawn on grading plan}. Preliminary engineef ing calcula-
tions�give a�approximate discharge of 5p cubic feet per second to this re�entian area '
based on a 22 inch rainfail. �F�is esfiimafie includes both i�he area in Somerset (< plus
the discharge from the 21 inch storm sewer at �ansfard Lane and Round Hi�l Road fram the
� exisfiing Samersefi praperfiy to fihe east of Samersefi li. Approxima#ely 2 the water results
from discharge from the existing Somerset property and 2 from the collecti'on af water
on the Somersefi I1 property. This would require about b0,000 cubie feet of starage with
a 4$ inch out(et pipe and flared end-section with a concrete dam weir on the retention

material on the site (clay and impervious materials) with 1 to 1 side slopes �(as shown in

The seeding will be in accordance with specification 3876,� Minnesota Highway Depart-
ment Mixture #7 as follows: 20°lo Timothy, 42.9°lo Smooth Bromegrass, 28:6% Perennial
Ryegrass,and 8.5% Birdsfoot Tre�oil R'empire" at the rate of 35 pounds per acre. The
foregoing mixture was selected because it can be seecled•iri late fall. If th�e seeding can-
not be accomplished in the fall, another mixture may be used that is rated fio produce
equivalent results as Mixture #7. The future street areas will be seeded als�o. ��

The following measures will be�taken to deal,with the discharge from the.e �isting Som�rset
properfiy: -A 21" reinforced cpncrete pipe will be connected at the existing discharge at
Lansford Lane and Round Hill �Road and continued on the storm sewer easement on lots _
3 and 4, Block 2 and continued to the west side of the north-south street to� be constructed�.
A drop catch basin/manhole will be constructed at this point which will belconnected to'
the storm sewer on the future north-south street. A pipe will discharge� from this catch
basin/manhole to the northeast part of the retention area on the easement on lots 2 and 3,
Block 1 from a flared end section'at elevation 828+, .(as shown on grading'plan) •

AN ORDINANCE ESTABLISHING A MUNICIPAL
LIQUOR STORE
The Village Council of the Village of Mendota
County, �iinnesota, ordains as follows:

Section 1. Definition of Terms. As used in this ordinance
the following terms snall be deemed to have the following meanings:
(a) "Intoxicating liquor" and "liquor" mean etHyl alcohol,
distilled, fermented, spiri�tuous, vinous, and malt beverag�s
containing in excess of 3.2 per cent of alcohol,by weight.
(b) "Sale" and "sell" and "sold" mean all bartirs and all
manners or means of furnishing intoxicatinq liquor including
such furnishing in violation or evasion of law.',I
(c) "Off-sale" means the sale of liquor in original packag�s
in retail stores for consumption off or away from the premises
where sold. �
(d) "On-sale" means the sale of liquor by the glass or con-
sumption on the premises only. ')
(e} Non-intoxicating malt liquor is any malt lrquor containing
not less than one-half of one per cent alcohol by volume nar
more than 3.2 per cent alcohol by weight and is�la fermented
malt beverage for the purposes of AZinr,esota Statutes 1971,
Sections 340.44 to 340.56. ���
( f) "Pdinor" means any person under 2I years of, age .
Section 2. Municipal Liquor Store Established.; There is h�reby
established a municipal liquor store for the "off sa e" sale of intoxi-
cating I.iquor. The off sale of intoxicating liquor �t retail elsewhere
in the Village, or by anyone not employed in said mu��icipal liquor
store� is hereby prohibited; providec�, however, that�the Village Counc:
may grar_t on-sale licenses as provided by the applic� le D4innesota
Statutes. I
Section 3. Location and Operation.
(a) The municipal liquor store shall be locatec
place in the Village as the Village Council may have
mined or shall hereafter d�termine. No premises upoi
tax�s, installments of special assessments, or other
delinquent shall be leased for such municipal liquor,

Section 4. Municipal. Lic�uor Store Fund Created��

(a) A Municipal Liquor Store Fund is hereby cr�ated, in which
all revenue recea.u�d fram the operation ai the municip�l ].iquor s�ore
shall be depc,sited and £rom which aJ.I aperating expens�s shall be
paid. By resolu�ion of the Vil].age Council. surpluses �.ccumulating
in the Municipal Liquor Store Fund may Ue transferred to the general
fund or to any other appropriate fund of the Va.11age arid ma� be expended
for any municipal purpose. The Vill�ge Council may by resolution here-
tofore and hereafter adaptea authora.ze the issuance of Municipal Liqucar
Store revenue bonds, payabl� from the net rev�nues of aid municipa.l
liquar store, for the purpose o�' providing moneys for ��onstruction
o� buildings and other capital improvements, and for the prova.sion
of inerchandise, equipment furnishings and working capi�al necessary
for said municipal liquor s�.ore, upon such terms as th� Village Council
may deem n�cessary and expedient. The Vill.age CounciJ.�lmay pledge net
revenues of said mun.icipal liquor store, a£ter payment of reasonable
and cu.rren.t costs of operatian and main�.e�ance and a reasanable stock
af m�rchandise for resale, �o the paym�nt of such bond.� and ixzterest
ther�on. The Village Council may make r�r continue any pledge �f net
revenues of said municipal ].iquor store contained in a` resolu�ion oz
resolutians of the Village Council heretafore or herea ter ado�tea
ta �he payment of bonds of the Viliage a.ssued for any '�urpose autha-
rized by law for th� paymen� of which the Village is a thorized to ,
pledge such revenues. The Village Council may in and �by such resolu-
tion or r�solutions make on behalf of the Village all��uch covenants
as may be reasonably required for the security of the��c�lders af such
bonds, and no mon.eys in the 2�unicipal Liquor S�or� Furi shall be
transferred or expended exc�pt as �rov�.d�d in such resolution whi3.e
any af s�id boncl� shall be auts�.anding and unpaid. �`

(b) The procedure prescrived by law shall be f�llowed in
the handling of municipal liquor store funds as for re eipts and
disbursements of Village funds generally. �
• Section 5. Hours and Days of. Sale. The munici al liquor
store shalT observe the following restrictions upon th' hours of
operation: . i
(a) No sale of intoxicating liquor shall be ma'�e after �
one a.m. on Sunday, nor until eight a.m. on Monday, no�r between the
hours of one a.m. and eight o'clock p.m. on the day of�larly statewide
' election. No "off-sale" shall be made before eight o''clock a.m. or
after eight o'clock p.m. of any day except Saturday, o�i which day "off--
sale" may be made until ten o`clock p.m. No "off-sale'ti shall be made
on New Years Day, January 1; Independence Day, July 4;'IThanksgiving
Day; or Christmas Day; December 25; but on the evening� preceding
such days, if the sale of liquor is not otherwise proh�bited on such
evenings, "off-sales" may be made until ten o'clock p.z�., except that
no "off-sale" sha11 be made on December 24 after eight�o'clock p.m.
(b) The municipal liquor store shall not be op n for business
of any kind during the hours when sales of intoxicatin� liquor are
prohibited. (�
Section 6. Conditions of Operation and Restrict�ions on Sales.
(a) No business other than the sale of liquor �hall be carried
on in the municipal liquor store except the retcail sal of cigars,
cigarettes, ice, a11 forms of tobacco, non-intoxicatin'� malt beverages,
soft drinks, and any other products or items permitted�to be sold by
