RESOLUTION CORRECTING RESOLUTION NO. 79-',39
WHEREAS, Resolution No. 79-39 adopted by this Council o;n April 3, 1979,
provided for the settlement of certain assessment appeabls with respect
to the Mayfield Heights Lane Improvement Project (Improiement iVo. 77,
Project No. 1), and
WHEREAS, the total assessment figures used in said reso'lution with
respect to the Posnansky Parcel No. 76402-110-03 inadve�tently was
$1,686.06 rather than the correct figure which was $1,1�68.06, and
WHEREAS, the Council desires to correct said ResolutiorilNo. 79-39
so as to correct said figures as set forth above.
NOW THEREFORE, the City Council of the City of Mendota �ieights does
hereby adopt the following resolution correcting in itslentirety said
Resolution No. 79-3.9:
WHEREAS, Stanley K.and Delores Karon, the owners of pro
in the City of Mendota Heights identified as Tax Parcel
090-1, have appealed from the assessments levied agains
in the total amount of $2,199.60 by reason of the Mayfi
land improvement project (heretofore known and numbered
No. 77, Project No. 1), and �

WHEREAS, Michael A. and S. K. Posnansky are the owners of property
identified as Tax Parcel No. 02300-050-52 and Tax Parcel No. 76402-110-03
against which the total assessments for the above-descr�bed improvements
were in the respective amounts of $1,553.70 and $1,168.'06 respectively,

WHEREAS, the above-named individuals have filed appealslfrom the assess-
ments levied against their respective properties by rea�on of the
above-described improvements, and
WHEREAS, Stanley E. and Delores Karon have agreed to di'smiss their
assessment appeal in consideration for the City reduciri� the assessment
against their parcel to the amount of $1,200.00, and �

WHEREAS, Michael A. and S. K. Posnansky have agreed to'dismiss their
appeal with respect to Tax Parcel No. 76402-110-03 in consideration
for the City agreeing to reduce the total assessment against said
parcel to the sum of $584.03, and �I
WHEREAS, said Michael A. Posnansky and S. K. Posnansky
to settle their appeal with respect to Tax Parcel No. 0
in consideration for the City agreeing to defer the mak
assessment against said parcel until such time as the p

WHEREAS, the legal description of said Tax Parcel No. 0�300-050-52
is more particularly described as the following property situated
in Dakota County, Minnesota, to-wit: II
That part of the Northwest 1/4 of the Southwest 1/` of
Section 23, Township 28, Range 23 described as fol ows:
Commencing at the Southeast corner thereof, thence West
121.20 feet to the point of beginning, thence cont'nue
West 215.80 feet, thence due North 100 feet, thence due
East 215.80 feet, and thence South 100 feet to thelpoint
of beginning. '
WHEREAS, compromise and settlement of said assessment appeals on
the basis set forth above would result in the saving tolthe City
of additional legal expense and expert witness fees required in
order to litigate said assessment appeals in court, and �
WHEREAS, the City Attorney has recommended that settlem nt of said
appeals on the basis set forth above would, in his opiri'on, be in the
best interests of the City. '
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Counci�. of the City
of Mendota Heights, Minnesota, as follows: �
1) That the settlement appeals of Stanley E. and belores
Karon and Michael A. Posnansky and S. K. Posnansky relative
to the parcels set forth above be compromised and �settled
on the basis more particularly set forth above, and
2) The City Attorney be and is hereby authorized'and directed
to take all steps and execute any and all document�s required
to consummate the settlement of said appeals. -'I
