RESOLUTION TO DESIGNATE AND ESTABLISH A DEVELOPMENT DI
NO. 1. PURSUANT TO THE PROVISIONS OF SECTION 472 Al ,TO
OF THE MINNESOTA STATUTES AND ESTABLISH A TAX INCREMEN
DISTRICT A, B, AND C PURSUANT TO THE PROVISIONS OF SEC
273.71 to 273.78 INCLUSIVE OF THE MINNESOTA STATUTES (
322, LAWS OF MINNESOTA, 1979) AND ADOPTING A TAX INCRE
FINANCE PLAN.

USIVE
WHEREAS, the City Council of the City of Mendota Heights, Minnesota has
determined that it is necessary and desirable and in the public iIcterest to
designate, establish, develop and administer a development district in the
City of Mendota Heights, Minnesota pursuant to the provisions of section
472A.01 to 472A.13, inclusive of the Minnesota Statutes; and
WHEREAS, the Planning Commission of,the City of Mendota Hei'hts has
been consulted with regard to the proposed district; and
WHEREAS, the City Council of the City of Mendota Heights ha' determined
that tax increment financing will be necessary to finance the public costs
associated with the development project within the tax increment districts
A, B, and C, pursuant to Minnesota Statutes 273.71 to 273.78 inclusive; and
WHEREAS, a public hearing was held on May 5, 1981, at 7:30 o'clock P.M.
before the City Council in the Council Chambers in the City Hall,lin Mendota
Heights, Minnesota,"notice of which has been published once in the official
newspaper for the City, not less than ten, nor more than thirty days prior
to May 5, 1981; and
WHEREAS, the City of Mendota Heights has fully informed representatives of
the District No. 197 School Board and the Dakota County Board of Commissioners, of
the fiscal and economic implications of the proposed development district No. 1,
and tax increment districts A, B, and C; .and
WHEREAS, at said public hearing all persons and parties were given full
opportunity to present written or oral testimony, comments, objections,
suggestions, and other matters, all of which were duly considered by the
Council; and

WHEREAS, the creation of the proposed districts A, B, and C are necessary
and desirable in order to provide employment opportunities, to increase tax
base, and to improve the general economy of the State of Minnesota; and
WHEREAS, the proposed development and tax increment districts A, B, and C
are intended to (a) encourage the retention and expansion of existing industrial
park; (b) provide land for the expansion of existing industrial park; (c) improve
the financial base of the City; (d) provide increased employment 9pportunities
and as much as possible, seek business which would employ the unemployed and
under -employed; and

WHEREAS, the City of Mendota Heights is prepared for the relocation of
individuals, families and businesses that may be displaced as they result of
carrying out the project; and
WHEREAS, the proposed redevelopment would not occur solely +through private
investment within the reasonably foreseeable future and, therefor) the use of
tax increment financing is deemed necessary; and
WHEREAS, the tax increment financing plan will afford maxi opportunity
opportunity
consistent with the sound needs of the municipality as a whole, for the
redevelopment of the district by private enterprise; and
WHEREAS, the tax increment financing plan conforms to the general plan
for the redevelopment of the municipality;as a whole; and
WHEREAS, the projects comprising the proposed tax incrementlfinancing
district are a redevelopment district requiring the removal of nonLconforminq
land uses and/or removal or substantial renovation of substandard,.buildings;
and
WHEREAS, the City Council of the City of Mendota Heights, Minnesota, finds
that the land in the redevelopment district area A is blighted and predominantly
occupied by buildings, streets, utilities or other improvements aid 20 percent
of the buildings are found to require substantial renovation or clearance in
order to remove such existing conditions as: inadequate street layout, incom-
patable uses or land use relationships, overcrowding of buildings on the land,
excessive dwelling unit density, obsolete'buildings not suitable for improvement
or conversion, or other identified hazards to the health, safety and general
well-being of the community; and
WHEREAS, the City Council of the City of Mendota Heights, Minnesota,
finds the land in redevelopment districts,"B" and "C" is blighted, and not
predominantly occupied by buildings, streets, utilities or other improvements,
but at least 80 percent of the total acreage of such land has a fair market
value upon inclusion in the redevelopment,district which, when added to the
estimated cost of preparing the land use,,including utilities, if any, exceeds
its anticipated fair market value after completion of said preparation; and

NOW THEREFORE, BE IT RESOLVED {BY THE ^CITY COUNCIL OF THE CITY OF MENDOTA
HEIGHTS, does hereby designate and establish Development District No. 1, and a
tax increment redevelopment district, adopts a finance plan and development
program for said tax increment redevelopment district and finds:
1) that the proposed development would not occur solely through
private investment within the reasonable forseeable future
and, therefore, the use of tax increment financing is deemed
necessary; and
2) that the tax increment financing plan will afford max
tunity consistent with the sound needs of the City as
the development of the tax increment economic develop
by private enterprise; and
3) that the tax increment financing plan conforms to the
